I was also promised to drop a percent from 6.5 to 5.5 well its now 7.5 so it was raised a full percent.When the appraiser came to my home he was here for about 15min and looked around he then left. The agent called me about 30 min after the agent left (ameriquest agent) and told me my appraisel came in @100,000.00. Now I paid 83,000.00 for my home only a year earlier. He told me the appraisal was to low so I figured ok I won't finance he says well let me call my appraiser and I'll call you back. I said ok.
Two hours later my phone rang it was the ameriquest agent. He was upbeat and was happy to get me on the phone. He then says hey GREAT NEWS. I talked to the appraiser and he says that your home is worth 130.000.00. I was like wow that's great.
Boy was I in for a huge suprise. I then contacted the office the next day (after I signed papers on the day before) and asked to talk to the agent (jason) and they guy on the phone says he doesn't work here anymore?
Wow now I smell a skunk. The refinance I agreed on from ameriquest isn't the one I agreed on the old bait and switch. I tried to make the payments from july of 2004 until december 2005 and it caught up to me I was 5 days late on my payment when I sent it in and they sent it back to me I called and they said I need to make arraingments huh what the hell are they talking about?
Well they aren't takeing any money from me and have forced me into foreclosure and my home is up for sale on april 6 2006. So with all that said if anyone has any info they can pass on to me that would be great. I am seeing my lawyer friday morning and will post on how that all went.

My father passed away 4 years ago at the age of 80; he too was victim. My fathers first payment to Ameriquest would have been $984 dollars, more then his social security payment due in July; a payment he never lived to make. Ameriquest got their money as the property had to be sold but I am convinced that the stress of this situation was what drove him to have his heart failure.
There were so many discrepancies in his paperwork that took me over 8 months to get. Some of the loan documents said he was 50 some years of age, other parts 30 some years of age. His loan documents said he was in business for himeself and "owned" a business; a business that did not exist.
I realize it has been four years, but some things are really hard to just let go. If you have any suggestions or if I should pursue further give me your thoughts.

Lawsuit targeting Ameriquest adds Arnall to its sights
Lawyers have asked to add Roland Arnall as a defendant, saying he had a hand in abuses at the sub-prime lender.

Ameriquest Mortgage Co. founder Roland Arnall seemed to have shrugged off complaints of lending abuses early last year, when the sub-prime lender agreed to pay $325 million to settle allegations by 49 states of misrepresented loan terms, hidden fees, puffed-up appraisals and fabricated borrower income statements.
The Los Angeles billionaire blamed rogue employees for the problems. Consumer activists said a promised overhaul of operations at the Orange-based company would set high standards for the sub-prime industry, which caters to borrowers with poor credit, heavy debts or no money for down payments.
Arnall, whose confirmation as U.S. ambassador to the Netherlands had been held up because of the litigation, won the Senate's endorsement for the diplomatic post soon after the settlement was reached.
But on Monday, Arnall's accountability was again front and center as attorneys for Ameriquest customers asked a judge to add him as a defendant in a private lawsuit.
In a request filed in federal court in Chicago, lawyers for the borrowers, who are seeking to combine 20 suits into one class action, contend that Arnall made decisions that resulted in abuses, blocked attempts to reform Ameriquest and drained it of its profit before virtually shutting it down as the sub-prime industry imploded.
Ameriquest and its affiliates "were the alter ego" of Arnall, the suit says. "Assets of the Ameriquest entities were transferred to Arnall with the actual intent to hinder, delay or defraud the plaintiffs in this action."
In an e-mailed statement, Lisa Cohen, a spokeswoman for Arnall, said he had "stepped down from the company's board almost two years ago far in advance of the meltdown of the non-prime industry and at a time when the company was profitable and financially stable."
She added that lawyers for the plaintiffs were "trying to generate interest in their case by tarnishing the ambassador."
A spokesman for Ameriquest declined to comment.
The motion to add Arnall as a defendant is to be heard June 26 by U.S. District Judge Marvin E. Aspen in Chicago.
The current defendants are Ameriquest, parent company ACC Capital Holdings Corp. and various subsidiaries, affiliates and agents.
Ameriquest's $325-million settlement with the states was the second-largest ever in a predatory lending case. The largest was by Household International, which settled for $484 million with 50 states in 2002.
But private attorneys say that many Ameriquest customers would recover more by declining to join in the settlement with the states and instead taking part in the private litigation.
In most cases, the settlement with the states would result in awards amounting to hundreds of dollars for each borrower, though their actual damages often ran into the tens of thousands of dollars each, said attorney Gary Klein of Boston, one of the lead lawyers in the private lawsuits.
Klein said the plaintiffs would seek billions of dollars in damages, including punitive damages and treble damages under many state laws for "bait and switch" tactics.
Ameriquest, which in its glory days sponsored Major League Baseball, the Super Bowl XXXIX halftime show and a Rolling Stones tour, was ranked the country's top sub-prime lender in 2004 and 2005. But the Ameriquest companies fell from the top 10 among sub-prime lenders in the third quarter last year, according to National Mortgage News.
Ameriquest Mortgage last year shut down 270 offices around the country and this March shuttered six operational offices, leaving only a small staff working at the headquarters in Orange.
Arnall remains the majority owner of Ameriquest and its affiliates. When he became ambassador, he was required to give up a role in running the company.
The plaintiffs' filing Monday cites allegations in an Orange County Superior Court lawsuit in which Wayne A. Lee, a longtime executive for Arnall, accuses the billionaire of thwarting Lee's efforts to reform the company's sales practices.
Lee's lawsuit names the company as a defendant but not Arnall. It claims that Ameriquest reneged on a deal to pay him $30 million after he left in frustration in 2005.
An attorney for the company has called Lee's suit "a ridiculous work of fiction" and has said Lee is "attempting to use baseless and inflammatory allegations to extract money to which he is not entitled."

