I went to the EEOC to file a charge of discrimination from my black employer who fired me when she hired two black younger females around 03/05.

When you believe you have been discriminated against, you have a right to file a charge of discrimination. The state hospital I worked at In columbus georgia discharged me for no reason. They lied to the EEOC about the reason why I was discharged. When I applied for umemployment, the hearing officer denied my rights & ruled agaisnt me so I had to repay the money back the umemployment gave to me. But I have applied this to higher court so I would not have to repay this money back. All the EEOC did was went by what my black employer said because all they have are black people working in the EEOC office. They do not help white people out who file discrimination.

If I was a black female filing a complaint against my white employer the EEOC would help the black person more then the white people. The EEOC dismissed my complaint stating they have found no evidence of discrimination but I have a right to file a suit in federal court If the EEOCh as found no reason for discrimination, then filing a lawsuit would be a waste of my time & my former black employer will just get away with breaking the LAW!.

The EEOC has treated me unfairly. Why have a EEOC if they are not going to do their job? They have nothing to worry about because they are getting paid a big check every week & not helping victims of discrimination & the employer gets off. I will not ever work for another black employer for the way black people have treated me, discharged me & lied to the EEOC for discrimination. The employer I found out from another employee, was going around trying to make employees sign a false statement agaisst me but nobody would sign the form.

It's time for us white people to take a stand against these racist black people who wish to do harm to white people. Black people still live in the past & think they are paying the white people back. Today if a white employer discrimination against a black person the EEOC would help the black person & just forget about the white person.

If the EEOC cannot be fair to everybody then they need to be shutdown for not helping people. Black people are not taking over everything like they think they are going to do. They are still full of hatred for white people. It is know 2006 & discrimination still continues today & the government does not do its part to protect the victims of discrimination. So why bother filing complaints if the EEOC is not going to help people.

 I cannot believe the EEOC and question whose side they are on. I was working for a compnay for 18 months and assigned to their client site. The EEOC rejected my complaint after I provided proof of 4 serious actions against me.

1. I was never provided the ADA forms where I would have listed my disabilities

2. I have a series of e-mail exchanges with my employer where I am inquiring about ADA. They respond with "What is ADA". I tell them and they say they will check with their manager and get back to me. But they don't. I write again and they again say theyhave to check with their manager and again I never hear from them

3. I call them 5 times in December 2011 to tell my employer I am being harassed and humiliated by the client. They refuse to intervene. I call again and beg them to intervene, they refuse. I call them again and tell them the client has become so hostile I am scared. They refuse to intervene.

4. I provide proof of disabily with letters from my Psychiatrist and Rheumatologist, but it didn't help

5. I am harassed, isolated, falsely accused of sexual harassment, using obscenities, throwing stuff around and threatening employees. All if this isa lie and it had to do with my missed work because of my disabilities.

6. I call my client manager to tell her I amgoing to be in late and she beginsto verbally abuse me

7. My client manager continues to humiliate and tells me to "be a man".

8. My client manager announces to my coworkers hey this guy says he is disabled and divulges the disbilities I confided to her in privacy. She gets the who group to turn on me.

9. Finally, she tells the employyes to not talk to me and not provide work to me. I come to work, spend 1 hour trying to find work to do and I cant. I walk out asserting constructive discharge and am awarded unemployment.

All this was provided to the EEOC and they dismiss my complaint saying, the actions of the employer and client do not meet the definition of harassment and discrimonation. As a result my illegal discharge drives me $25,000 into debt, results in my credit score dropping to 523 and I am blacklisted and unable to find work in the community. In fact three job interviews are offered and at the a few days prior to my interview they are cancelled

Please you tell her that she is ignorant for the report? But yet your title is the Klan meeting? That's kind of a contradictory statement as you told her not to be ignorant but yet you said the Klan meeting is down the hall. Her opinions is her opinion, she has every right to make a report, but it doesn't mean that the author is racist, it just means she is upset by something that happened and she wants to be heard. Every person has every right to be heard, including you, but you can't go around making ignorant statements and then say to the author to stop being ignorant? I don't know what kind of world you live in, I don't care where you come from: black, white, Hispanic, Blue, Yellow... don't really care we all have a right to be heard.

Blacks think they can harass white people & torment us. They just can't pay back every single white person who walks their path.  I don't have a problem or anything agaisnt blacks.  But once they attack me I will defend my myself & I will use racist slurs agaisnt them.  If they call me anything.

So people can call me a "BIGOT" "RACIST".  I will not put up any racist remarks from blacks.  I don't bother anyone unless they bother me.

I am Caucasian and  feel I was discriminated by an African American Manager. I followed the chain of command with the company with no results. I filed a charge with the EEOC with no results. I have written statements from my witnesses and I mailed these statements to the investigator with  the EEOC. The investigator basically told me the statements would not help me. The investigator with the EEOC phoned me and advised me to e-mail him asking for a Right to Sue Letter and
e-mail him requesting my completed file, I e-mailed both of these and I only got the Right to Sue Letter from him I had to send certified letters to the Director in order to get my file. I was given false information from this investigator. The EEOC did not help me at all regarding this matter, if anything they hurt me.  I have contacted my congressman, Department of Justice, United States District Court, etc. I have contacted others also.

My main topic is to let someone know that I don't think everyone has equal rights in this USA. O I think everyone should be treated the same regardless of race, treat everyone as you would like to be treated. I would like for tougher laws to be put in place so everyone would be treated equal.

The eeoc georgia commission of equal opportunity Is a farce.  They protect the employer & don't care If the employees rights have been violated.  You just have to find a new job & hope your employer Isn't black.

If you are white the eeoc will dismiss your complaint.  And say you weren't discriminated agaisnt.  But then they tell you.  That you have the right to sue them.  The eeoc Is a complete farce.

Its a total waste of tax payer money.  Because they don't do what they are suppose to do.  In protecting workers rights.

EEOC : THE INCOMPETENT GOVERNMENT SOLUTION

After filling a complaint with EEOC about a Chief of Police talking money from an Officer I was retaliated against by the Department, I was a sworn full time Officer. EEOC not only butchered the investigation but showed clearly they are an incompetent agency needing either a disbanding or complete tear down and rebuilding of staff. I was warned by several attorneys EEOC is largely incompetent.

EEOC by law is charged with investigating the facts as primary. In this they failed near 100% in my case.

EEOC sent an investigator to the Department and spoke with the very Officers retaliating against me. I have no opposition to this but the point is they lost their own objectivity in the process and "took sides"; a cardinal sin for any investigator.

EEOC DID NOT meet with me but conducted a phone interview only!

Shortly after EEOC spoke with the other Officers (code of silence and demonization of my character) EEOC turned a cold shoulder to me and refused to meet with me for a discrepency interview. I could have easily picked apart their story and added truths to show they were truly lying. I had in my possession a private investigators report indicating the Police contacted people around town trying to drum up dirt on me to discredit my word. EEOC refused again to meet and never read the report!

The city terminated the Chief for taking the money. Imagine that, someone did the right thing but it was NOT EEOC. I retired out by settlement and am set for life, yet, EEOC had no part in the settlement process as they screwed the pooch from day one causing this issue to last 2 full years to settlement when it could have been done in 6 months had they performed competently.

EEOC had a simple case yet they caved in to ignorance as they are truly the worst investigators absent common sense I have ever come across.

My cousin had several great EEOC winnable lawsuits ranging from sexual harrassment to ethnic discrimination to discrimination based on gender to discrimination based on perceived sexual orientation to hostile work environment to providing inadequate training, not having a standard job description available for ALL employees ... and there were other things with other federal agencies.

Let's hear it for the GREAT PRIVATE SECURITY GUARD CONTRACTING AGENCIES because they do their part to keep the petty and often vicious SEXUAL,RACIAL,COLOR,GENDER, LIFESTYLE, DISABILITY HATRED and DIVISIONS going by the ignorant, crooked, coked up TRAILER TRASH that manage and operate them...DISCRIMINATION,PREJUDICE,IGNORANCE OF EMPLOYMENT LAW AND HUMAN RIGHTS and EXPLOITATION of what they believe is an infinite supply of people stupid enough to put on the cheap, ill-fitting polyesther uniforms while they rip off them and people stupid enough to hire them is what they are ALL ABOUT!

EEOC refused to do anything but send a green sheet of paper about a day after she filed the complaints telling her that she could sue the employers.

BIG DEAL! She could have done that anyway on her own --assuming with the bare minimum they had been paying her that she could have afforded to more than pay the rent, utilities, transporation and food costs. Good thing they provided uniforms because she could not afford a typical businesswoman wardrobe --not even the kind of clothes temps and blue collar jobs wear --on what they were paying her--and me, because I was fool enough to work in the industry myself.

I have only known of ONE guy who sued a security company successfully for a CIVIL RIGHTS VIOLATION and he was a LATINO WAR HERO (AND HAD A SERVICE-CONNECTED DISABILITY) WHO WAS OF AFRICAN ORIGINS AND HE HAD A ALTERNATIVE SOURCE OF INCOME WHEREBY HE COULD RETAIN AN ATTORNEY WHICH THE SECURITY GUARD SERVICE CONTRACTOR DID NOT EXPECT--because they had STEREOTYPES of African Americans. OOOOPPPPPS. HE SETTLED QUITE HANDSOMELY OUT OF COURT!

But the EEOC didn't help him.

