This is my response to the Windstream Customer Feedback Request:

I was overcharged for several months a year or two ago by Nuvox, treated rudly by customer serivce and ever since then have waited for the 3 year contract to expire. When it did I started a new service with Deltacom who requested the service move 09/29/11. I already paid for October in advance Windstream continued to bill me for service you did not provide and now say it's $1800. You are a bunch a thieves I am in the process of posting this complaint on the internet and if there is a FCC location plan to post there as well. You owe me for the October $400. Your customer service did not even have my telephone number in the system because it was with Deltacom and continued to bill. When the bill doubled in November 2011, I started calling and then there were the need for written cancellation orders, then it needed to be on a letter head. You should have stopped billing and refunded the overpayment for October. I still can't tell if you stopped billing because the cost is more every time I see a statement. Now you are saying a new contract automatically started and I need to keep paying. You need to cancel all these bogus charges. Why don't you act like a professional business instead of a bunch of greedy crooks.

On March 15, 2012, the business provided the following information:

Dear Ms. Plant, 


This letter acknowledges our receipt of the notice of the complaint filed by Ken Gelbach. We look forward to addressing the customer's concerns and resolving this matter. 


From the filings, we understand that the customer is disputing an amount owed after the service should have been cancelled. 


With respect to Windstream's response, my office has been advised Mr. Gelbach's account was billed $2040.45 for early termination fees in error. The early termination fees were calculated with five months remaining on the contract, but the fees should have been calculated with only two months remaining. A credit for $1222.65 has been applied to the account, leaving a balance of $817.80 owed. All credits and debits have been applied and appeared on the February invoice.


Customer signed a contract (CSA #1068650) on 4/24/2008 for a 3-year term with auto-renewal and the Monthly Recurring Charge of $408.90. Contract (CSA # 1068650) auto renewed on 3/24/2011 with new term date of 3/24/2012. Mr. Gelbach's service was disconnected on 1/5/2012, two months before the end of the contract.


Windstream received a Local Service Request from ITC DeltaCom to partially port two numbers, 704-339-0545, and 704-339-0785 on 9/14/11. Windstream received a Letter Of Disconnect to disconnect the remaining service on 11/23/2011 from customer. An email was sent to the email address Windstream has on file at gelbach@gelbachdesigns.com to confirm disconnect letter. There are not any notes on the account indicating customer responded to the email. If customer insists that service should have been disconnected in November 2011, then the early termination fee would have to be recalculated to bill for five months instead of two months.


The remaining services were disconnected on 1/5/2012.


We regret any inconvenience this matter may have caused Mr. Gelbach. Please feel free to contact me if you should have any additional questions or concerns.

Contract Agreed upon 3 year cost - started 06/30/08 Ends 06/30/11 - During the contract they constantly added to the agreed upon charges


So they ported my service in September 29, 2011, kept billing me full price for service they did not provide after they ported my service. Automatically started my contract another year with no approval, discussion or notification to me. And now I only owe $817.80 for no service from them for 2 months (I had paid the October service in advance, so really it was 3 months they charged full price for doing nothing). 


Windstream is a bunch of crooks, They provided adequate service for 3 years (Actually that was AT&T they just resell it). About 2 years ago for about 6 months they overcharged me and finally agreed to stop the charges. They also told me they could charge anything they wanted and I signed an agreement that gave that to them. I counted the days until the contract was up. Waited until it was complete and signed with Earthlink. Now all this.