realiZed what they were trying to do and
within the 3 days cancelled the contract I had signed and I think it was the smartest thing I have ever done. I can't
imagine how I would have dealt with the
situation they were trying to get me in.
I had decided to refiance what I owed on my house and get some extra money
$10,000 to pay for some small debts and just have my mortgage payment.
I saw an add on yahoo home page and I contacted them and explained what I wanted
... a lower interest rate which would lower my payment about $100.00 a month as I had financed when rates were much higher.
My credit score was good but they told me
that they would finance me at a higher rate and after 4 months if I paid that on time then my credit score would go
up max and they would refinance at the lowest rate. My payment was going to be almost twice what I was paying but I was assured by the agent this would only be for a few months. I was very sceptical
but the agent kept telling me..trust me I
am not going to lie to you...I am trying
to help you.
In just a few days they called and said the loan was ready for me to sign and they would bring the paperwork to me to sign...this group was in New Orleans and I was about 3 hours away. The person with the paperwork called and wanted me to meet her at McDonald's on the outskirt of town. She didn't want to come to my home and I had reservations about doing personal business in a public plaae where anyone I knew could walk in and it
was nobody's business. When I got there
she had her husband and kids with her..not good company image!!!
The shocker was when I got the paperwork
it was nothing like we had talked about.
I ask her questions but she was only a
notary type person. I signed them and when
I got home I realized they had tried to lie and scam me. The new mortgage was for 95% of my home value. They were giving me more than I had ask for to pay off bills and I didn't want that money and with all the closing cost and fees they had taken all my equity. My payment was nearly $900 a month. I called the agent and he said but it is for only a few months and then we will refinance at the low rate....I knew I had been had and as soon as I could I faxed the notice to cancell to their Calfornia Office...
Then the agent called and begin to harass me even saying that on Sat he would be in my area and wanted to
talk with me about this...I kept telling
no way I will agree to this I have a
payment of $434.00 now... no way will I agree to this and have no equity left in my house.
He finally wanted me to talk to his boss
who he thought would confirm his story.
He transferred me and this manager guy's
story didn't go along with the agents. He
said the earliest I could get refinanced with a lower rate and payment was at
least a year and when I questioned him about the story I had been told and how
my loan had been written up to eat up all the equity in my house...he hung up...
GOOD REDIANCE !!!
THANKFUL EVERYDAY I CANCELLED THAT LOAN I

We are under the 2 week mark to get off the property my family has owmed for 20+ years. Mr. B was able to keep us in our home through the Holidays or else we would have been out on our butts in Dec.
I was a dog breeder , owner of horses, proud mom of 3 that when asked awww mom cant we have cats, chickens and guinease and so on I said sure we have 10 acres you guys can do the fair like I did growing up never ever thought that I would have to scramble to find homes for the animals we love and care for. while my children say it's ok mom we understand....gut wrenching for the past 2 weeks
We have spent our time packing, finding homes for pets and trying to find a roof to put over our heads not so easy with the credit A'quest has left us with not many people want to sell or rent to you once foreclosure and eviction are in the picture. Before I was afraid to hear the phone ring to many nasty phone calls from those working for a'quest but now I pray please ring and let the caller say sure you can move in pronto or hear yes they will extend you til the 1st of June considering all that you have to do to get off the land or yes they are willing to give you a fair loan. Anything as long as I don't have to watch my children give up anything else they love.
I don't mean for this to be a big soap box. I just hope all goes better then it has for my family and I pray to god that not many has to go through what we have.

We need to protect our selves by the big organizations so the "Dollar Monster" wont get us.I signed in for the "United08" party asked them to help Us....

Now with that said, people all across the nation have been ript off, not because they are stupid or they didnt get a second or third opinion but because Ameriquest offered many many people a good deal but didnt show all of what they were really offering.
I didnt even get papers @ closing. I got a huge run around for months after my closing. And just one more thing their smart guy, I had my appraisel and closing all in about 2 days and when you are asking question to these dip shits on the phone and keep getting a run around, like Im not sure I will have to get back to you. Or call this guy or call this guy and these guys are bigger dip s**t then the last one you talked to.
So with that all said please keep your mouth shut. You have no idea what we are all going through and what this company has done to many people. Ameriquest will PAY for what they have done to my family and I WILL keep my home. I will soon be leaving for Iraq and for 2years I have been trying to have Ameriquest fix this huge mess they have made and still they run and hide.
So when they are ready to talk they will have to wait on me now. I cant wait for when I come back from Iraq because if things arent settled I will be on ever TV station telling them my story right from what they have done to me and my family all the way to me comming home from Iraq and what they are still doing to me and my family.
Im sure that their will be a huge out poor then about ameriquest and what they are doing not only to the everyday citizen but also a United States Soldier. You do the Math.