THE EEOC HAD NOTHING TO DO WITH IT!

HE WAS LATINO, BLACK, VETERAN, DISABLED, HE WAS IN THE "PROTECTED AGE GROUP" AND YOU TELL ME HOW EEOC HELPED HIM!

OR MY COUSIN WHO WAS FEMALE, NATIVE AMERICAN AND HISPANIC -- THEY DID NOTHING FOR HER EITHER!

EEOC "DO NOTHING" IS TRULY EQUAL OPPORTUNITY --- THEY DON'T HELP ANYBODY!

As far as I know, those guys at EEOC just sit on their butts and do nothing but draw Xs on the calendar as each dead-a*s, do-nothing day passes until their retirement from the government job that POLITICAL PATRONAGE probably got them.

Of course the eeoc isnt going to consider anything the employee says. People can call me a racist, I just don't like when other black employees lie to get someone else fired. This Is what happend to my mother 4 years ago.

The house has not been lost got another new car these employers will never win. I don't like It when employers or employees lie.

People can call me a racist but I will continue to speak out agaisnt work place violence & workplace bullies, who down right lie to get someone else fired.

Liars might get away with It for a while but @ then It comes back to haunt them. Its just sad how they try to ruin a persons lively hood just cause they don't want to work with them.

The employers can lie & discriminate. When the employee files a complaint or files for unemployment, the employer lies & covers everything up & has other people lie to back them up.

I really don't care what black people think. They are the cause of my mother never being able to hold a job my mom always has to change jobs every six months.

At 1 job the black employees told my mother they had been there for years without being fired well all the white people have gotten fired.

The nurse manager was married to a black man so she defended the black employees & gave my mother a hardtime.

The nurse manager Is a white racist but this Is wrong. I would like to know why Is It my mother Is always the one who gets fired while the trouble maker employees gets to keep working there.

Black people also bring there own troubles. If they want obama to become the nations first black president they need to shut there racist mouths up.

And don't think cause obama will be president ya'll can make us poor because It want happen.

Obama Is for all races.

Don't file complaint's with the eeoc it will do nothing good for you. You waste a year from your life & @ the end the eeoc dismisses your complaint like how they treated my mother.

Just find another job but remember employer's who treat there employee's like crap alway's get it back just find a new job that is what my mother did.

The eeoc does not care you waste month's waiting for them to investgate your complaint then @ the end they dismiss it saying you weren't discriminated agaisnt, but they still give you a right to sue letter.

Why can't the eeoc help grant you relief on there website they help people all over the country recovery damange's & there lost wages, but when my mother filed a complaint they did nothing.

The eeoc need's to be investgated for violating people's civil right's. But thank god for the rip-off report you can make your voice heard.

The real issue is that government won't punish government. The fact that you are white has less to do with your ruling. I am a black female in Atlanta and filed a case against the government office I worked for and got the same thing you got! Believe me, blacks aren't getting any BIG settlements. Those days are gone ('70s and 80's).

The EEOC is full of a bunch of lazy government workers, like a lot of other offices. We need to reduce the same of government on ALL levels and put some "teeth" in those that should be working for the public and not for themselves.

Therefore, under the "at will" employment laws, the employer is not required to have a reason to fire an employee, nor do they have to even give them anything in writing as to the termination. They can simply say "you don't work here anymore".

Now, if they do decide to give a reason, that reason cannot be in violation of any state or federal law such as racial discrimination, sexual discrimination, etc.

The burden of proof is on the employee to prove that such discrimination took place. These complaints should be filed immediately in writing to the EEOC.

"Right to work" simply means that an employee can work in a union shop without paying dues or initiation fees, but still has the same rights of representation as the dues paying union member. It has nothing to do with at will employment. It has nothing to do with "having to answer to a union". Right to work states do have unions and recognize union contracts.

To Melissa you do not know what u are talking about, you are just

like everyone else on this website just because someone says something

agaisnt the eeoc they are considered a racist. Everything, you have

You want constructive advice.

Stop blaming the world for your problems. I'm a white woman who has been working since 15. I've never lost a job. I succeed at what I do because I try hard and I'm determined. If I was fired, I wouldn't run and file a lawsuit. I would get a new job and strive harder. I would evaluate what I did wrong, and fix it.

Make no mistake: You are a racist. You are the type of person who believes the world is out to get them. It's easier to blame everyone else than yourself or your mother.

I work in an extremely diverse work setting. The job is stressful and people are always getting fired, regardless of race. Their job performance is what dictates their longevity with the company.

It does not behoove a company to fire someone if they are doing their job well. It certainly does not behoove a hospital to fire someone who is a hard worker. IT doesn't make sense.

I've never encountered racism in the workforce because I am white. I've had African American supervisors and I have always been treated with respect, because I'm a hard worker. There have been white people to get yelled because their attendance was poor, and they would cry "reverse discrimination." They would be wrong; and so are you.

Why don't you get a little bit of self-respect, try to gain a little bit of integrity, and be a better person. Don't spout out about race wars or how organizations are run by 'blacks.' When you act stupid, you'll be treated as such. That's the way of the world, buddy. Deal with it.

The, black people who commit hate crimes agaisnt whites do not get

enough punisment but if white people commit hate crimes agaisnt blacks

they don't get probation like black people do, white people get tough

sentences while black people do not. When, black people start

I, am sick & tired of people accusing me of being a racists I am

speaking out agaisnt discrimination agaisnt white people, how am I

gets away with discrinmantion, if u are white don't accept fair

treatment cause the eeoc will dismiss your case saying you weren't

discriminated agaisnt. What, can anyone do nothing you are screwed!.

Black, people can keep there jobs & say racist remarks like white trash,

on tv but do they ever get fired no they do not, its always white people

who can't keep there jobs cause of these racist black people who hate

white people. If, a white employer done what my mothers former

black employer did the eeoc would call it discrimination & helped the

I, am not racists I dislike racist black people, I would like to know why

people never attack black who says racists remarks toward us white?

blacks always get to keep there jobs, over the years I have heard

some nasty ugly racist remarks from blacks on the news towards us

When, I was in school blacks always got away with everything & the

white kids always got introuble I was always harassed buy black people,

3 duke lacross players this is an example they where accused of

attacking a black female & they had evidence they where somewhere

else, the racist district attorney still proceed to file charges but he lost

his job. These, black people still says there guilty even though they

girl said they attacked her, she should be prosecuted for lying!.

Well, the 3 duke lacross players got there good name back & sued for

millions & the corrupt discrict attorney lost his high paying job.

Charles,

The wording below should simply have been "the employer" instead of "the black employer".

And, as far as unemployment benefits go, there are a few things you need to know. First, you don't "win" unemployment. It is not some sort of prize or lottery.

Second, your employer does not pay your unemployment checks. Unemployment compensation is actually an insurance that your employer simply pays premiums for. The payments actually come from your state.

Third, there is not "at fault" or "not at fault" criteria in recieving unemployment benefits. If your termination was due to something willful on your part, you will be denied. There are some circumstances where you can quit and still recieve unemployment compensation.

Now, to your specific case. You would have to prove that the reason you were terminated as a white employee, was for the reason of being able to hire black workers to replace you. That would be extremely hard to prove.

I currently have a case with the EEOC against Tropicana / aka Tropicana Products / aka Tropicana Products here in Bradenton FL. I have a well documented pattern of harassment and retaliation against me by the Tropicana HR dept., and my case will be very difficult to win. And, I have witnesses! Tropicana is a division of QTG [Quaker-Tropicana-Gatorade] and is owned by PepsiCo.

You must have done something to really piss of Satan, because that guy seems to make your life a living hell.

You suffer from a severe accountability deficit. You have proven yourself to be one of the most irrational reporters in the history of RoR, and you continually refuse to listen to rational people with solid advice.

Meanwhile, while you've spent the past two years ranting and raving about the EEOC, I'm sure your mother has missed the deadline for filing an employment discrimination lawsuit. You/mom failed to adhere to the proper legal procedures, and failed to follow through on the enforcement of your rights. Satan has nothing to do with that.

If I get in my car in the morning and fail to turn the ignition key, I don't get angry that my car won't start. If I turn the key but fail to put the car in gear, I don't get angry that the car isn't going anywhere. Why have the eeoc if they are be in favor of the employer & believe the employer over the employee. the eeoc is suppose to help victims of discrimition not close their complaints after the eeoc receives the employers response. As we have another detractor in the fray, I'll explain this one more time.

The "job" of the EEOC is not to "enforce" anti-discrimination laws.

The "job" of the EEOC is to INVESTIGATE complaints of discrimination and to determine whether the complaint can be resloved at what is referred to as the "administrative level."

Here's a little analogy that may help you understand this concept a little better. Imagine that a student in a high school is given what he feels is an unfairly low grade on a project. His first step is to complain to the principal. If it is a clear-cut case either way (either the student is clearly right or the teacher is clearly right) then the principal can make a decision on his own in somewhat of an informal setting.

However, if the disagreement between the teacher and the student is more complex and cannot be resolved by a simple he-said/she-said confrontation, it may be necessary to escalate the issue to a school board decision.

Now, could the student take his grievance directly to the school board? Nope! They would send him back to the principal's office to see if the matter could be resolved within the school's internal administration, thus allowing the principal to at least perform a cursory examination and round up all of the relevant evidence.

Think of the EEOC as the high school principal in this analogy. Its role is to investigate the case, compile evidence, and make one of two determinations: either the employee is correct and deserving of a monetary award, or the case is simply too complicated and must go to a trial.

