I am another homeowner scammed by Homecomings Financial. My story is very similar to the thousands of complaints filed already against this financial corporation. My original loan through our builer was with Pinnacle Direct... after a few months was sold to Homecomings. We love our dream home....we paid every month on time and made additional payments on the principal.

Back in October, 2005 Homecomings sent me a refund check or 4,200 for overage in escrow. I called and questioned them....Homecomings assurred me that was correct. Two months later without notice they increased my payment without notice by $1000 per month claiming I did not have enough in escrow??? Does anyone in their escrow department know what they are doing??? They claimed they paid our Orange County Taxes and our homeowners insurance and now we owe them over 9,000???? Where is the money we paid in escrow to Pinnacle???? I called Pinnacle Direct and they claim when they sold the loan all our escrow monies went to Homecomings Financial. Where is the money from Pinnacle and where is the money from the mortgage payments we paid to Homecomings for that year??? How could we possibly owe this amount??? We filed a complaint with Homecomings....demanded an audit...they investigated...told us to wait for the answer than slapped us with a late fee because we did'nt pay on time in January due to this confusion. We paid two days late. WOW!

My wife and I finally had enough and THANK GOD we refinanced and got out from underneath them with a very good mortgage company who will not sell our loan. However, not a clean break!! They charged us $35,000 in settlement charges. They charged unpaid late fees and we paid the late fee, prepayment fees that were not pro rated, statement/demand fee, fax fees, Interest for two days past closing, and finally Escrow Advance??? When will a Class Action Suit begin....please add us to the list. I am so frustrated with the crooks in Texas!!!! Are they related to Enron????

your situation.

I would say 95% of the people on Rip-Off Report that are complaining about mortgage companies are doing so because of their OWN IGNORANCE. However, it seems like you got screwed, and it's no fault of your own.

But I do have a question:

The "settlement fees" that you spoke of...who charged them? Were they ALL from Homecomings?

Because first of all - the prepayment penalty is something that you KNEW ABOUT. It was in the papers that you signed with Pinnacle. But if the majority of those fees were charged by the NEW mortgage company...well then, sorry to say but you ot screwed again (depending on your loan amount, that is). In other words, if you loan was for 500K, you paid 7% to close, which is high as hell. If your loan was for 1mil, then you paid 3.5% which - with a prepayment penalty, is standard.