Ken thank you for all your help and starting this thread. I have been up for the past 2 days. I am burned out by this Americrap monster.
I found and spoke with MrH I praise him. I am going to see my attorney in the morning bringing LOADS of paperwork to him.
My story is the same as every ones.I have been to hell and back 6 times now for the 7the time Scumquest grew sme big kahoonas and right after I spoke to Mr H a sherif came to my door to serve me a note for Civil-Action EJECTMENT. they are pathetic
I own a $200.000 home I refinanced with Scumquest in 2001 for $50.000 in 2003 I injured my back I have 4 herniated lower lumbar disks. I was a two months late I called them about my misfortune and they said I was ok to send in the payment and so I did. in the meanwile they never picked up the cash from western union instead they send me ACT 91 I have been in forclosure with them since 2003. Fighting to keep my home. God I have too much equity and sweat equity to them just to take my home as YOu said they need to go down.
In the begining I did not catch up why so much trouble, well when I was sick and ready to throw in the towel the truth came out. the buyers attorney told me to hire an attorney whenever they did the title search so I can have a closing and go on with my life without scumquest they found so much fraudd they backe off and did not want to do anything with buying my home. they decressed (now I know why) so I couldn't refinance. period. the value on my appraisal never removed my payoffs from the title showed the loan twice on my credit report and have put so much fraud on my deed and credit report after my bancrupcy chapter 13 was dismissed I began to receive credit card statements from creditors I never even heard of. OMG this is too much
I contacted Dr Phil and Hillary clinton and senator Casey here in Pa and just like others I can get over the fact that everywhere I went in the city of scranton and sopke to every local and state agency people are un informed and dumb and dont want to hear it. This makes me even more sad and frustrated. I am burned out now I will post my update tomorrow after I talk with the lawyer. well just one more thing before I try to get some ZZZZ's
I think they went on a foreclosure rampage to gain equity for themselves so by the time they go to bail out and sell the company they will sell it as is, with all these homes who wouldn;t want that. just a thought. good night

To the people who were sooo surprised that there house had appraised 50K in 5 months, then come to find out it not worth that. Thats your fault, I'm not being rude, I'm just being honest. How are you not going to know the true value of your home? You weren't complaining when you were taking that check to the bank to cash it.
And stated deals, hey if the loan officer tells you you need to state a certain ammount in order to get the loan done and you do it and now you can't afford the house. You're just as much to blame as the LO. You should have thought about it then before you wrote a letter saying you owned an ice cream stand making 10K/mth.
So really you should have thought about all this before you signed on the dotted line.
Keep in mind, a loan officer is a salesman, just like when you go to buy your new car, or TV, or even that new vacume, its all about sales. If they can get it done, they'll do it, not just AMC LO's, but everywhere.
For future reference, if you don't think your house appraises for what they say, for gods sake get your own appraisal and use that. Also don't state you make more than what you do if you know you're not going to be able to afford it.
And to Beth the LO that has taken so much business from AMC. I don't know why you're bragging about that. Its not hard, their rates are horrible, they always use ARM's, and their fees are outrageous. My 5 yr old brother can steal an AMC loan.
Again, I'm sorry about the troubles and problems you guys are having, but its 50/50, you're just as much to blame as them.

I did talk to several attorney's and was told that we had a case but there was not enough money in it for them. I went to legalhelp.com in Milwaukee and found a wonderful attorney who is now helping us. Of course Ameriquest will not talk to him either so this week we're filing a federal lawsuit against Ameriquest.
I won't give up. I'm told that it doesn't matter if Ameriquest is sold. If someone is stupid enough to buy the mortgage section of this corporation, they will have to assume all liability that comes along with it. Don't wait for Ameriquest to answer your calls or letters, they won't or if they do they'll try to get you to go after the appraiser. Don't fall for it. If you go after the appraiser, you'll loose your chance to go after them. Find an attorney who's willing to take your case and file the suit and go after Ameriquest and the appraiser at the same time.
I always though myself an intelligent women and I refuse to allow this company to take advantage of people who work hard and trust in people.

Ameriquest was willing to deed back one house when i filed complaints but they made me sign a stipulation. That was before i realized the houses were trash and the price was inflated three times the amount. Also they failed to mention I was part of the class in the class action. in the loan docs tehy had me living in the four duplexes when I live in CA! I couldnt figure out why all the tax bills were coming to each house. Anyway the appraiser I reported skipped the state knowing it was the end of the line and the seller is being investigated by the prosecutors office, i also turned him in for possible tax fraud.
I retained an attorney who is willing to take this on just to file a case. She is doing it as a favor so the SOL doesn't run out. Then I have to find an attorney willing to take this on contingency. If i find lots of attorneys in many states suing for the same reasons it bolsters my case. I believe i can nully this stupid stipulation as I really didnt understand it, and I foudn out there were state and city disclosure which I was suppose to see and never seen. one in fact was signed by the seller rather than me. Ameriquest knew all this but wanted to rip me off and the taxpayers (using fanny mae's money).
anyway I want to get ahold of your lawyere and looked at all you posts and cant figure out who he is. I know rippoff reports bleeps out your email address but you give the guys name out or hint about it?

I only have one thing to say to the people who defend Ameriquest, if their wasnt any merit in my case and 1000s of other cases this would of all been done before it even started!!
I went to my Attornys office today to drop off some more paperwork and their was yet another client their to see them on a lawsuit.
This is still all at the begining stages of the lawsuit and im willing to keep fighting for another year or two if I have to.

When completing a loan, by federal law the lender is required to produce a copy of the appraisal at closing or if the loan does not close - ONLY if you specifically ask for it in writing. The appraiser by the same law cannot directly send you a copy of the appraisal.
When getting an appraisal done always get the name of the appraiser and whether they are a trainee or licensed - a trainee can visit the house alone BUT most mortgage companies require the trainee to be supervised and the report MUST state the supervisor inspected the work and he must sign the report stating so. If the appraisal states he inspected and he wasn't there report him to your state appraisal board and get a lawyer.
If you have representation you can have your lawyer do a request for production for the appraisal from the mortgage company OR at least get the name of the appraiser and send him the req for production for the appraisal AND work folder. Appraiser are required to keep this information for 3 years.
Once you have the original appraisal you can have a forensic or retrospective appraisal done by a reputable appraiser that shows your true value on the date of the original appraisal. These typically cost more than a regular appraisal but they could be worth the money. I am a Certified Residential Appraiser in Massachusetts.
Also for those who are in trouble you can send a fair credit letter stating that you believe that you are being made a victim of a coerced or constructed foreclosure.
Dont send it to Ameriquest - send it the their parent company ACC Capital Holdings, 1100 Town and Country Road, Orange, CA 92868 the fax number is public record from their SEC report. (I dont have it with me) address it to the CEO Aseem Mital or COB Dawn Arnall One of their assistants will call you back sooner than some one in home retention will. Make sure your details are correct and to the point and keep the names and contact times of everyone you have spoken to.
Once the owners office calls the peon you typically get a little bit better treatment.

