Americredit was told to make two payments to bring the account current so i did and they came and took our van anyway Arlington Texas

americredit doesnt stand by whay they say. my husband and me made payments on time and if we were ever late it was no more than 2 months. we were working with a lady and she told us to make 2 payments to bring us current and thats what we did. the only payment we didnt pay was july because i was in the hospital. that was the reason why there were times when we were late was due to my health and when that happened my husband wouldnt be working. as soon as he went back to work we would take care of our payments.

they camein august of 2007 and took our van, they wouldnt tell us where they were taking it,and would not let us take our belongings out. we have been trying to get a lawyer to help us fight this but nobody will help? they sent this to a jeff winager at a collections and he called us liers, he said americredit doesnt have anyone in there departments that can arrange payment plans.

im doing this alone know ,my husband got deployed and i need to fight this and i want them to show me where we were 3 months behind like they said , they are not counting the 2 payments we made. we were only 1 payment behind. they didnt give us any notice of what they were doing, i was put in the hospital in july got out in august and a few days later they came and took it.

please if you know someone that can help me fight this please rell me ,i need to do this for my kids and my husband.

When you make a payment arrangement to get caught up, you cannot be late on your next regular payment. You stated that you made the May and June payment to get caught up, but you still hadn't paid July yet and they took the van in August.

When you make an arrangement, at least be ontime with a few payments after that. This way they don't think they'll have to make arrangements with you every 3 months. When they see you still cannot make your payments after the arrangement, they see you as a risk and take the auto.

What exactly are you going to fight? You plainly stated you have a history of making late payments and you've been two months late in the past. Americredit finances people who have shakey credit. That's why your interest rate is probably in the double digit range. When you sign the contract, YOU AGREE to make each and every payment on time and Americredit agrees to lend you the money to buy the car. That's the deal, that's what YOU agreed to. Americredit is at significant risk when lending money to people with shakey credit. When you miss a payment, they get antsy. When YOU fail to make payments ON TIME, they can and often do repo the car. You can't get an attorney because you have no case. They don't need to tell you in-advance of sending the repo guy. Your contract tells you the terms of the deal.

I know this isn't what you want to hear but I'm not going to stroke you. It is regretable you have been ill and I hope you are doing much better now. But unfortunately, Americredit or any other financing operation has one interest and that's getting its payments ON TIME as AGREED to by the custommer.