In both of the complaints in this report the complainants stated that they "lost" at the EEOC. Any attorney with an ounce of employment law knowledge will tell you that only an employER, and not an employEE can "lose" at the EEOC level. When the EEOC determines that it cannot find in favor of the employee, it issues what is referred to as a "Right to Sue" letter.

The "Right to Sue" letter is the employee's ticket to the courthouse. With the letter in hand, he may now file a lawsuit against his employer. Without the letter, any such lawsuit will be dismissed for "failure to exhaust administrative remedies."

Having gone through the EEOC process, either of the above-mentioned complaints could have been filed in a federal court, and the complainants could well have won their cases. But rather than avail themselves of the legal remedy that became available after the EEOC proceedings were complete, these complainants chose to throw in the towel and allege discrimination on the part of the EEOC.

It, is the job of the eeoc to enforce discrinmantion laws! my mothers former employer did not have a legitimate reason for termination the black employer lied saying she was insubornate & she argued with her employer, & my mother was awarded unemployment benefits!.

This, is all about discrinmantion! like I said this before if this was a black person the eeoc would have done something to get their wages they lost back!, my mother also found out from another employee the the employer was going around asking employees to write false statements about my mother, this is defamation & slander! this is the lie the black employer told the unemployment hearing officer!. But, my mother was awarded unemployment benefits! why should I always have to move on with my life!, my mothers former employer did not have a legitmate reason for terminating my mother!, they just wanted to discrinmate agaisnt a white person cause blacks think they have the right to discrinmate agaisnt white people!.

Actually, Charles, pretty much everyone has given you the most effective advice that is available: get on with your life and give this a rest.

The problem is that you equate "advice" with "affirmation." But when you are just plain wrong, your cause doesn't warrant affirmation, and thus your version of "advice" isn't forthcoming.

You also seem to be confused as to the definition of "discrimination."

Discrimination, in the legal sense, requires an actual intent to discriminate. It's not enough to show that you were treated differently from a similarly situated, but differently colored person. That's just the first step in the analysis.

The next step is for you to refute the employer's legitimate, non-discriminatory reason for the adverse action. You and your mother's very demeanor is prima facie evidence that the employer probably did have a legitimate reason for the termination.

But again, all of that's beside the point, because your complaint against the EEOC, when viewed in light of the actual function of the EEOC and the procedure involved with a discrimination complaint, makes no sense at all.

But I will now reiterate the ONLY advice that is at all relevant to your circumstances: get on with your life! Your mama had the opportunity to bring a lawsuit. But that ship left the port long ago, and mommy refused to board. So what more do you want from us?

I'm a licensed attorney and it would be highly unethical for me to give you an inaccurate depiction of your/your mother's rights. So I have given you the truth of the matter, over and over again. There's nothing more that I, or anyone else can do for you and your mom.

Your mom failed to protect her rights by filing a timely lawsuit. Sorry, but that's how the cookie crumbles.

1. Employers DO have the right to hire and fire anyone at any time, whether they are white, black, green or purple. Technically, if you were my employee, I could fire you because I didn't like your hair color. Is that right? No. Is it legal? Yes.

2. You throw the word "discrimination" around WAYYYYY too much in all your posts. You have nothing going on in your life but to bad mouth black people? How about taking responsibility for yourself...like going back to school and learning to read and write English properly?

3. Things that are unfair are not necessarily discrimination, per the law. Just because your white does not mean that every black person is discriminating against you. And if you truly feel that way, you should move out of the south and move to a place that has few blacks. They you'll know true discrimination: white/white... based on your qualifications.

4. This thread has gone on WAYYYY too long. How about getting a new hobby: fishing, making model airplanes, cooking. Your posts are all the same: I'm being discriminated against. YAWNNNNNN. We're not helping you here, and you're not helping yourself.

5. Quit posting for your mother. If she's able to read and write (and I should hope she could if she's a nurse as you said she was elsewhere) she can write here. If she doesn't, it means she doesn't WANT to post here. Respect her wishes, huh? Be a good son!

All, people wanna do is cause me emotional stress!. Of, course people would say I am wrong! the blacks are punishing us whites for their unfair treatment back in the 1950's & 1960's, the blacks are not punishing us!. Well, I do not care if people think i am wrong! well I will not listen to these people, who try to bully me! cause they will never listen!. A, employer regardless black, white, asian has no right to terminate you if you do not deserve it! this is abuse of power & authority I will always continue to say this, & a employer cannot have all blacks & all whites it has to be half & half not just all blacks & all whites. We, could all put this to rest when employers quit abusing their authority & power & quit terminating & would stop all this discrinmantion!, it would be nice if blacks would stop doing this. But, this will be once hell freezes over!. All, the complaints on this website agaisnt the eeoc are vaild! they do not help white people with discrinmantion cases! but all people do is wanna cause me emotional stress then the emotional, stress I am feeling already!. Linda, I agree with most of what you've stated.

But you could have picked a more appropriate report for your comments.

Everything (per the EEOC) happened exactly the way that it's supposed to. Charles' mother did not "lose" at the EEOC. Nothing was decided against her.

What happened was that the EEOC determined that it could not make a determination regarding this claim in its administrative setting. So it gave Charles' mother what's called a "right to sue" letter. This letter affirms that the claimant went through the administrative process that is required before you can file a lawsuit.

This is what happens most of the time, and it doesn't mean that the EEOC is racist, it just means that the case has to be heard in a courtroom.

So Charles' mommy's next step was to file a lawsuit. For whatever reason, she decided not to do so.

Basically, she left the game at half-time and is now complaining about the final score. This is the major flaw in Charles' reasoning, but he doesn't want to hear it. He is dead wrong about the process, he has been all along, I've told him this over and over, but he continues to post his diatribes once a month.

I'm not biased against anyone, and I don't know enough about his mommy's situation to surmise as to the validity of her claim. And guess what, the EEOC was in the same position.

Charles is just plain wrong about the EEOC. His comments are akin to someone getting mad because the new car they bought doesn't fly. He thinks the EEOC should do something that it is not designed for, and he is upset because the it did exactly what it is supposed to. If he would take the time to listen to people who know what they're talking about, we could put this to rest.

Charles, I honestly feel for you and you mother regardless of all the bias comments made on this Report turned into " Attack Charles Forum" I lived in Ashland Alabama for ten years, out of those ten years I worked four of them, for some discrimimatory reason or another I couldn't find a job for six years not specifically consecutively, although I was not born and raised there, I moved there because of the climate, "beautiful country" unfortuntely I had to move out of Alabama because of the same brutality that you mention, I'm a white woman, I am now 52, but lived in Alabama from 1991 - 2001, Have you ever heard of the phrase MAJORITY RULE?? I think the best thing you and your family can do IS PACK UP AND LEAVE ALABAMA to that majority, you can't fight city hall and you do know who owns city hall, nobody should judge you unless they live in a state where discrimination was born, it being the capital of it. remember that sueing an employer means you had better get rewarded enough money to last the rest of your working life, because what employer will trust to hire you, since you have attacked someone of THEIR own rank. Alabama is predominantly conservative republican, a capitalist society, The relief I felt working in another state was refreshing.

Anyone who terminates any employee, when that employee has done nothing wrong to deserve it, is abusing their authority to rule in his or her own position, this would of course have to be based on lies, if it is concidered that the job belongs to the employers and they can terminate anyone at anytime for any reason, first of all, that is a moral wrong and very childish, the employer can't determine right from wrong.That is as bad a stealing. The employers job is to determine the act of termination based on bad workmanship or conduct, or in a layoff situation when there is no work to be performed.

We are dealing with people not robots, machines can be turned off. people cannot, they have to work to eat and have shelter for them and their families, people are not skillfully or behaviorly perfect, people have emotions, robots do not have any of these things, well I guess that is why alot of industry has gone fully automated, not to mention that it's cheaper. the only problem with this is the jobs are eliminated and the more machines do then there is less money to be spent because it isn't earned.

Periodically you hear in the news that a former disgruntled employee of a company pays their former employers one last visit with assault rifles and hand guns, How does a person get this desparate? Here is cases where the EEOC and other prominate authorities has abused their powers by pure neglect of those who seek justice for the crime of descrimination a defamatory conduct by employers. No it is never said on the news that the perpetrator lost a claim that he has filed, news just reports these persons as anti-social and problem causers farther protecting the employer.

So who is the real criminals, Well he works from nine to five, he produces evil intent in people seeking justice and morality from his verbal abuses and demoralization of innocent workers.He doesn't deserve to be filled full of holes however, his punishment should be nothing less then poverty and shame.

Employers are very careful to discriminate under the guise of legitimate reasons even if it is fabricated, this is to protect themselves from lawsuits.
a ex-employee would have to prove direct discrimination even in a indirect manner, such as " I was fired because I didn't get my work done on time even though a person who is either of another color or sex, or religion had made the same mistake and was overlooked.This is even when the law doesn't distinguish between direct and indirect reasons.

Fedaral authorites have more power then they portray and should exercise it and not neglect the citizen of the US and pass them off to private attorneys.

The, eeoc claimed in my mothers case their was no evidence of discrinmantion well of course they say they about every white person who files complaints!, but if a black person files complaints the eeoc always finds them to be discrinmanted agaisnt & help file a lawsuit, for their damanges!.