Ameriquest probably is going to be sold and the buyer is going to make a ton of money. Your problem is, that once this company is in fact sold, what happens to all of the on-going lawsuits??? It will be a firestorm!!! The new owner is not interested in operating under the Ameriquest name. He will buy a package including liabilities, i.e. your lawsuit, which will be far less than assets. Once it's done, it's done. You can't continue to sue something that does not exist. Pay attention and get moving!!!!

This guy is a consumer advocate. His name is Robert Tapia and he and I have had an ongoing dialogue since July 2006 about mortgages. We have talked several times on the phone and exchanged all kinds of info. I have seen the loan docs of people he is reporesenting that have been screwed on their mortgages and provided suggestions.
Ken, I don't bash consumers, I just call a spade a spade and advocate for personal responsibility. It is maybe not in your case, but there are TONS of posts here from consumers that just plain can not manage their money responsibly.
The other thing that you just don't get or are willing to acknowledge, is that companies like Ameriquest, New Century, HFC, Fremont, First Franklin, Vanderbilt, HomeQ, Decision One, Option One are companies that offer loans to people with bad credit. That is their niche in the mortgage world. If a home owner has a loan with these companies, then they have credit issues. These companies exist because there is a market to provide home loans to these individuals. It just costs more and the homeowners are willing to pay it.
Otherwise, the consumer would have NEVER accepted the high rates or the high fees that these companies charge. The fact is, they couldn't get a loan elsewhere. Doesn't mean they are bad people, they are not stupid, but for whatever reason, they have not managed their finances wisely.

Now - you state that you have "proof" that I work at Ameriquest. Please show me a W-2, a phone number, any one that I've written a loan for, or even my full name; because any of that would be fictitious (I am not now, nor ever have been a sales person in any type of field).
When a new company comes in, they assume all of the assets and all of the liabilities of the company they purchase. While most individuals would not want $1 billion in liability, it is relative - they have over $113 billion in assets (aka loans to service). Steve has explained the numbers to you, yet you still berate him.
We understand that you have a problem with Ameriquest. You have been given advance information that if you were smart, you could leverage. You just don't get it.

I have slammed AMC and companies that use similar tactics to screw customers over and over here. I do not need to defend those postings. Look em up. I have posted my contact information many times, mixed in with the text. Posters from here have contacted me numerous times and I have given them advice to fix their situations.
I've been a mortgage broker for almost 10 years now, and I have never worked for AMC. I have never, ever sent t loan to their wholesale division, Argent. Quite the contrary, in fact. In fact, over the last 3 years or so, we have marketed heavily to the homeowners who have mortgages with AMC, T & C, Aegis, Ditech, Beneficial, etc., the lenders most often associated with predatory practices. We show the homeowners the nightmares that await them and most times we have a way to get them out of the problem if they have not sucked all the equity of their home.
The article I posted here is from a very respected, widely available, national mortgage publication we subscribe to. It did not endorse AMC, offer opinions defending them, anything like that. It offered up a newsworthy event. Nothing more, nothing less.
As far as who would want to buy them? It is just a numbers game, like buying any other type of business. Sure, no doubt theis company is very tainted, but look at the numbers.
ACC services about $113 BILLION in loans, and is being purchased for about $2.5BB-$3BB. Even if the new buyer would have to pay $1 BILLION in lawsuits, claims, settlements, etc., that is NOT EVEN 1% of the value of the serrvicing rights. It is a drop in the bucket compared to the value of the long term income to the new owners of the loans.
Not just that, but consider this: Most of the loans that AMC originated were the 2/28, 3/27, 5/25 variety, and the rate adjustments are coming now and over the next couple of year. The buyer of ACC Capital Holdings is also purchasing the first opportunity to approach these homeowners to get them into a better loan. There will be a HUGE amount of refinancing business available to the new buyer.
Ken, you totally don't know anything about me, my business, my exerience in this business. I have helped 100's and 100's of homeowners with screwed up credit fix their situations, and some of them I have done 3-4 loans for. I don't really prospect for business much any more. My business is going to close 2006 as 82% referral based from previous borrowers and realtors.
Good luck on your deal Ken, but just because someone makes a post here that does not slam AMC, does not mean they are supporters of AMC.

Ameriquest Mortgage sale rumored
Analysts say ACC Capital of Orange, formerly the top subprime lender, is closer to the sale of all mortgage operations.
Acquisitions are heating up in the lending industry, as companies try to grab market share amid sinking loan volume. Now analysts confirm the widely held opinion that Ameriquest Mortgage is next.
Orange-based ACC Capital Holdings is entertaining offers for all of its mortgage businesses, including Ameriquest and wholesale unit Argent, according to National Mortgage News' MortgageWire and analysts.
An ACC spokesman declined to comment.
Bose George, an analyst with Keefe, Bruyette & Woods in New York, said reports of a sale are likely true, considering the wave of consolidations among lenders that make loans to borrowers with risky credit profiles in what is called the subprime market.
George went on to speculate that the most viable candidate would be Britain's HSBC Holdings, which has been on a bit of a buying spree of late. It recently purchased the subprime mortgage unit of Champion Mortgage, a Midwest originator of loans in the B/C market. Due to someone not doing their homework our waiting game was extended on Monday. Mr. Black calls it our first victory.

