 Ebay Seller intentionally shipped the wrong item ebay now expects me to pay for return because the item is to big to ship stand mail so ebay now refuses to pay

I purchased a "2001-2006 CARAVAN TOWN AND COUNTRY VOYAGER 3.3 3.8 TRANSMISSION" from ebay seller. The item was covered by ebay buyer protection. When the item was recieved at the certified mechanic shop it was found to be from a sebring model not one of the "2001-2006 CARAVAN TOWN AND COUNTRY VOYAGER 3.3 3.8 TRANSMISSION" as listed in the auction. Meaning this transmission will not just go in my town and country as any included under the listing I purchased "2001-2006 CARAVAN TOWN AND COUNTRY VOYAGER 3.3 3.8 TRANSMISSION" would have. Without thousand of dollars worth of additional parts and labor the transmission shipped to me will not fit.

This seller has admitted he shipped a transmission out of another model but believes I should have to except that even if it will cost me an unreasonable amount of money and time.

Ebay admits that the seller is in the wrong and states they have no problem giving me my money back but only if I pay the FREIGHT charges to return the item. I believe I was protected from such types of bait and switch tactic. When I first contacted ebay they told me they would pay the return the shipping to ship back to ebay and issue my refund since the seller was totally wrong and intentionally sending incorrect item. Then they realized the item was to big for standard shipping now they refuse to pay. In the end they agreed to pay only half the related cost.

This seller intentionally sold one item then shipped another the item has to be shipped by ffreight which will likely cost several hundred dollars that I don't have I don't know who to contact to ship such a thing. Ebay promised to protect me and now they are requiring me to spend money I don't have to return an item that their seller sent incorrectly. All the while I do without my money and my van i can't get to work can't take kids to school, appointment, can not even go to store to buy grogercy but I am supposed to figure out how to ship this item I can not even lift.

I can not even get the accurate seller information in order to file against the seller in court for my loss. This is fraud and my family and I will suffer while this seller and ebay stake claim to my money.

 I would suggest that you file reports with the following agencies:

http://sanjose.bbb.org/ (BBB of San Jose)

http://oag.ca.gov/ (Attorney General of California)

http://www.ftc.gov/ (Federal trade Commission)

eBay notoriously does not honor their buyer protection policy. I've had a similar problem with them, although not to the same magnitude as yours. You might consider filing a dispute with your credit card company.
