CBCS attempting to collect debt for Alltel Communications, however, cannot produce evidence that I owe the money. Contacted Alltel and verified debt was sold to CBCS. However, Alltel cannot provide proof that I owe the money either. This harassment has been going on for 4 years. Has negatively affected my credit score (784 to 654). I did get the credit report corrected after several months. I believe this is a scam for the following reasons. Collection agency contacts me I dispute the debt and ask for proof of debt. Never hear from that collection agency again. However, a few months later a different collection agency contacts me. I have reported this to the Attorney General and Better Business Bureau of Ohio. Next step is to file complaint with Florida my home state.

ROBERT- the law is ( 809. Validation of debts) that is the statute in the United States Code or USC look it up if you want to. As far as validation if you read the statute it states that when the agency makes contact with you they show you what the bill is for, how much and who it is from - you as the consumer have 30 days to dispute the validation of the debt, so i would think that if you DONT than the debt is valid. So maybe you should think twice about not calling them or not . And the reason why you sound stupid is 1. im not trying to help the agency - i no longer work for them. 2. We get a flat rate per hour without ANY commission, but the money is worth getting yelled at by irresponsible debtors, and we simply have a goal of a certain amount of payments we have to collect per month in order for us to KEEP our JOBS. So maybe u should read up on that as well.

The Ex-Employee says that you can demand the collection agencies address(not adress) but you are not going to get it. So their address is a state secret? The real reason they want you to "verify" who you are is so they can keep you on the line to attempt to get you to give a payment right then and there. The last thing a collection agency wants is something in writing.

What is the specific law that states that if a consumer calls back they automatically acknowledge the debt?

Finally, the burden of proof is on the Collection Agency to prove that the debt is owed. The consumer does not have to dispute the debt, the collection agency has to validate the debt. No validation = No collection(and no commission for you).

Fair debt collection laws are important to consumers because when debt
collectors obey the law there is less emotional urgency when dealing with
the debt they are collecting. When a debt collector calls or writes, a
consumer should immediately do the following:


Stay calm.

Do not argue with the debt collector or try to explain why you cannot
pay the debt. It is none of their business.

Do not use foul or indecent language even if the debt collector is using
inappropriate language.

Ask for the name of the person calling, what company they are calling
from, his or her address, telephone number and fax number. WRITE IT
DOWN. Include the date and time the call was made.

Inform the debt collector that you want no further contacts until a debt
validation/verification letter is received.

Politely say goodbye and hang up.

Immediately write a letter to the debt collector stating that you:

Dispute the debt.

Demand that any previous reports to the credit reporting agencies be
notified that you dispute the debt.

Do not want further contact until the debt has been validated and
verified.

Demand that no third party be contacted.

Demand that you not be contacted at work.

Demand to know who was the original creditor and each succeeding
creditor.

In sending the letter, always use Certified/Return Receipt Requested
mail. It is worth the $4.35.


FDCPA STatute - Tells you we cannot disclose any information to no person via telephone, or mail UNLESS YOU verify personal info THAT WE ALREADY HAVE!!


809. Validation of debts
(a) Within five days after the initial communication with a
consumer in connection with the collection of any debt,
a debt collector shall, unless the following information is
contained in the initial communication or the consumer has
paid the debt, send the consumer a written notice containing
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days
after receipt of the notice, disputes the validity of the
debt, or any portion thereof, the debt will be assumed
to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector
in writing within the thirty-day period that the
debt, or any portion thereof, is disputed, the debt collector
will obtain verification of the debt or a copy of
a judgment against the consumer and a copy of such
verification or judgment will be mailed to the consumer


**A consumer has a right not to have the alleged debt revealed to third
parties, including family, friends, neighbors, and employers.

**A consumer has a right to have debt collectors contact third parties
only once and only for the purposes of locating the consumer's
whereabouts.
or the name and address of the original creditor, and a copy
of such verification or judgment, or name and address of
the original creditor, is mailed to the consumer by the debt
collector.

If you just call up there and demand the collection agencies adress you are not going to get it.... BEcause 1st of all they have to verify who they are talking to, they are not going to give you information until they know that you are the person on the account....
2nd when you call (and since they already have your number, b/c they call you all the time) your whole account pops up, so we already know who you are and what number your calling from, so by you callin back YOU ALREADY ACKNOWLEDGE the debt...

3rd like i said it could be someone else with the same name and last name that could of possibly lived in that state, and just like any credit card company YOU CAN DISPUTE THE DEBT with us...

In effect he is only correct about one collection agencies selling it to another one.

Never speak to a collector about a debt, they may attempt to illegally re-age the debt based on your conversation, the only thing you want to get from them is their address so you can send written debt validation requests and cease communications letters - do not sign them type your name only.

ITS CALLED JUNK or ZOMBIE DEBT - and the collection agencies paid pennies for it and will try and collect the full amount + whatever they can manage to tack on. (tacking on extra is illegal by the way - but won't stop them from trying) When one cannot collect - they sell it to another one, and on and on.

MOST debts have a statute of limitations - a time period based on individual states. Once that time frame has passed - there is no legal means to collect it any longer.


All you can do is STAY OFF THE PHONE - NEVER ACKNOWLEDGE THE DEBT PERIOD

More than likely it is too old to be legally collectible - means they cannot sue you for it. But that will not stop some of the nastier collection agencies from trying.

Just get their address and send them debt validation and cease communcations letter. They cannot validate it, so they will sell it again.

CORRECTION

The reason why alltell has no record of your debt is because they sold it to one of the Credit COllection agencies, they already got their money for YOUR debt, and now its the collection agencies job to get theirs BACK.... The collection agency has possesion of the debt for a X period of time, and after several attempts, they may sell the account to another agency who is going to contact you again... Every time this happens the debt reapears as new debt, each time a collection agency purchases that debt.

Best advise is to stay on the phone with the rep and verify the adress the debt is allegedly from and there is a window they use, where they can see what the debt is for (*late fees, equiptment and etc.) Or they could possibly have the wrong JOHN DOE whose last # SS wont match the 4 they have on that particular debt. SO be patient and work with them, if your willing to do that, they will be patient with you and you will not get the collector who wants to rip your head offf!!!1 LOL

Alltell is lying

Alltell is lying. They say they "sold" the account then they wouldn't be sending it to five collection agencies. The fact that the OC (original creditor) can't produce VOD (validation of debt) makes it hard for the CA (collection agency) to produce the documents....

So if you feel you don't owe the money then I would HIGHLY suggest each time you get notice of collection agency that: a) you request itemized bill from the OC, b) that you are disputing this debt, and c) you consider it to be in dispute until you get validation from the OC.

Or you could try to do fraud dispute on the account

File a report with the Federal Trade Commission

Not only should you continue to persue this with the attorney general and the BBB, but you should also file a report with the Federal Trade Commision.

It only takes a few minutes to file a complaint and if they recieve enough complaints of the similar nature for the same company, then they will start an investigation into this fraduelent behavior.

I for one, am fed up with companies using immoral practices to scam consumers.
This behavior is totally unethical and the government needs to stop it.
If the state goverments are not willing to do anything, then maybe the federal government will take more action to bring this behavior to a stop.

It only takes a few minutes to file a complaint and if they recieve enough complaints of the similar nature for the same company, then they will start an investigation into this fraduelent behavior.

I for one, am fed up with companies using immoral practices to scam consumers.
This behavior is totally unethical and the government needs to stop it.
If the state goverments are not willing to do anything, then maybe the federal government will take more action to bring this behavior to a stop.