They will have to pay the piper. And this time it will be more than a class action lawsuit. They have already lost in court and 350 mill, and they look at this as a cost of doing bussiness.
There are a lot of people retaining their own attorney and going after them. But Ameriquest is doing bussiness as if their is nothing wrong. Im thinking it is to save face, but it will all come to an end very soon!
Well have to get just wanted to update a bit. If you get a call from anyone from another attorneys office or the news media please direct them to your attorney. Since the beginning of this huge mess i have been contacted by many people. Just yesterday i was contacted by a women from florida and she reads all of these sites. She works for an attorneys office that have many lawsuits against Ameriquest.

After getting into contact with Ken we then contacted his lawyer who has shown us glimmers of hope none of which I have had for some time now.
On the 7th We recieved another phone call from the man with no last name saying time was up. We informed him that we had been in touch with a lawyer and gave name and number to him. On the 8th papers were filed to evict us. On the 14th I had a visit from the sherrif. Isn't life grand
only goodthing is that the mans idle threats of having the sherriff show up and evict us on the spot. I no longer jump out of my skin when the phone rings or the dogs bark or when there is a knock on the door.
If it wasn't for Ken and our attorney I would have mentaly checked out by now.

This site rip off report has help many people get help. Ameriquest wishes this site would go away. This site has also began the down fall of ameriquest. This company (ameriquest) will pay for what they have done to thousands of people acoss the country.

I am a veteran (army) and I am in the National Guard now serving this country. It makes me sick that Jack Roush has this company as a sponser for his race team. Greg Biffle drives the #16 wich also has the National Guard as a main sponser.

This company is unreal. How they are still in business is beyond me. For one, they have fought long and hard to ensure the laws are either changed or remain the same so fraudulent companies, such as they are, are very difficult to sue. I'm just glad to read on this site that people are fighting back and Ameriscum is losing quite a few cases. They need to lose many more to feel the pain and grief they have caused so many customers.
I can't think of a single thing they have done right! I'm sure your challenge will stand as I know there is NO ONE, not a customer OR employee, who can truthfully defend this company who has crapped on so many.
Now I did one today and their are 1,730,000, really makes you wonder that maybe their really is a problem with ameriquest.

Truth: They along with every other sub-prime lender is accepting 50 to 60 cents on the dollar but WILL NOT accept that same offer from the homeowner who needs help and is living in the home. Why do they do this? Because when the lender, be it Ameriquest or OCWEN or SAXON etc. accepts a short sale offer they actually substantially mitigate their losses.

I happen to be a senior loan officer with many years of experience.
I have read/heard MANY horror stories about Ameriquest and professionals in the mortgage industry are in disbelief.
I have to agree with all of you about the wrong doings this company has done. They were really doing things that are NOT acceptable to any industry standard and they can only be classified as thiefs and criminals.
At the same time you also HAVE TO TAKE some of the blame of your misfortunes because you DIDN'T DO your homework or asked any questions!
I am not trying to add insult to injury but I do hope in the future ALL of you do your homework and ASK questions!
I can understand that most of you do not have any mortgage experience and/or background but at the same MOST of the numbers should be in plain English and for some things you simply have to use common sense!
For example if you purchased a home at $83,000? a few months ago and the property amazingly gained $42,000 in equity so quickly and is now worth $125,000? don't you think there may be something wrong with the picture? ( for clarification the properties which may experience a 15% to 25% appreciation in a year are in HIGH desirable areas usually in the east or west coast)Realistically you should always have an idea of much your house is worth. Did you have an idea how much the house were selling for in your neighborhood? If at first "someone" thought it was worth $100,000 and then the same person miraculously tells you a few hours later that is NOW worth $130,000 - wouldn't you think this is suspicious?
If under loan fees you see that someone is charging you $12,000 to process/originate the loan? Don't you think this is a bit too much? Did you question/challenge ANY of the fees? Did you get a second opinion from a different lender? Did you see ANY benefit in paying $12,000 in loan fees to get $12,000 cash-back?
Would you pay $24,000 + interest over 30 years to get $12,000 cash-back? (example) Are you really that desperate?
DID you ask what kind of loan program you were getting into? was it FIXED? was it ADJUSTABLE? if it was ADJUSTABLE? Did you bother to ask when was it going to change? How much was it going to change? How much would your payment increase?
Last and not least... where have you heard that someone will let you skip MORE than 1-2 months of mortgage payments? - NONE of them exist!!!
In fact even when you think you are "skipping" 1-2 months on mortage payments... YOU ARE STILL paying INTEREST on the loan!!! there is not such thing as free payments. For future reference ALWAYS make your mortgage payments - what makes you think you could go on rent/mortgage free for more than 2 months?
I truly do hope the best of luck in your current litigations... I am very sorry to learn many of you had to learn a terrible lesson the hard way.

