My mother and I subscribed to Uverse over a year ago.  Till this day, we have never been given an accurate amount owed on our bill.  They add charges that never existed to our bills and then 'correct' them miraculously after we are forced to spend literally from 8 in the morning until 5 at night.  This is every month.  They have even issued large sum credits to our account for the hassel but as of yet, have never actually fixed our account. 


This month is notable.  Last month, after we called disputing a $250.00 bill, in which they informed us that we never paid for July, August, September, October or November.  Somehow, it took them over five months to turn off the service.  They then added over 60 dollars in 'reconnect' fees.  They finally admitted to their mistake, credited back the money and we paid the 40 dollars they claimed we actually owed them.  They told us to call back on March the 4th to get on a promotional deal where instead of a 100 dollar bill, we would get a 79 dollar bill. 


We received an email this morning informing us that we owed them 249.00.  We have also been requesting paper bills, which they have neglected to give us.  My mother is currently still on the phone as I'm typing this, having been on the phone since 9 am.  They actually have finally admitted that she owes them only 188.00.  However, they can't explain where that figure came from.  They are now claiming that we have an overdue balance from JULY.


My mother has been called a liar by this company and she has been threatened with legal action if she did not pay the amount they claimed she owed them.  After that conversation, she spoke to someone else who gave her a 100 dollar credit for her 'pain and suffering'. 


We spend EVERY month on the phone ALL day with these people.  My mother is sixty years old.  I would hate to think they're attemping to swindle old ladies out of money, but honestly after this much hassle there is no way else to consider this.  This is extortion.  'Pay us any amount we send you, no matter how ridiculous and unfounded, or we'll turn off your service and sue you'.  I am so totally disgusted right now.   I understand why they haven't opened any offices yet.  It would be flooded with people fed up with this horrible service.

I considered a possible resolution to this type of problem when I experienced a similar situation with, coincidentally, an AT&T 'partner'.  I provide this information AS IS, and I do not bear any responsibility for your or your mother's actions.  Good Luck! :-)

Small Claims Court

You will have to investigate how your court's processes are set up.  In my experience, a person(mother) pays ~$50 and fills in a summons with their info, the registered agent's info, the reason for the civil law suit, a desired monetary outcome, and any other outcome, such as "permanently fix the accounting on my billing".  They also summons witnesses(you, your significant other, Uverse customer service reps) to testify on the facts. 

Sit yourself in that court several times, prior to initiating your case, to evaluate how the process works, how the judge operates his court, whether he is liberal or conservative, etc.

Normally, you should expect to appear in court at least twice.  The first time the judge asks if the parties are prepared, and then sets a trial date.  This also gives your mother a chance to 'settle out of court'.  She should always be open to negotiating a settlement, as long as the resolution is valued above her costs, but not necessarily her demands. 

To make this work, you must have a DETAILED accounting of the issues, dates and times you called to correct the issues, outcomes, time and value mother lost dealing with these ignorant bloodsuckers.   Include mother's psychological problems due to the defendant's egregious gross negligence and willful disregard for her rights,  especially if the court awards punitive damages.

Uverse's 'registered agent' can be found through your state's 'corporation commission'.

Your mother's time is worth at least minimum wage, if not five or ten times that.

Tack on another 25%-50% for punitive damages and identify it as such.  Don't be greedy, judges don't like that; many may reward more if your estimate is conservative.


Make sure you read and understand the Uverse contract.  For instance, it may state you cannot sue them for improper billing.  You're not.  You're(mother) suing to stop their egregious gross negligent conduct, etc.

Your mother's service may be terminated as a result of the lawsuit.  That may be good or bad for her.  That may or may not be allowed under the contract.

Your mother could be responsible for the defendant's legal fees if you lose your case.  She should consult with and maybe hire a lawyer, whose fees should be paid when she wins her case.

You cannot appeal a lost case, but the defendant can appeal to a higher court, and this could lead to large lawyers fees.  Funny how even the small claims court can ultimately destroy the little guy. What are the chances the defendant would appeal?  Probably very low; your case is small and fairly solid.  At this point you would start contacting the media; ie. 'big corp attacks elderly widow'.

Well, we've now spent from 8 am to 4 pm on the phone with Uverse.  They claim that we owe them 249.00.  They claim that the reason our amounts owed have never been the same amount is due to 'rate increases' and that AT&T is not responsible for these increases. 

My significant other lives literally across the street from us.  He has AT&T Uverse.  He has never seen a rate increase on his bill.  I can only conclude that they have rate increases for specific customers, which smacks of discrimination.

They have demanded that we pay this bill, or they will 'come after us legally'.  They claim that if this bill is paid, they will credit what we in fact do not owe them in April.  Can anyone figure that out? 

We have no idea what to do or whom to contact.  This situation is out of control.