My, mother has appealed the decision to superior court! my mother will not pay back the unemployment payments that she was awarded , the board of reviews also refused to re considered the decision!. The, unemployment hearing officer reversed their decision so that my mother will have to pay back the unemployment money! & believed the employers false statements!, my mother refuses to pay back the unemployment money because it wasn't her fault she got terminated she was wrongfully terminated because she was white!, & know due to the unemployment hearing officer my mother know has to pay back all this money that she was granted!. My, mother has appealed this to superior court! you will lose regardless with the board of reviews they turn down everything who has done nothing wrong to be terminated!, all the employer has to do is make up lies! & their you are without a job!.

Quit, defending the eeoc!, I am sure why you are defending them because they treat blacks more favorably then whites! & that I will ruin the little click ya'll have going on!, I do not know why people would defend the eeoc! its a waste of time to file complaints with them! they do not care about anybody they sure don't care for whites they want to punish us!. Thanks for providing that reliable, statistical proof that I asked for, Charles.

I know that, in your head, an unsubstantiated statement like "The, eeoc does treats blacks more favorably" is good enough. Case closed, right Chuck?

Fortunately for the rest of us, the EEOC (along with the remainder of the thinking world) requires a bit more. You see, there could be a hundred guys from Alabama with poor punctuation skills shouting about how the EEOC treats blacks more favorably than whites. That doesn't make it true, buddy!

What does make it true? What would actually prove that your statement is correct? How about a research-based study, from a reputable institution, showing that black people are significantly more likely than white people to resolve cases favorably at the EEOC level? That, at least, would be a good start!

But you don't even have that for us! At best, what you have is a fleeting hope that the truth is what you want it to be.

Listen, just because you THINK that black people are treated more favorably by the EEOC doesn't make it true. Just becuase your buddy down at the bar told you that "the niggers always win" doesn't make it true either. Even if Limbaugh or Hannity are shouting about it, that doesn't make it true. None of those are reliable sources.

I asked for REAL proof, not more of your ramblings. Did your ma walk into the EEOC thinking that the diatribe of a deluded redneck was all the proof she needed? If so, then thank god she "lost"!

You began your most recent, direct rebuttal to me by advising me to "read the laws" on workplace discrimination. Charles, do you know what the letters "J.D." denote? Do you know what it means when those letters are follwed by the phrase "magna c*m laude"?

Believe me, I've "read the laws." Not only have I read the laws, but I've advised people just like your mother on their import. I've applied the laws to countless factual scenarios. Heck, I've even published articles in legal publications about "the laws."

And guess what, Chuck? Thus far, you're the only one who thinks I've got it wrong!

I know it's completely lost on you, but here's where I'm coming from: if you take the time to understand how the EEOC operates, which I've laid out a couple of times for you, then you will realize that your complaint lacks any basis in reality.

Here's a little metaphor to help you understand. Imagine that you're playing a game of baseball, and you're at bat. The ump calls the first pitch a strike, but you're pretty sure it was a ball. Do you then turn around and scream about how the ump shouldn't have called you OUT? NO! If you understand even the most basic aspects of the game of baseball, then you know you have at least two more whacks at that ball. So you take your shots and hope for the best. If you end up striking out, then you can go ahead and get upset about that first, arguably bad call. Before then, however, your energy is wasted.

Now, let's talk about "talking out your a*s." Here's a little quote:

I imagine that what you're trying to say is that blacks are treated more favorably by the EEOC.

WHERE'S YOUR PROOF? Do you have ANY statistical evidence to back up that statement? NOOOOO! You don't! Because such evidence doesn't exist! You're just making up facts and hoping that nobody will call you out on it. In other words, you are INSULTING OUR INTELLIGENCE!

Now, I'm sure your next posting will have "this is my last response," or something to that effect, in the header or body. Please, for the good of the thinking world, be sincere about it this time!

blacks get better treatment from the eeoc & treat everyone else hispanic, white, ect unless your black you will win but if you from a different race forget about fairness, they treated my mother like garbage also all statements from her black employer where false & my mother had witnesses to prove the employer was going around asking the employees to write false statements about my mother insubordinate behavior!.

It wasn't only after 3 months my mother filed the complaint they dismissed it they didn't even investigate anything the eeoc should be disbarred & fined for felony charges for violating civil & human rights!.

Equal is for everybody not just for the blacks if my mother had of been black things would have been different!.

I live in Miami, FL. I am Hispanic and have a situation like Kathy _not exactly the same. I, along with another co-worker, filed a complaint in eeoc. They dismissed the cases and gave us a right to suit letter. They never called any of the six witnesses I provided. They treated me like garbage after I called to claim the reasons for dismissal.

All statements made by the employer were lies and my witnesses could have proved that if they had been called for interview. I think if I was black all this would have been different.

I know exactly what you are talking about.
I will right my own report soon on this and other sites.

This is to Patrick, this is why noone listens to Timothy he insults people tells them that their wrong & calls them idiots just down rights degrades people. If, you file a complaint against the eeoc you're considered a white racists if any white person says anything against blacks they are consider racists, this is why nobody takes timothy's advice!. I am sure if this was a black nurse got fired & two whites replaced her the eeoc would call this discrimination & help them get their lost wages back, of course everyone ignores this every black person wins discrimination complaints with the eeoc this is a direct violation of our civil rights.

I said "we do not have the right to work" I did not say Alaska was not a "right to work state" There is a difference. NO ONE, ANYWHERE has the RIGHT to work. Now, states may have "right to work" laws, but no where in this country's constitution does it say you have the right to have a job. I did read what you wrote. You are confusing "Right to Work" with "At will employment"..They are TOTALLY different things.

I was telling you that your reference to "Right to Work" was totally irrelevant.

You said that Alaska is not a right to work state. Did you know that is actually a GOOD thing for EMPLOYEES? Right to work laws KILL unions and promote low wages.

At will employment simply means that either the employee or the employer can terminate the employment relationship anytime, without notice or cause.

This is why employees need a union, and this is why right to work states are usually also an at will employment state.

AK is an exception, and like I said, that is a good thing. AK has good paying jobs and unions.

And before you correct someone, you should at least proofread your post. I said EMPLOYEES NOT Employers.

Enjoy working in AK.

Here in FL you ned a union to make over $10/hour in most cases or to get any benefits at all. The employERS here enjoy both the right to work and at will employment status of FL. Big business likes FL.

This is my final reply but i cannot let this one tiny fact go buy, why is georgia & alabama violating peoples civil rights & the injustices that employers do to people making people lose their homes cars & everything they have ever worked for. This problem is only getting worse unless all the citizens of alabama & georgia fight for their civil rights!, i would like to know what gives them the right to make people poor, the state of georgia has the eeoc to protect peoples civil rights agaisnt discrinmantion but it only applys to blacks who have been discriminated agaisnt it doesn't apply to white people who get discriminated agaisnt black employers. I only listed the things the employer accused my mother of doing which my mother didn't do their was a confrontation which the other employee my mother was working with started, & the black employer had written my mother up for it. These are the same lies the black employer told the hearing officer & the eeoc my mother didn't argue with them them which they stated to the eeoc was the reason for being fired & after that they hired to black younger nurses this is age & race discrinmantion regardless what people say on this website. You can't unlawfully fire somebody & hire a different race in their place, if a white employer done this they would be all hell to pay , the blacks would win in the eeoc & in court agaisnt the white employer & they get big $. Look all threw history a black person complains about discrinmantion & they always win but never a white person just like in the eeoc so the charging party always gets away with discrinmantion but never a white person gets away with discrinmantion, if blacks run a place theirs always corruption & they always get caught i don't know why they think they can get away with it crime doesn't pay. This will be my last reply, not just because people have insulted me about my typing or spelling i have made my point loud & clear regardless if anybody agrees with me or not, i am not giving in i have spent way to much time on this subject & taken everything else in my life away & enjoyment of life. I am not going to be accused of being a racist because i am not a racists i dislike racist black people i don't hate blacks i don't hate anybody, regardless of their evils they do to me & my mother & trying to make my mother lose everything which this black employer intented for my mother to happend. But guess what a year later & we are still in this new house so they did not achieve what they had planned with help from caring family members & other sources my mother made it just fine, so no matter what the black employer had in mind to make my mother lose her house & car it didn't work no evil anybody does ever works i have nothing to worry about, my mother still has a place to live & i & we are not living on the streets homeless i have forgave the eeoc because of their evils & forgave the racist black people for their evils, which my mother tells me to do is forgive your enemies, & love your enemies which god & jesus tells us to do its hard for me but it will be the only way i can have peace to move on with my life. Her former black employer & employee did not achieve what they have plotted agaisnt my mother to make her lose everything a year later we are still living in this new wonderful house & nobody is taking it away! not this time, this will be my last reply don't think because i have gave in to your insults or telling me i have filed false complaints i have wasted enough time on this website getting my word out. Here's what we have in front of us, Charles.

We have you and your mother who have been antagonizing, hostile, and completely unwilling to hear other people out even when they are providing valuable legal advice.

The basis of your mother's termination was that she was involved in a workplace confrontation. Given you and your mother's behavior in this forum, why should we think that the employer was wrong?

Now, here is the foundation of your wrong-ness: "my mother was discharged & two black nurses where hired in my mothers place, this is discrinmantion & racism regardless what any person says on this website"

You are so wrong that my head is spinning. The mere fact that your mother was fired, and that two black women were hired, does not even make out a prima facie case of discrimination!