Roland Arnall: Persona non Grata?
It was a bad idea for President George W. Bush to appoint entrepreneur, millionaire and Republican fund raiser Roland Arnall to the post of Ambassador to the Netherlands. Arnall comes with significant baggage. His formal appointment has been held up since July because of a U.S. Justice Department probe into mortgage insurance company he founded, Ameriquest.
Ameriquest is under investigation for alleged fraudulent activities during the sale of mortgage insurance policies. It is expected that the U.S. Senate will block confirmation because the candidate for the ambassadorship has not properly resolved his legal issues with the Justice Department. Late last week, he had to answer some very pointed questions from Senators regarding his business dealings. It is one thing that Ameriquest is not highly regarded in the U.S. But what is really held against the candidate is the fact that many of Ameriquest's customers, victimized by the company's fraudulent practices, are now being stonewalled while trying to get their share of the multi-million dollar settlement (apparently agreed upon by both parties). This remains a major blemish on Arnall's record. It also causes the post of Ambassador to The Netherlands to remain unfilled.
Primarily, the blame for this latest blunder lies with Bush himself. There is nothing against awarding a major appointment to a significant election campaign contributor. It may be better that a friend of the president (who has a track record of putting his money where his mouth is) may have far better access to the President and his inner circle than a career diplomat that has a minimal relations with the President and may belong to the other party. Many Ambassadors to The Netherlands have gotten their assignment due of the fact that they were significant campaign contributors.
However, this type of appointment can by very risky politically, as the Arnall case proves. The issue surrounding the company he no longer leads - but still owns - came up immediately after Bush proposed his name. The president should have seen this coming: a long, slow-moving investigation, sharp criticism during Senate hearings, and disruption of the appointment process, leaving the Arnall appointment in permanent limbo.
In light of all this, is it at all possible for him to be appointed to the single highest U.S. diplomatic post in The Netherlands? That would be anybody's guess. What would have happened if Arnall was proposed for the top job in London, Berlin or Moscow? It is highly likely that another candidate would have been quickly found. Bush should have waited to announce Arnall until the Ameriquest issue was resolved. By then, The Netherlands would have gotten another Ambassador and Arnall, when his name was finally cleared, could have started somewhere else with a clean slate.
It was the right move for our Foreign Affairs minister Ben Bot to push his American counterpart Condoleezza Rice for a speedy resolution of the issue. It is in the best interests of both parties that this long-vacant and key position gets filled soon. But it would have been better if the Dutch government had objected earlier to the appointment. When Bush nominated Arnall, we should have objected immediately through political and diplomatic channels. The writing of this disastrous flap was on the wall. It is now clear that our agreement on this appointment was painfully premature.

No, I have another attorney in GR. My cousin is one of those "high power" attorneys - ran for Congress a couple times. He recommended this GR firm first (he specializes in another area of law), but when I brought up the name of Ken's attorney, he had good things to say about him, too.
Ken knows my reason for picking this firm. Probably shouldn't go into it here, but he will explain if you ask, which is fine with me - but just didn't want it publicized on this forum. I believe that Ken's attorney will do a fine job and get you the restitution you deserve. I believe that both firms are consulting each other.
I have a concern over this latest legal wrangle that Ameriquest got themselves into (Geeze, guys! Can't you do ANYTHING right!!!). They gave NO notice to many (if not all) of the States' banking regulatory agencies, that they did business in, before closing down branch offices. That's a no-no. Many states REQUIRE that financial institutions notify them AT LEAST 30 days prior to closing ANY branch offices in their respective states. As I said, AMC gave absolutely NO ONE any notice before closing these 229 branch offices. And now this has ticked off several states and they are talking about taking legal action against them.
I have an uneasy feeling about this. Don't know why... I don't really want AMC beat to a bloody pulp, and bled out, BEFORE we get out of them what they owe us. Maybe I'm concerned over nothing. I will talk to my attorneys this week about this. This matter needs to be taken care of expeditiously, for sure.

i found all 3 of my appraisers.
138000 low-148000.00 high end from one appraiser

and then
one more appraisal at 148000.00
when ameriquest had my appraisal done ,they said, "good news your appraisal came in at 175000.00 . Right where we want it. don't worry about your payment this month because you will be getting a new loan and the only payment you will have is a house payment, and you will now have your lower intrest rate. you can skip this months payment, we close at the end of the month.
Don't worry." well i didn't need 175000.00 but ameriquest needed to up my appraisal so they could refinanse and get another 30000.00 out of me. Well we did not close. (i only wanted a lower rate not more money) but by the end of the month the payment i was told not to make now had me behind. i was 24 minutes late sending in paperwork (i warned them that i might be. i was working 2 jobs and i had to get to kinkos before they closed.)your too late we can't accept your paperwork or your late payment until you can make 2 payments. thats how a BAD APPRAISAL hurts. even if you don't want all of their money which was my case, i did want the lower intrest rate. i was suppose to get a new loan in one year with very minimal fees. i don't call going from 119000.00 to 175000.00 with less than 2000.00 (taxes) paid out, minimal fees. lucky for me i didn't do their 175000.00 loan . but i still got messed up by (them telling me)and me beliving i was going to get a lower rate.

I have since refinanced my first loan with a credit union and it is 30 year fixed I paid the $6,000 prepayment penalty to get out of the ugly loan. My next two have a three year prepayment penalty I'm on my last year and then will refinance them also.
The only thing I ask you is to be honest you did take cash out as I did and you are unwilling to state how much. I am in California and I and part of the class action and will get some back they do lie and deceive and overcharge and consumers beware.
Don't trust what they say.

I'm from Wisconsin and am about to loose my home as well from ameriquest, they over inflated my appraisel by so much that there is no way I can ever sell it or come up with the fees they want to be in a forebearance program for me to keep it. I've only had them for 2 years i've owned my home for 17 and now i may not even have no where to go in Oct. when they put it for sale. I've called many people in Wisconsin and no one seems to care or just don't want to take my case. I have a husband who is disabled which that was denied so i have no help there and when I tried to pay my account up to date they said they would get back to me and then when I called them 2 days later they had already sent the papers to the attorneys office. Can anyone from wisconsin help me.

This title co. had sent "travelling brokers(?)" to our house to sign the papers. AMC told me and I called them. I then requested copies of all of my closing doc paperwork.
When the package arrived, there was no appraisal. But they did include the check stub for $850 for the appraisal. Yes I did question this... but I was in need of the money due to my ongoing legal battle with another bank on another illegal mortgage. the AMC agent knew he had me hamstrung on the deal.
We did win our battle with the other lender and got our credit records "blocked" and negative marks deleted and/or "suppressed" that had been a result from that bank's negligent and very poor banking practices. We negated all of their finacial claims against us and I did request a few thousand in cash on the deal - WAY under what we should have requested on the out of court settlement.
I had a little bit of a hard time convincing my attorneys to press for a lot more cash, as they thought we may be pushing our luck, as they had just agreed to eat a $225K mortgage, wipe my wife's and my credit history clean, pay all attorney costs, along with cutting me a check for a couple thousand dollars.
Sorry, didn't mean to go on about that... past my bedtime...

