Our local bank State National Bank became Compass Bank recently and the nightmare began with our banks ATM machine when the switch was made. After the first week deposits money was put into our account that was not ours. We reported this to the banks branch manager and was told that several people had e-mailed her many of whom money was taken out of their accounts.
Our money was repaid to the bank from our direct deposit account. A few weeks later we returned from a trip and had used the ATM machine to withdraw $200.00. We kept track of the money that was spent and when we checked our balance we were negative $100.00 plus a 35 dollar fee. The $35.00 fees kept accumulating until we were told we were negative approximately $ $256.00.
After checking our statement we found that an additional $200.00 was taken out of our account with incorrect information given on an ATM machine that we did not take our money out of. My husband walked into our bank and asked for a computer read out. We had asked in person and over the phone several times to sit down with the branch manager or someone at the bank to go over all our transactions and try to resolve this. My husband walked into the bank and spoke directly with the branch manager. She was extremely rude and said she was too busy to speak with him and that he is always having problems.
My husband called both the branch manager and regional manager several times to try to resolve this matter and his phone calls were not returned. Meanwhile we have kept checking our balance over the phone which kept showing that we were negative. A couple of days ago my husband tried our ATM card just to see what would happen to get gas for our car. We were surpised that the ATM card let us purchase gas. We then checked the ATM machine at the branch we bank at. In the event of the slight possibility the mistake was found & the money was put back in our account. We were shocked to say the least when we found that the ATM machine showed a balance of $500.00.
After speaking with the banks toll free number at 3 different times including a supervisor we were told that our account still shows we were in the negative of $256.00 which include $155.00 of late charges & there was no deposit made of $500.00. We were told by 3 different bank employees over the phone including the supervisor that this was impossible and even though they did not show a deposit of $500.00 we could withdraw and keep the money As of today calling their toll free number we are now negative $575.00 and their is still no evidence of the $500 deposit.
My husband took the money out and we are saving it in an envelope along with a receipt showing that the bank does not know what their doing. We are in the process of contact the Federal regulatory agency that regulates the bank. We are on a limited income of disability and are in the process of trying to repair our credit due to medical bills. After receiving letters from the bank that we owe them money and reading the horror stories on this website we are concerned of what this ongoing nightmare will not only do to us but countless others who bank at our branch.
We have since taken our money out of this bank since we felt our money was not safe and have changed banks for our direct deposit. We will not walk into that branch without a Federal regulator & or attorney involved. We would be interested of joining a class action suit with others who are having problems with Compass bank and would like to make sure our branch and all the ATM machines affiliated with this bank are thoroughly investigated. Today my husband went to our branch and the ATM machine did not work and would not give us our balance. He then went to Sams Club and was able to get $5.00 worth of gas which will probably initiate another $35.00 charge.
My husband will have also have a receipt for this transaction. This again proves that there is a mess with the ATM machines affililated with this bank.lIf it is happening to us and has happened to others in our bank & probably is continuing to happen this branch needs to be shut down Any money put in this branch is not safe It is ironic that the toll free number message states that customers can be assured of the security of the money in their accounts. This is evident from what has happened to us & countless others in our branch. Any advice and help with this matter would be greatly appreciated!

I would like to add that the bank continues to send us letters and keeps adding fees of $7.00 each day for a month. We have spoken with someone in the administrative office and have sent our statements and still get no answers. We have filed a complaint with the Federal reserve. We are also in the process of getting a class action attorney to handle our case and most likely hundreds of customers in the Las Cruces area. We would appreciate hearing from attorneys and or customers of Compass bank who would be interested in filing and or being a part of a class action suit. Thank you!