Did you really expect that, on nothing more than the fact that your mother was replaced with a black person, the EEOC was going to find discrimination?

Don't you think that the law requires a bit more than that?

The funny thing is that, when the EEOC correctly found insufficient evidence of discrimination, you called the EEOC a bunch of racists!

I am amused at how little evidence it takes to convince you that someone is a racist, yet getting any other point through your head is like trying to stuff a watermelon in an envelope.

But your problem is patently obvious: you see what you want to see, and close your eyes to everything else. You refuse to believe that you could possibly be wrong, or that your mother may have been legitimately fired for having the bad attitude that she has displayed here, or that the American legal system may actually be interested in facts and evidence rather than your absurd rhetoric.

Now, even as you have tried to shift the focus away many times, your mother's original complaint was against the EEOC. I'm going to explain this ONE MORE TIME for you, even though you will never actually read what I write:

There is a specific procedure involved in maintaining a charge of employment discrimination.

First, the employee must file a complaint with the EEOC. The law refers to this as your "administrative remedy."

After the EEOC complaint is filed, a cursory investigation will be performed, hearings may be had, briefs may be filed, evidence may be presented. The EEOC is not a court, however, so there is no "trial" at this stage.

Now, the EEOC will do one of two things. It will either find that the employee was discriminated against and levy penalties against the employer, or it will find insufficient evidence and issue a "Right to Sue" letter.

The VAST majority of EEOC cases end with a Right to Sue letter. The reason why is simple: Americans have a right to "due process," which, basically, means that your rights cannot be taken way/you can not be punished without a full and fair opportunity to be heard.

In some cases, the evidence may be so clear, or the employer may make certain concessions, so that the EEOC can resolve the matter without is having to go to court.

In most cases, however, the EEOC is simply not equipped to hear all of the evidence, nor is it capable of rendering a judicial determination. Thus, having exhausted the administrative remedy, the complainant is given the right to bring an employment discrimination claim in court.

Now, your mother received her Right to Sue letter, which is how the vast majority of EEOC claims end.

So what's the problem?

Everything went exactly how it should have. I am trained to spot legal issues and, let me tell ya flat out, you have none per the EEOC, at least with what you've given us here.

Your mother may now bring a claim in court and have her evidence heard by a jury. Everything went exactly as it should have: the EEOC decided that the case wasn't succeptible to administrative resolution and opened the courthouse door.

If your mother now chooses not to prosecute her claim in a court of law, then she must not have had much faith in it from the start.

I'm sure we all look forward to your next delusional rant.

We are not racist, we hate racist black people like the black people on this forum who have said we have lost our creditably my mother got written because this other employee started harassing her & fighting with her, & the black employer said that they where screeming & yelling @ each other which my mother denies & the other employee was started throwing papers @ her. Yes my mothers is in her late 40's & they black employer hired two black young nurses in her place 15 years younger then my mother the, the eeoc claimed they could find no evidence of race discrimination how could they not the two new employees were black is that evidenc enough so they closed that complaint. The eeoc is working on the age discrimination part that should get her former black employer for lying about my mother, it will probally be like the race discrimination complaint they could find no evidence for age discrimination its time the eeoc does what they get paid to do besides closing complaint, but they are not fair toward white people who file complaints they said that my mother was not discriminated agaisnt, they will probally say the same thing about the age part also I just would like to get the word out how the eeoc is treating my mother because she is white its racism I am afraid when i get in my 40's that i to will be in the same problem not being able to work. You stated that your former employer fired you and hired to YOUNGER black females. If you are over 40, you are SUPPOSED to be able to file for age discrimation:

Title I and Title V of the Americans with Disabilities Act of 1990 (ADA), which prohibit employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments;
Sections 501 and 505 of the Rehabilitation Act of 1973, which prohibit discrimination against qualified individuals with disabilities who work in the federal government; and

the Civil Rights Act of 1991, which, among other things, provides monetary damages in cases of intentional employment discrimination.

We do have laws, its lack of ENFORCEMENT of the laws that we as citizens of the U.S. are having problems. LAWS are USELESS without ENFORCEMENT.

Through this website we may be able to unite and put pressure on our tax $ paid law enforcement officials to actually do their job.

EEOC Does Deny Complaints From White U.S. Citizens ... It Happened to Me

"It's time for us white people to take a stand against these racist black people who wish to do harm to white people."

In response to the above comment, not everyone is racist. However, prejudice and racisim can and does exist in all culures and all nationalities. Remember, prejudice is ignorance. The more educated a person is, the less likely he or she is likely to be.

I have witnessed "reverse" discrimination, too. We as a country need to stand up for everyone's rights, not just the minority's and immigrants.

We, as legal U.S. citizens, need to recognize that even white people have rights, and white people fall prey to racism and prejudice.

I took an hispanic sex offender before Judge Alex in October, 2005, for destruction of property, racist comments, and financial loss suffered by this man. (Please note that I did not even attempt to sue for pain and suffering. The case was Matthews vs. Sanchez, and it aired on Jan. 26, 2006.)

Judge Alex, who immigrated from Cuba with his family as a child, claimed there was no such thing as "prejudice against white people," and ruled in favor the the ex-con and registered sex offender.

"If the EEOC cannot be fair to everybody then they need to be shutdown for not helping people."

Again, the EEOC was created to defend people's rights that, at the time the EEOC was established, really needed to be protected. Times have changed. Now, anyway can fall victim to prejudice and racism, no matter what your skin color is, no matter what your ethnicity is, no matter where you work. It is human nature.

Only through education and social reform will be united as a nation and truely equal. We as Americans, need to be TRUE to ourselves as well as others. TRUE: True Racial Unity and Equality

The United States are no longer united. It is not racist to stand up for your own race; it is also not discrimatory to stand up and say we will no longer tolerate injustices against us.

We are supposed to be the UNITED States of America. We speak ENGLISH; we have LAWS that must be obeyed; We cannot support the whole world. We can only attempt to defend ourselves.

United we stand; divided we fall. Just be careful of blaming a whole race of people for the prejudices of a few bad apples.

In the meantime, keep fighting for your own rights. Eventually, somebody will listen.

I know what this is racism my mother as been a victim of racism! sense the eeoc is run by blacks white people don't have a chance to win discrinmantion complaints, if a white person like my mother files a complaint agaisnt her former black employer later after the investagtion conculded that my mother was not discrinmanted & the employer gets away with the unlawful crimes they have commited.

This black employer as caused alot of problems worring about having to back back the unemployment money while my mother is out of work & cannot pay it back this is racism firing white people & replacing black younger people is age & race discrinmantion these blacks think they are running everything its time to treat black people the way they were treated in the 1950's but if we do that blacks will cause riots & destroy everything it will be world war 10.

My mom is a nurse this is how she makes her living this is how she pays her bills, food bill, & gas for her vehicle & a place to live & these employers are trying everything in ther power to steal her living away & make her poor, after a bad divorce from my druken father in 1988 when i was in 1st grade after my fahter almost making us poor due to him spending everybit of money he made on a beer besides supporting his son & wife my mother was not working at the time my mother figured nothing was going to work out with my fahter & she felt like a prisioner in our own home so she divorced his sorry a*s, she wanted to be a nurse so after the divorce she entered nursing school & she graduated in 1989 she has been a nurse ever sense then she did not know this is how nurses was being treated like unless you were black you got more favorable treatment then white workers, but she could not get out of it she had to change jobs all the time because of harassment from other black employees getting her fired & because her employers did not like her this is why nursing is having a shortage problem then they will get whay they deserve for treating people like crap!, after a divorce from my sorry a*s fahter 9 years later she filed for bankruptcy because she was struggling so much to pay the bills & her credit was getting ruined because she was never getting hardly any work. Then in 1998 she entered into a christian college which things seem to get a little better because was recieving student loans which helped alot to pay the bills & to have food & a car BTW, my sorry a*s fahter failed to pay me child support which made things harder for my mother because my sorry a*s fahter hated my mother threw all the hell he has put us threw which he owes us close to $40,000. My mother has always had it hard trying to live because of my sorry a*s deadbeat dad & her sorry a*s employers & sorry a*s employees she has to work with so in closing do not judge us unless you hear all of the story thats the problem people on this website think they have the right to judge us when they don't know the whole story!.

You're missing the point entirely, Charles.

Your mother's complaint was against the EEOC, not her employer. So if the employer lied to the EEOC, then your mother should file another report to that effect, under the proper category.

But, assuming for the sake of argument that the employer did lie to the EEOC, which I don't believe in the first place, why is that the EEOC's fault?

Let's move on.

Let me explain in more detail how exactly an employment discrimination case works, so that maybe you can see where I was coming from in the previous rebuttal.

First, a few important legal principles that should be of help:

1) As the complainant/plaintiff your mother must prove by a preponderance of evidence that she was the victim of discrimination. Your mother bears the burden of proof. The employer doesn't have to prove anything.

2) The singular most fundamental characteristic of the American legal system is the requirement of DUE PROCESS. Due process means that no person/organization can be made to do anything, or made to answer in damages, or be incarcerated, etc., without first having the opportunity to defend themselves. It also means that, if you wish to impose the force of government on someone in an adverse way, YOU must show that you are entitled to such assistance and, on the other hand, it means that the person you seek to affect bears no ultimate burden of proving a negative (in other words, the defendant doesnt have to prove that he didnt do something, he only has to show that the plaintiff can't prove that he did).