I will be the first to say that I have not done everything right in my loss of my house. I will also be the first to tell you that I truly and genuinely believe that I did everything that I thought was the right thing to do during that process and during those failed negotiations. Did I trust a rather dishonest company, and several people in that company that I thought I could rely on to help me and my family? Yes.
Do I think that because I wasn't thoroughly well versed in real estate and mortgage law, that I am completely to blame for what happened to my family? No. And anyone who does have this mindset is someone I'm going to have a problem with.
There is a clearly defined line, in my book, between right and wrong. I have tried to teach all five of my kids (all grown now) this very important principle.. and I can't teach it if I don't live it.
I don't like whining. I hope I don't come across as doing that. But right is right. I will be methodical and pragmatic as I pursue reimbursement of the debt that AMC owes me. I have no bitterness in my heart towards these guys. I have been told that this evil will invade every facet of your life, if you open the door just a little for that.
It's just that I just discovered that AMC owes me money. I have been disabled and I am trying to get SSDI so my wife and I can retire and enjoy the rest of my life, after the struggles that we have been through. I think it's really great that AMC has stepped up to the plate to help us out financially in that aspect. God does provide, doesn't he.
And while Cheryl and I have been hurt, we have also gained an extraordinary amount of wisdom and insight on a good many things, financial. A banker that I recently spent some time with recently, remarked, after an hour long conversation, that I should write a book. While that's flattering, there's no way. However, if I could use the education from my misfortunes (and my almost fanatic self-education that I dove into after this personal calamity) to help someone else, I would have peace in my heart.
I want to buy my fifth wheel so my wife and I can retire in it and travel the country and see this beautiful God-given land that we live in. I refuse to have any bitterness in my heart, as it will surely take away my (and probably Cheryl's) joy and peace. I just need to take care of business - retrieve our money - and be off on our journey with a joyful and thankful heart.

If the judge had truly stopped the foreclosure you would not be having a hearing on Friday. The judge has obviously not ruled on the merits of your arguments nor has he issued a final judgment.
I do not have any particular love or hate toward Ameriquest. I do, however, appreciate the truth and you are not exactly a credible witness. Your story is that you refinanced your house so you could increase your monthly payments. Yeah, right. Your story just does not hold water. In the last 10 years I have had five mortgages on three different properties and I never once signed off on one without knowing who was getting how much money. How is it that you end up owing $130,000 on an $83,000 house and you don't have a clue as to where the money went?
First of all i didnt walk away with a bunch of cash. Ameriquest charged me a huge amout of fees that dont even make any sense and my lawyer is handling it now. Besides when my attorney went to the judge and showed him everything that im telling here on this website; why on earth would the judge stop the foreclosure and why on earth would i have a court date next friday. And wow next friday is also good friday how fitting!
So larry now i see why you are defending ameriquest because you work for them and i would be careful what you say and to who because you know as well as all the other people that work for ameriquest what they are doing is wrong!have a good day.

You said you bought your house a year earlier for $83,000 and you had a loan at 6.5 percent. Then you refinanced to try to get a lower interest rate. OK so far. Monthly payments (principal and interest only) would be about $525.
Even if you put no money down on your original mortgage you should not have owed more than $83,000. The first thing I do not understand is why an appraisal of $100,000 is too low to refinance an $83,000 mortgage. The only issue might be that your equity was less than 20 percent requiring the purchase of mortgage insurance. (That's assuming that you put no money down when you purchased the home.)
The second appraisal of $130,000 would take that issue off the table. You would then have had $47,000 in equity in the home or about 36 percent. This would be quite favorable to you if you were refinancing that $83,000 mortgage.
You said your new payments were $1007 a month and that the new rate was 7.5 percent. Payments on an $83,000 30-year loan at 7.5 APR would be $580 a month. Even if your payments include taxes and insurance, this makes no sense.
But I suspect that you did something other than just refinance. If you borrowed $130,000 at 7.5 APR, your payments would be $908 a month closer to the figure you give for your payments.
You also mentioned that you expected your house payments to INCREASE when you refinanced. Nobody refinances so they can pay more, so I suspect that you decided to get a pocket full of cash out of this deal. You did not just refinance, you squandered the equity in your home -- the only asset you had -- and got yourself in debt up to your butt. That is the only way your story makes any sense.
Why on earth would anyone do something this silly? You now owe far more than the house is worth and apparently have nothing to show for it.

we all know they lie and as a former customer, and thank god its former, i can sympathize with you.
i took a home loan out with ameriquest in feb 2002. i had some bad credit but i was purchasing the home from my boss and he said he would help me no matter what.
i tried several local banks but none of them would finance me. my boss was good friends with one of the presidents of one of the banks and he referred me to a broker in columbus.
the broker got me a loan with ameriquest. they would only finance me for 85 percent of the loan so my boss held a second mortgage. my payments were 680.00 per month including taxes and mortgage insurance. my boss let me pay him 140.00 per month on the second that he had held.
i paid ameriquest for two years without missing a payment or being late. on time every time. after the two years were up i was called by one of their reps to talk about refinancing. i thought this would be great, i could pay off my boss and pay off some other bills.
cameron polk was the rep i was working with at that time and he said he could get me a 6 percent fixed 30 year loan and finance it at 100 percent of the loan and my payment would actually be cheaper. i said great tell me what you need and we will do this.
i sent mounds and mounds of documents etc and kept in contact everyday. then all of a sudden when we were supposed to close, silence. i started calling cameron and guess what? he was either on the other line or not in his office.
finally i said fine and started looking for another lender. as soon as the other lender got a much better deal for me and contacted ameriquest for the payoff. cameron suddenly decided he would return my phone calls.
what an idiot my payment was almost 1100.00 and my interest rate was 8.5 percent, 6.0 with the new lender, it was a 30 year arm and he could only, again, finance me for 85 percent of the loan. this company is laughable. i told him to shove his loan up his a***!!!!!!
im am with a better lender now, one that tells no lies, they dont have to they have all the business they need, why? because they are reputable. enough said, if any one in ohio wants a referral to my new lender let me know. i would be thrilled to have my lender take another one from those scunbags.

