 A 2005 Explorer Sport Trac was purchased in November 2006 at Gene Evans Ford,  This was vechile number three purchased to encounter Late Fees from the Auto maker.  Letters and Calls were made to try to get the problem corrected.  The loan was a 80 month loan that we asked the auto maker to correct the errors in the account.  The Auto maker was evasive to say the least.  Which forced us to try governing agencies to assist.  We finally recieved a payment ledger to review and see what lead to the problem.  What we discovered we want to shared with the world!  Late Fees were being added to the account when we were not late 28 times we alerted Ford.  With the proof and evidence to be told it was being investigated.  We even recieved a letter which stated it was being corrected to find that was not the case.  Our pay by date was the 30th of each month my husband and I had a contract that clearly stated at signing, we were told if not paid by the 30th we had 10 additional days before fees applied.   We sent the contract hilighted and circled and underlined the 28 Late Fees Ford charged us to prove our case and their error.  What happened next was this, Ford sent us a letter of Intent of Repossesion!  We have gone back and forth with this Automaker we have since paid all eighty payments.  To date the Auto maker is still trying to take the vechile since the evidence was sent and the Auto maker Refusal to do the right thing,  This is forcing my spouse to even consider Bankruptcy because Ford refuses to correct this huge error.  DO NOT FINANCE WITH FORD BUYER BEWARE!  We merely want the Title we are due and a STOP to Ford Financing and Bullying! Consumers do have rights and Bankruptcy should not be the only way.

If you really wanted to share with the world you would scan and post all of your proof(of course blocking out any personal information).

Because while you may be telling the 100% truth.  There are a few odities.  First, of I can never recall having a payment due on the 29th,30th, or 31st.  The reason is that there is too much ambiguity when it comes to February.  For example in your case if it is due on the 28th does that now mean the 10 days start from the 28th, March 2nd or 1st(in a leap year).  This is why lenders generally make the due dates between the 1st and 28th of the month.

Next, what are you counting as 10 days?  Is that 10 Calender days or are you taking 10 Days as meaning the 10th of the next month?  Are you counting the day you send it or they day they receive it?  This is important because in just about every case they mean the day they receive it.  After all you could always say "Well I mailed it out, it is not my fault it took another 5-10 days".

A telling factor in this is also why didn't the government help you with your "issue"? 

Then we have your 28 "late" payments.   Okay if your payment is DUE on the 30th, if you pay it one day after it is LATE.  Now, you have a period of time in that 10 day period you are still late, but they won't assess any other FEES.  But what did it say about INTEREST?

Then finally, even IF you were late 28 times.  The average late payment is 5%, even taking a $500/month payment that is $25.  So you would be looking at $700.  If you are really saying that because of $700 your wife is considering declaring Bankruptcy, even if it was $1000 or $2000 that Ford is looking for there are things you are definatly leaving out. 

As a side note...if there is any other RipOff here it is your loan.  If you had to go to an 80..that is over 6 1/2 years that means you were problably overextended and were buying a car well over what you could legitimatly afford.  Which may be a primary reason why you are trying to play with these "10 days".