3) The EEOC is an administrative agency. It is a body of the executive branch of government. Administrative agencies, in many cases, and especially in civil rights cases, are used to lighten the load of the courts by weeding out easy cases and by fleshing out the details of a case before a trial occurs.

This is why everyone raising a federal employment discrimination case must first file with the EEOC. If you don't file with the EEOC first, and instead file in court right away, you will find that the court lacks jurisdiction over your case until you get that Right to Sue letter.

4) In every employment discrimination case, there is a burden shifting method of determining whether the employer is liable. First, the employee must set forth a prima facie case of discrimination by showing that she was treated less favorably than similarly situated employees of a different color/gender/etc. If the employee can't make a prima facie case, she loses. If she can, the employer must then set forth a legitimate, non-discriminatory reason for the adverse action. If he does so (and they always do), the burden then shifts back to the employee to show that the employer's given reason is a pretext for discrimination. If the employee can get satisfy the demands of the third step, then she wins.

But if the employee can't show that it is more likely than not that she was the victim of discrimination, then she loses. And it's not a question of whether the employer can show the absence of discrimination, it's a question of whether the employee can show it's existence.

So those are the general principles. Study them again if you have to. Here's how they apply to your mother's situation:

Your mother filed her complaint with the EEOC like she should have. But your mother assumed that she would win at the EEOC and that would be the end of it. But the EEOC action rarely is the end of it. For the most part, the EEOC can only resolve the case if there are no actual material controversies on either side. If the employee makes out a prima facie case, and the employer fails to offer a legitimate reason, then the EEOC can resolve the matter because the employee has won as a matter of law. Likewise, if the employer sets forth a legitimate reason for the termination, and the employee fails to put forth any evidence showing that this reason was a mere pretext, then the employee wins as a matter of law and the EEOC can resolve the matter.

But if, after evidentiary proceedings, controversies remain, then the EEOC CAN NOT resolve the matter, because to do so would be to deprive the parties of their right to a full adversarial proceeding. The complainant (your mother) must then take the case to court (hence the Right to Sue letter).

SO, the fact that the EEOC failed to resolve the complaint says ABSOLUTELY NOTHING about the EEOC's personal feelings on the matter. It simply says that there are matters that can't be resolved in an administrative proceeding, and that the case must proceed to the courts.

And guess what? The VAST majority of EEOC cases end with the issuance of a Right to Sue letter. And guess what else: most EEOC complaints are lodged by non-whites!

At this point, Charles, you and your mother have destroyed your own credibility in this forum. You began with a complaint alleging that she was the victim of racism, but proceeded to show yourselves as QUITE the racists.

By the tone that the two of you have used, it's fairly obvious to most of us that what actually happened is probably NOT what your mother said happened.

So get the logic of this next statement, because it sums up the absurdity of your crusade. Ill put it in caps in case youve given up on reading this by now:

YOUR MOTHER FILED A ONE-SIDED REPORT, BUT FAILED TO CONVINVE ANY OF US THAT HER CASE HAS ANY MERIT. AT THE EEOC, THE EMPLOYER WAS ALLOWED TO RESPOND TO THE ALLEGATIONS.

IF YOUR MOTHER CAN'T CONVINCE US THAT HER UNOPPOSED VERSION IS TRUE, HOW COULD THE EEOC FIND IN HER FAVOR WHEN PRESENTED WITH BOTH SIDES?

First, Robert is exactly right in everything that he's said. The American rule is that employment, absent a contract specifying otherwise, is at-will. This, of course, means that the employer can terminate the employee at any time for almost any reason.

The employer is not, however, allowed to take adverse actions in a discriminatory fashion.

HOWEVER, the burden is on the EMPLOYEE, not the EMPLOYER, to show discrimination. The law prescribes a very specific procedure and, for some reason, the reporter and her idiot son have decided that they would rather complain than actually follow this procedure.

FIRST, if you want to sue an employer for discrimination, you MUST file a complaint with the EEOC. If you file a lawsuit without first going through the EEOC, then you find your case dismissed. So to all those who have suggested by-passing the EEOC: you can't, unless you like the idea if having your case thrown out of court.

BUT, the EEOC will only resolve charges if there is extremely clear evidence either way. It would be a denial of due process for the EEOC to levy charges in the absence of clear evidence.

The person who filed this report has done NOTHING to substantiate her claim in this forum other than to show that she was fired and a black girl was hired.

Do you really think that that alone is sufficient? If you owned your own business, would you feel that you were treated fairly if the EEOC levied penalties against you simply because you fired a person of one color and hired one of another?

That is OBVIOUSLY insufficient for an administrative determination.

Now, since the EEOC could not resolve the matter on the evidence that they had, they issued the complainant a "Right to Sue Letter."

What is a "Right to Sue Letter?" I'll tell ya.

This letter gives the complainant the right to bring a case in federal court, where the truth can be fleshed out in an adversarial proceeding.

But if the complainant's case is so strong, why hasn't she taken advantage of her Right to Sue? Why has she instead opted to expend all this energy complaining about an intermediary determination?

Could it be becuase this complaint is groundless, and is just another example of white Americans blaming their poor work history on reverse-discrimination?

I think so.

Listen, the EEOC complaint is nothing more than a step in the process. If you expected the EEOC to resolve your complaint than you didn't understand what you were doing. The EEOC generally does not resolve complaints, they simply establish a record for a trial in court and weed out the obvious cases.

The primary purpose of the EEOC is to lighten the work of the courts, not to resolve complaints. If you have a case, take it to court. If not, find a new job and try to be a better employee next time.

I could suggest to my mother renting the house

I could suggest to my mother to make some extra cash by renting this house to people, its still a new house but I do not know how she could get started sense she has never rented a house to anybody, that is what some people do fix up their houses & become landlords & put the house in the paper if they need a place to live but they have to make the income first, then my mother could by a even bigger house then the one she has know. I could suggest this idea to her so she can have alot more cash & to make it easy in these hard times. Like the advice from robert go start your own business & i thought renting this house would be a good business for my mother my mom could become a landlord & my mom could mabye go in real estate, & change this stupid caree she is in know from her former employers abusing her & treating her like crap.

Hearing officers are unfair also to people in umemployment cases, cause they think they have the power to do as the please! they can have evidence right in their face that my mother as to contradict her employers lies & the hearing officer will still deny my mothers umemployment & the employer wins the case.

I first responded to this 'complaint' (which I really don't consider a ripoff) because at one time in my career I was responsible for answering all EEOC cases for a large corporation. I thought I was giving correct advice, based on a somewhat confusing rant.

I have since reached a conclusion regarding trampled-on Kathy and her 4th-grade educated son, Charles: They're BOTH full of SHYT!! Here's an example of sonny-boy's rantings: 'white people do not stand a chance of winning anything unless they are black' Whaaat?

Until somone pointed it out, I didn't realize Charles was the 'author' of the truck driving position. I hope to God he's never driving a truck on the same highway as I. Run for the hills--

Wasn't Charles also the one who was going to sue some dealership/financial institution for about $40,000 over the sale of a 1987 Hundai, or some similar stupidity? Wasn't he also being home-schooled because he was kicked out of a public school? A true example of 'the acorn doesn't fall far from the tree.'

I have one simple request of any trucking company or medical center in their area: Don't hire her unless it's for the 'before' representation of a lobotomy; Don't hire him unless it's for washing the trucks!

When your employers or your employees are jealous of you they will do everything in their power to mess everything up for you because they have less then you, well I have less then some people & you don't seem me going to try to ruin their lives like they are trying to ruin my mothers live, my mother is in college my mother makes good money when she works all the time but when these employers gets jealous they try to make her lose everything my mom has to pay her bills house payment car payment ect., but how can she do it when employers are treating her like crap all the time my mom stands up to them regardless if they are her employers are not my mom does not have to take s**t of from anybody her employers or her employees, who are jealous of her because she makes more money. I own my business, not the Government. They cannot make me hire anyone. They cannot make me keep anyone. I own every job that is available at my business. The reason the employer has all of the authority is simple. The employer OWNS the jobs. The employer is the one with the investment.

I have people working for me. They get paid very well. The average mech in this area gets $15-$17/labor hour. I pay them all a minimum of $22/hour.

If they want to keep getting paid better than anywhere else, they will continue to do as I say. If they want to apply your attitude Charles, they can look for work elsewhere.

I get the feeling you and your mother are given option #2 alot.

Patrick I read your insults about me not knowing how to drive. I am a good driver I have never had a speeding ticket or a reckless driving ticket, nor have I been in a accident my driven record is clean accept I have to put up with rude a*s drivers in my town who don't like it because they don't get their way! which I do the speed limit which is 55 mph & people get pissed. I read where swift has raised their trucks speed to 65 mph, alot better then 60 mph. Who needs schneider they did not accept me because I did not have a prior work history not relating to driving & they made a fuss about that so who needs them! they are a sorry a*s company anyway they have done this to other people besides me can't even be accepted into a training school just because you don't have a 36 month record. Its very hard to get a job today & hold one if schneider does not realize that then they can piss off, they are not a good truck driving company anyways mabye it saved me alot of grief down the road, anyways it does not matter if schneider didn't accept me they are better companies then them so who needs their shitty school I got accepted into a better school after feeling the grief from schneider! so they can piss off. Schneider will not have to worry about me any longer because I will not apply with them anymore.