I almost lost my home last year and I heard the same as David. Lenders didn't want to foreclose. What a lie that is when it comes to Ameriquest. When a customer experiences some kind of hardship, they thrive on it. And you're so right saying that they will attempt to block any payment you try to make. And their hardship program does not exist. If I didn't qualify last year, no one will.
I am also in the process of obtaining an attorney. I wish you both luck and I so hope you get them good in court! Please let us know what happens.

Have you had any luck with this person you said to call? What are the chances of that happening? (A release of lein.I have been in contact with another attorney at Ameriquest. We were able to recind our loan and now I am questioning the appraisal. We have to pay back the amount they paid off to our previous bank as well as the $11,000 we cashed out. So, that leaves us at about 0 equity. I was told they will have the appraisal review dept look into it and get back to me. I'm hoping thaey will knock off the $11,000. A release of lien would be better, one could only get so lucky!!!

However, in my case, they did everything in their power to block me from making payments when I was short one month, then, after we went into the Mich 6 month redemption period, they set me up by telling me that a short sale was an option open to me. After working hard (understatement) for 5 months (one sided effort, as they wouldn't return calls, and kept asking, "Who are you again?")
Then 14 days before the F/C was final, I was finally able to come up with the financing for this short sale. When I made this call, the "Home Retention Specialist" in Anaheim, CA informed me that he had misunderstood what I had been ernestly explaining to him for 5 months (after he had even briefly explained this procedure to me early on, along with the steps to take to accomplish this - real quick overview, as it seemed I was taking way too much time out of his day by being on the phone with me), and that AMC had just "recently" passed a rule that forbid the original owner from offering a short sale back on their own property.
And then, just to make sure they could lock me out, he proceeded to tell me that if I did come up with a third party buyer, they would retain the right to disallow this person, too - just in case I got lucky enough to find a way around their 11th hour roadblock.
I have a letter from AMC that specifically states that I have that short sale solution open to me.
I lost my house through fraudulent representation, and I will seek reparations equal to my losses. I developed a medical complication during this stressful time that should have healed. I am now permanently disabled, and I can no longer work. Getting this kind of medical stuff to fly in court is difficult (but not impossible). It will be up to my attorney to figure out what we can and can't do in court.
I do know a "token stipend" of $2,000 to $3,000 will be ripped up. It is an insult. I may lose on private litigation, but that $2K-$3K is a triffle loss. Besides, I have other evidence that will be very difficult to AMC to defend against in court, and yes, I know all their strategies that they will employ.

-they promise you cash-in-hand without disclosing that out of that cash comes the closing fees which changes that number dramatically!
-tell you not to pay your current mortgage because you're refinancing. By the time you realize you're getting a bad loan, you don't have the cash to catch up on your current loan and feel you have to close on the crappy deal at Ameriquest to keep your house. the 5-day rescission period doesn't change the $$ in your checking acct. so you keep the loan.
-they short you on your debt consolidations. that way they can come back in 4 months, dangle that "we can waive your pre-payment penalty" carrot in front of you and get you for another $12k in fees to "consolidate the debt you couldn't fit in on the last refi"
-if you dare to try and refi with another lender, once they order your payoff from Ameriquest not only will they make your current broker or lender wait 10 business days for it, but they will TORURE you and blow up your phone for those 10 days to try and hook you in again. and they'll leave all kinds of messages to scare you into calling like "we're doing an audit on your loan, you need to call us right away" <----they said that to a senior citizen that I was refinancing. thankfully she told me about it and I told her to completely disregard their calls. i got her away from them and she is in a good loan today.
-they make up employment for borrowers who aren't working, they cut and paste a bad credit score onto a good one and tell you that your credit is bad, they white out liens on titles and make you think they're getting paid off but absord that money in points, etc.
-they don't always send appraisers. sometimes they send realtors to value homes. if an independant appraiser provides a fraudulent appraisal, and u/w at a NORMAL lender will not longer accept any appraisals from that individual, and they can lose their license with the state. at Ameriquest, it doesn't matter. the appraisers with WITH them to give them the value they want. who's gonna rat them out?
Ameriquest has a real nifty little network of appraisers, title companies, etc. If only greed did not cause such an abuse of resources they would have a monopoly - and they almost did. But thanks to sites like this, someone like myself who has experience, integrity, and a conscience can only hope they are put out of business for good.
What can YOU do? Keep spreading the word and JUST STAY AWAY FROM THEM! It's hard out there for lending... about 90% of the loan originators in this industry are NOT EXPERIENCED and are crooks who aren't able to pay their own mortgages. So they will tell you anything you want to hear to get you to commit to a loan with them. It's not just Ameriquest, but they ARE the industry leader in fraud.

this is marge and i wish you luck with your attorney.
i have contacted the attorney general about ameriquest. (at least three e-mails and a couple of phone calls)
you won't belive it. the governors office sends me back a form to fill out because they have no idea what i am talking about.
my first word was " i'm contacting you about the problems with ameriquest" how do i get my name on the list for people who had a loan between 12/31/00 and 01/05. they have no idea what i am talking about.
we have all been told that ameriquest lost a 345,000,000.00 law suit and our attorney generals office will be handling the cases. and they have no idea what i am talking about.
now i'm thinking i would like to know who has been contacted by the attorney generals office.
