A little over a year ago, I got into buying domain names. I purchased over 100 domain names within a 3 months time. After purchasing about about 20 of them, and a handful more of them ready to purchase, I decided to call godaddy to make sure of a few things.
I contacted customer service because I had 9 names I wanted to register and wanted to make sure that all the names were on a "Non Auto-Renew" because I had a problem with a subscription being auto-renewed several times with a different company 6 months prior.
The Gentleman I talked to was happy to assist me at godaddy. I informed him that after I had register the 9 names I wanted to make sure that all the domains I purchased prior to that day, and ones I purchased in the future were ALL on a non auto renew.
I explained to him the problem I had 6 months earlier, with a company other than his, charging my card repeatedly even after calling their customer service dept. He put me on hold for a reasonable amount of time and came back and said..."Mr. xxxxxx, I made the changes to your domains that you requested, and made sure the names you just registered with us are all on a non auto-renew status."
I thanked him and asked if the domains I buy in the future will be on a non-renew status. Again he put me on hold and after returning, said "you are all set" To which I replied "Ok, so the domains I currently own and the ones I buy in the future will expire and drop off if not acted upon by me? Is this correct?" His response was "Absolutely"
I said great. Because you might recall earlier in the conversation I mentioned having problems with a company that kept hi-jacking my card by renewing a subscription repeatedly, even renewing it twice in one month. His response was "I don't what company did that to you but here at godaddy, we are a very reputable company and would never do anything like that"
I thanked him, hung up the phone and felt confident that my account was in good hands. Fast forward a year later. My wife and I had just come back home from an extended cruise. It was a Wednesday and my wife called me at work and told me that there were all sorts of charges from godaddy on an account we have for just internet related purchases.
After logging onto the online banking service I had with this bank, I discovered, much to my horror that almost 60 domain names had been renewed at a price of $9.78 each. There were over $560.00 that had been charged to my account because that's all the money that was in the account. It was at that point overdrawn. godaddy kept charging renewals to the account at 9.78 each.
Each renewal they charged on my account caused a 30.00 overdraft fee with my bank. Approx $540.00 in overdraft fees.
Ok, So I called dodaddy's customer service dept. and explained to them what happened as best I could. The girl that took the call seemed very confused and kept explaining to me that "I needed to take the auto-renew off of my account." I explained to her the phone call I made to her company a year earlier. She said again, "Sir you need to take the auto-renew off of your account" "I said Ma'am, you are not listening...I talked to a salesperson from your company and he assured me that the auto renew was off and that I had nothing else to do as far as renewing my names. "That if I did not physically pick up the phone and renew them, they would would be rendered inactive and drop off."
Flustered, She put me on hold to see what was going on with my account. When she came back she informed me that some of the domains were on auto renew and some were not. I said that's impossible because I had not done anything to my account and the person I talked to assured me they were all on non-renew. I was not prepared for what came out of her mouth next. She said "Sir some salespeople will and some salespeople don't put non-renew on customer's accounts, It's really the LUCK OF THE DRAW"
After catching my breath, I asked "So you are telling me it's the luck of the draw when dealing with your company as to weather I get ripped off or not?!" "It's the luck of the draw if I get a salesperson that actually does what I ask of them?!" She interupted me and said "Sir, I did not say luck of the draw." I said "Yes, yes you did say exactly and I quote "Luck of the draw" I have it on tape I have been taping this conversation and when I send a copy of it to your supervisor it will clearly show that you did in fact say those exact words."
She refused to talk with me after that and no matter how much I tried would not stay on the phone with me. I was put on hold and a supervisor came on the phone and said that he did not authorize me to tape the conversation. I said thank you and informed him that weather or not he or anyone from his company authorized the taping of the conversation that it had no bearing on weather or not it would be taped. It's legal in Texas to tape "one-party" conversations.
He then explained to me that he would have to replay the tape of what transpired and have his supervisor call me back. I explained to him that would be fine but I would need to actually call him back because I would be recording the conversation. He said ok and hung up.
I never heard back from anyone at godaddy and so I called them 2 days later and then the whole thing started over again from the point where I was with the first lady but we got as far as the rep on the phone wanting me to select the screen names I have left that I wanted to renew and he said we would "Go from there" Being a little gun shy at this point, I did not do this because I wasn't sure if I was being tricked into doing something I sould not do. Anyway, That's where it stands now, I have no idea how I should proceed so any help would be greatly appreciated.
I am not looking to sue anyone or file a lawsuit, I would just simply like them to return the money to me that they charged on my credit card and the bank overdraft fees. Realistically, I'm sure, even though, they did the wrong thing, I know that getting companies to reimburse you of expenses you incurr through their own neglect typically does not happen. But I think they should have to pay for the damages that they caused... nothing more nothing less.
This isn't just lip service, I would be TRULY greatful for any sound advice anyone has. Thank you so much.

review your state law again. What I found in: CIVIL PRACTICE & REMEDIES CODE
CHAPTER 123. INTERCEPTION OF COMMUNICATION by using Tx state law as a search, indicates that unless you got godaddy.com's approval, the tape you made is illegal.
