My wife & I contacted First American Home Buyers Protection Corp a.k.a First American Home Warranty back in April to take care of our Air Conditioner problem. They sent out a vendor, North Star Mechanical - which is located at 2714 W. Kingsley Rd, Suite F in Garland, TX 75041 to review and make appropriate repairs. 

The service technician, S Brown, stated that there was an issue with the condenser coil and the compressor. He explained to us verbally and in the work order that it would take 2-3 weeks for the replacement parts to come in to make the necessary repairs. It is now May 23, 2012 and I have received a call from Diane, a customer service agent from North Star explaining to me that they now do not have an estimated arrival time for the part...however they can fully replace our system for the cost of 1100.00 dollars.   This is completely unacceptable. 

From there, I contacted First American in effort to resolve our problem.  I made appropriate suggestions, reviewed the contract with them & they made suggestions to resolve, one of which was to "cash me out" and stated that I could resolve the problem on my own. 

The contract reflected that they would replace the system if the condenser was determined as needed to be replaced... they are claiming that since the parts are replaceable, they have no control over when they arrive.  This is garbage!  This is has been going on now for 4 weeks! 

Example: 

If the Company determines that a package unit or the condenser of an air conditioning or heat pump split system must be replaced, the Company will replace the unit with a unit that meets current federal, state and/or local government efficiency standards. 

When replacing the condenser of an air conditioning or heat pump split system, the Company will replace any covered component as well as modify the plenum, indoor electrical, air handling transition, and duct connections as necessary to maintain compatibility and operating efficiency as required by the manufacturer of the replacement unit, including the installation of thermostatic valves. 

The Company will cover fees associated with the use of cranes or other lifting equipment required to service rooftop heating or air conditioning units. 

I have been a customer and paid my payments on a timely basis - this is an absolute rip-off and scam to avoid the goods and services as promised by First American, as well as North Star Mechanical, who has been contracted to make good on repairs.

Read your contract, don't pick out pieces you like

Take into account the entire contract not just the pieces that suit your desires. Your contract also stipulates the warranty company makes the final decision on whether to repair or replace a covered system.

They are completely living up to the contract but you refuse to see that. You see only what you want to see. Unless FA has decided to replace a covered system in your home, none of those contract excerpt even come into play which makes your argument look quite foolish.