But it doesn't mean you have a viable case. EEOC gave the Right to Sue letter because they have to give you one if they decide that your claim doesn't have enough merit for them to investigate. Obviously that is the case here. Unless she is lucky enough to find a jury made up of all Aryan Nations or KKK members, she it out of luck as far as litigating it.

Thanks for the heads up on Charles' antics on the Schneider report. After looking at it again after so long, I now remember his earlier rants from before last December. Back then, he was "Charles - 31754, Georgia". Then he became "Charles - Georgetown, Georgia", and finally "Charles - Phenix City, Alabama".

I thought that his posts on the Bush reports were the first time he had been on ROR, but I see now that he goes back way farther than that, to even before I started posting on this site.

Holy cow, what a twisted mind we have here! First, he bitches and moans about Schneider turning down his application because he had no prior experience (which they had every right to do). Then, he continues to b***h and moan about it for almost 2 years! For a job he never got in the first place! Now, if that is not an indication of a demented individual, then I don't know what is.

But wait, it gets even better! Around December, he gets back into posting on the Schneider report again (he must have been getting bored with the Bush reports). There is a point in which he made a series of 9 consecutive posts from 12/27/05 - 2/19/06, made I assume to bump the report back towards the front. Most of which were him just doing more pissing and moaning.

Then he makes another 6 (SIX!) consecutive posts in 2 days! How obsessive can you be? And the funny part is, on 2/20/06 he said he was done with Schneider. He has made 12 posts since then.

So then I make an educated guess, and opened a report about Swift. OMG, Charles has just been accepted (not excepted, Charles) into their training program! Charles will be training to be a truck driver, his lifelong dream!

Hey Charles, IF you ever make it through Swift's training program and receive your CDL and an OTR route, PLEASE PLEASE PLEASE give us your route schedule so that us God fearing safe drivers can make sure we are out of your way when you come through our towns. If your posts are any indication of your (lack of) education level, I would not want to see how you handle yourself on the road in such a large piece of equipment.

God help us all!

By the way, did anyone notice how he is trying to blame his and his mother's lack of employment on GWB? Har har, what a laugh! Take it back to the Bush report Charles!

I wrote this report out of hurt & anger because my moms former employers are trying to stealing my moms new house she has bought a year ago, making her not working so she would be unable to make the monthly house payment so she would be out on the streets & me also my mom has worked hard to get this house & she would be damned if she would let anyone to make her lose it she is currently in college know to try & work her way up to make more money then she is know to better her life everybody has their ups & downs in life & my mother is in her ups & downs know trying to make more money but with her employers trying to lie & trying to steal her house away from her is very low for them to do, my mother will not allow anyone to make her lose this house which her former & past employers have tried to make her lose everything & put her out on the streets. I am trying to find a college education & trying to find a better job so I can help my mother with the bills like in these hardtimes my mother is in my mother as enough money for the house payment & the home bills & car bills & food bills that is the only money she has she has not extra spending money like her employers get to have we almost did not make christmas this past year because she was not working enough, to have christmas for everyone christmas was almost ruined for me & my mother because of these selfish employers who do not care for anybody other then themselves I am angered & how my mothers former & past employers have treated her trying to make her lose everything & put us on the streets my mother will fight to not let this happen, I really do not care at the moment how I make my sentence at the moment I am angry how can employers not have a heart for their employees to do this to them hurt them lie about them & make them lose everything. We all know employers do not care about their employees bill or their kids but they could have a heart to think that their kids could live on the streets with no food or anything to survie on but employers these days do not give a d**n about anybody except their nice homes they get to live inn & their nice new cars they get to drive & do not care how hard they make it for their employes my mothers past employers have made it clear that they do not care finincial problems or how many bills she has to pay & because my mother is out of work collection agencies start hounding her & her creditors but do employers care NO! they do not give a "d**n" about nobody or what their employees go threw my mother will not let no employer make her lose her new house or make her lose everything she will not allow them to ruin her life!.

My mother stated to the EEOC this other employee started a fight with her yelling at her & throwing things at her & her black employer had written my mother up for the incident, which my mother stated she did not cause the agruement my moms former black employer also stated that my mother also agrued with with her supervisor & walked out of a meeting my mother denys this my mother said she was in no meeting when her black employer apporached her to sign the form to where she had written my mom up my mother refused to sign this form.

My mother also found out from another employee that the employer was going around to all the employees asking them to testify agaisnt my mother & make false statements but none of the employees would make statements because they knew the employer was wrong & they knew she was lying about my mother to falsely accuse my mother of wrong doings when my mother has not done any wrong doings or violated any company policy which my mother denys doing.

My mother former employer's are out to get her because blacks are out to get all the white people they can & take all the jobs away from them & force white people to live on the streets or in homeless shelters. Many states are "right to work" states, which means employers do not need a reason to fire employees. And it has become extremely difficult if not impossible to file discrimination claims with the EEOC. The new laws have been slanted in the favor of the employer. You now have to prove your case before the EEOC will even investigate. So do not blame the agency for not taking your case. My advice is keep good records of your complaint. Keep a diary, and document every e-mail, memo, etc. that would characterize abuse by your employer. Secondly, you have only 180 days to file a claim so if the abuse happened beyond that you are up the creek. In other words, you need to complain to congress and not rip off report. Congress needs to change the laws. But, guess what? Who is controlling congress right now? You Bet.
I am quailified to make these comments because I am a black female that is currently being discriminated against by my Asian bosses. Also Unfair Treatmeant is not discrimnation I found out from filing my case. If you have any questions about discrimination check out the EEOC website. It provides all of the information you need.

Michigan is an 'At Will' state, meaning that you are employed at the will of the employer. They don't need a reason to discharge you, although I will admit that most employers are very good about documenting any reasons for discharge (good business practice, protecting the company against lawsuits).

At this point, I'm not sure if the OP has been discriminated against or not, but there seems to be a lot of time and energy going into filing complaints so that she can get unemployment. Wouldn't your time be better spent attempting to find another job? I saw references somewhere in this thread to being a nurse. There are an ABUNDANCE of job openings out there, nurses are in short supply and high demand! If you're a nurse, we couldn't care less if you were purple, green spotted, or have two heads, as long as you're caring for us when we're sick and hurt. I'm not saying that you haven't been discriminated against, what I'm saying is that there are times in your life when it's in your own best interest to just move on. There are many out there that are UNABLE to get a job, which as a nurse shouldn't be an issue for you. These people want to work, yet you would 'rather live on welfare'? What kind of work ethic is that?

In closing, I think the 'discrimination' card is played entirely too often. Funny thing is that the majority of those complaints are coming from caucasians, and unfortunately, most of them are only for the attention, not for any true cause of action. (BTW, I'm white). For those that have spent years being trained in a career such as nursing, check out the job market in Michigan. If you're willing to work, we don't care what color, creed, religion, sexual orientation, or age you are, there's jobs up here where you would be appreciated and needed. Whiners need not apply!

Honestly i do not think you have a fight with this. You may think you were fired because you were white, but i honestly feel you were fired from your lack of work, or something else. If in fact your were discriminated against, then persue your fight, but ive seen this one too many times with whites who want to use this as a cop out to keep a job they in fact dont want to do. Hospitals have the right to fire you on whatever bases they feel they should, and i hardly think you were fired because you are white.

But back on subject since the EEOC (who are currently persuing a case in NY where a catholic school teacher got fired because she got pregnant out of wedlock.) has did not follow your mother's case means to me that that found nothing to persue. It was one word against another. They need proof about the discrimination and that does NOT come from 2 other people being hired. No matter what their race is.

I once got hired and then found out later that I was hired so that the manager could fire a girl whom she was getting many customer complaints about. (Also once when I worked at a store I tore cartilege in my knee on the job and when I was ready to come back the work, my manager called me up and asked when I could come back, I said that weekend and she mentioned, "Oh that's great! I can fire so and so sooner then.")

According to my mother another employee was harassing her on the job & was throwing things at her & the black employer lied saying she walked out of a meeting, to write her up for being in that agrument with the other employee, & accused her of walking out of a meeting my mother said she was never in a meeting & that she was standing in the hall & the black employer asked her to sign the write up form. My mother says she did not start the arguement & that the other employee started the arguement my mother was only defending herself & the black employer was going to get my mother introuble for something she did not do other black employees harass my mother to get her introuble & discharged my mother did not start this fight these black people want to get rid of every white person so that they could have their little CLICK. The black employer told the EEOC that she was discharged for walking out of a meeting but my mother said that when she approached her with the write-up form that it was in no meeting setting also my mother ran into another nurse & the black employer was going to have everyone make false statements about my mother to be withnesses that withness the supposedly bizarre behavior my mother was doing but none of the other employees inculding black employees would not make any statements saying that they saw anything because it was not true. This is the same kind of crap they told the EEOC it was noting much but a waste of paper they had nobody to back up their lies that the employer told the EEOC. Nobody would sign the form agreeing to anything that they withness my mother doing or what the black employer accused my mom of doing that is DEFAMANTION OF CHARACTER, & my mother can sue her former black employer for damanges the EEOC is a waste of time they had evidence looking them in their face & they lied saying their is no evidence the people were black who were hired after the black employer discharged my mother that is evidence enough, to prove that is was unlawful discrimination & wrongful termination & my mother can prove that she was discrimanted agaisnt & they will be legal action agaisnt this employer. Hiring a black person to replace a white person is not necessarily discrimination. I grew up in Spokane Washington, a town that is almost entirely white. If a black woman was fired, her replacement would probably be white. Is this discrimination? No. Its demographics. Same thing with Berkeley, a town that is predominately black. If I was fired from my job, a black person would probably replace me. Discrimination? Again, no. Demographics. It is only discrimination if she was fired because she is white and since you say this has happened many times, I doubt that is it. Maybe she just doesn't do a good job. Oh, and I bet you would rather be on welfare than work for a black person. THAT is discrimination. Grow up, get a job, and do it well, then she wont have to worry about it.

I would like to expand on and explain this very misleading terminology of "Right to Work"

Right to Work laws, DO NOT give any employee any more rights than in a non right to work state.

Right to Work is an anti-union thing. It has nothing to do with your right to get or keep a job.

States who have strong union representation and union protection are not right to work states. Right to work states are mostly the southern,midwest, and southwest states where there are very few, if any unions.

The term itself came from the law that prohibits a union from shutting down a place of business, thus allowing scab workers to legally cross a picket line. Thus, they have a right to work.

And in addition to the above, the same laws prohibit a closed shop, or mandatory union membership to be allowed employment at any place of business. You have the right to work, even if you do not join the union.

This is what "Right to Work" is all about. It is an Anti-Union thing. Nothing more.

With very few exceptions, the employer can terminate employment for ANY reason. Now, on to the fun:

"My mother will sue her former employer for damanges & for the suffering..." What damages? What suffering was caused by the employer. She has lost her case, therefore the termination was considered lawful.

"...for damanges to my mothers credit file we all know employers do not care about their employees bills or house payments but an employee can sue an employer for wrongful terminantion for no having the money to pay their bills & having their home foreclosed threw no fault of their own." It is not the employer's responsibility to make sure the employee pays their own bills. And as so far been the case, the termination was done lawfully and properly, so again, it IS through the fault of the employee that he/she has no job.

"Employers who abuse their power should suffer the consequences for the suffering they put their..." The employer can do anything they want, as long as they are committing no crimes. Firing a bad employee, or a good one, is NOT against the law. The jobs belong to the employer, not the employee.

"..for your former employer to tell your new employer why you were discharged if your former employer breaks this law you can sue them for damanges..." Wrong again Charles. It is perfectly legal for a former employer to tell factual information to anyone who requests this information. The former employer is not allowed to tell lies. If someone is fired for theft, and is proven in court to be a thief, the former employer is allowed to tell the next sucker all about it. It is also allowable to tell the requesting party if the employee had any other problems that violated company policies. If there is a dress code, and the employee refused to follow it, the former employer can relate that information to the next employer. There are NO laws prohibitting someone from telling the truth. While most companies don't give out any information, there is no law prohibitting it.

Also Charles, let me clarify something that seems to be very difficult for some Americans to grasp. Unless you are a member of a Union, you can be fired for any reason whatsoever, in any of the 50 states. The only time the termination would be unlawful, would be if you are a Union member, in a Union shop, and not have violated any written policies. (Just so the brain dead out there get it straight, obviously firing someone for committing a criminal act, when no such act was perpetrated, IS illegal. Since that does not happen, I only wrote that to satisfy the mindless droning of Charles.) If you are a member of a Union, you can still be fired. It simply requires the employer to notify the Union as to what policy the employee violated.

I have been hired to run other shops. The first thing I ever did was fire people. Figure out who is worth keeping, and get rid of the rest. It was as easy as telling them to leave and don't bother coming back. The only thing the employer is required to do in the case of a "termination without cause" is be honest about it when the employee applies for Unemployment Benefits. Beyond that, the jobs still belong to the employer, and can be filled or eliminated at the sole discretion of the employer.

If you don't like them apples, invest your own money into a business and see how much fun it is.

Why does everyone assume they have the right to a job? I don't know about Alabama, but here in Alaska we don't have the right to work. Same with my previous residence in Washington. These states (along with the majority of all states) are called right to work states. I know, the name is decieving. What it means is you can quit, or be fired anytime for any reason. Actually, you don't even have to have a reason. And your employer doesn't need a reason to fire you. They just can.

Now, they cannot fire you because of your race, religion, sexual orientation, age (unless the job requires a certain age), ect ect.

Why did your former employer say you were being fired? Do you have evidence that they lied? Probably not. You probably got fired for incompetence and then cried discrimination. I am white, I know white people do get discriminated against, as do black people, asian people and all people. But its not discrimination just because two black people were hired when you were fired. Maybe they just HAPPEN to be black and the most qualified.

Oh and she doesn't have a case for "damage to her credit file" She MAY have a case for wrongful termination, if she can PROVE she was wrongfully terminated. Oh and a denial from the EEOC will make it really hard to prove in court, because your former employer will bring that up. Give up, and get a new job. Quit tying up our legal system with worthless, unfounded claims.

My mother will sue her former employer for damanges & for the suffering, for damanges to my mothers credit file we all know employers do not care about their employees bills or house payments but an employee can sue an employer for wrongful terminantion for no having the money to pay their bills & having their home foreclosed threw no fault of their own. I am filing this report on behalf off my mother because I am tired of how the employers she works for treats her my mom does nothing to anybody at her work they always pick on her because she is white or if the employer is not black they still pick on her anyways, her employers lie about her all the time & wrongfully terminate her they have lied to the unemployment office & provided false withnesses so the hearing officer ruled agaisnt her & infavor of the employer. Employers do lie about employees whom they don't like this happens all across the united states & they always get away with it its time for white people to stand up agaisnt these racist black people employers because this is a total abuse of power I have to have a black employer if this is the way they treat white people black people need to be deported back to africa because all their intentions is to do evil to white people & harm white people these employers have wronged my mother & my mother is tired of putting up with it & tired of putting up with lies from the EEOC even if you have evidence of discrimination they will still rule in favor of the employer & dismiss the case, black people cry discrimination all the time like the black people from hurricane katrina no wonder the government did not act in a hurry because of the way they were acting black people do not need to yell discrimination because they do it worse to white people today in 2006 so why have a EEOC if they are not going to enforce the laws. They are some black people who my mom are friends with thats because some black people have put the past behind them & forgave the white people. but the rest of the childish black people still hold grudges agaisnt white people so that is why if you have a black employer they will fire all the white people who have done nothing wrong & keep all the black people working in 2006 they will be a civil war between whites & blacks because white people are sick of this s**t these black people pushing them around a person can only take so much they can take it for years on end & then everything explodes!!!! its time to show black employers or white employers that they will be held accountable for how they lie about employees.

You do not know the situation I am in so you can back off with your personal attacks to my report!. The LAW!!! says if you have been discriminated agaisnt you have a right to file a charge of DISCRIMINATION!!!!!!, but you are to dumb to see that why have a EEOC if they are not going to enforce the laws that are going to protect us I am not the only one the EEOC has done this to they rule agaisnt all the white people & all the black people win these suits, the EEOC needs to be investagated for its corruption. I do my job when I am working they are employers who do LIE about their employees if they do not like them & want to get rid of them the EEOC found no reason for the discrimination that FACT is I was discharged & my black employer hired to black young females so if that is not evidence I do not know what is, even if you have evidence they will say you have not been discriminated agaist to rule in favor of the employer. Its time we stop letting all the black people run everything because they are NOT!!!!! going to get rid of the white people, black people still live in the past & want to pay all the white people back today by taking all the jobs away from them, the EEOC does not stick up for the white people heaven forbid if a white employer discriminates agaisnt a black employee the black person will win as i have seen all threw the years & never a white person wins, so Sherri if you are looking to attack me go somewhere else to do it if you'er just looking to attack someone because I will not have it!. The, EEOC does not enforce the discrimination LAWS because my employer is black & the people who run the EEOC are black & no white person has a chance of winning If the EEOC cannot be fair to everybody then they need to be shut down!.

I am not going to let the EEOC get away this. I have always been discriminated agaisnt In my feild of nursing I have lost jobs because of this in the past this is my first discrimination complaint & the EEOC ruled agaisnt me because I am a white female. The, people who are working in the EEOC are black & white people do not stand a chance of winning anything unless they are black I am going to take this all the way to the top because I do believe I was discriminated agaisnt because I am white because my black employer discharged me & hired to black younger females & lied to the unemployment office about why I was discharged & lied to the EEOC & the EEOC ruled in favor, of my former employer. The EEOC is not fair to white people who file discrimination complaints I, have always been abused by black people & been harassed by black people in my work places when you sucpect you have been discriminated, agaisnt you have a right to file a charge but then the EEOC does not do anything to enforce the laws for discrimination complaints. I am angered by the way the EEOC has treated me & I will fight this their is evidence of discrimination because the people my employer hired to black young nurses that right their is evidence of discrimination, I will not give up this easy the battle has just begun!.

You were not helped because you did not have a cause of action against the employer. If you exhibited the same attitude and ignorance at work that you are exhibiting now, I can see why you were let go. You will have to pay back the Unemployment payments (plus penalties and interest) after your "applied" (the word is APPEALED) case is dismissed.

As someone born and raised in the south, you are really and truly an embarassment to most of us, as well as yourself. Please stop playing the "blame game"..it is just as annoying when the race card is played by whites as it is by minorities.

If you feel very certain you have been discriminated against because of your race, then by all means file in the federal court. The same people will not be hearing your case as in the first instance.
