I received a recorded message from Merchants Credit Guide Company at 9pm at night stating it wasnt a sales call that it was an urgent matter. I called them back and fist they wanted the last four digits of my social security number. I told them no I wouldnt release that information to them.

Then they claimed that they were trying to collect a debt from 1994. A debt that I was not aware of and might I add never reflected my credit report with Experian, Equifax, or Trans Union. I have never recieved anything in writing about this debt. When I asked them to fax me a copy of the aleeged bill they told me they cant do that. So I asked if they could send something to me in writing. I found it quite odd that all of a sudden they are calling for a bill over 10 years ago and I'm not even sure if this is a debt that I owe. If it is I would be more than happy to pay it A.S.A.P.

Contact the Attorney General of your state in writing.
Send a letter to Merchants Credit Guide, certified, return receipt. Tell them that you are unaware of any such debt, ask them to send the name of the company you supposedly owe this money to, along with the date and account numbers and your signature on supposed debt, associated with it.

Also, contact the FTC, and let them know about thses people.

Please check your states Statute of Limitations. Most states are 3-7 years. If the SOL has expired, these scumbags cannot win a suit in court against you. Article 2.6 (unfair collection Practices)says "it is a violation to attempt to collect a claim that is too old to be enforceable". If they take you to court, show up tell the judge it the SOL has expired and he will dismiss the case. They won't though. Send them a Cease and Desist letter telling them you don't owe the debt and in any case the SOL has expired.

I also got a dunning letter from this company. Our SOL is 4 years. They are not in my credit reports so I sent them a cease and desist letter by certified mail as soon as I got their letter. By law they are not to call you.

Read up on the Federal debt collection practice act and your right. And read about fair debt collection laws in your state. There are some good websites on sample letters to send them. Never admit you owe or start paying anything until you are sure. Because the SOL will start all over again!!! Please read up first and don't talk to them over the phone!

The complain to your state attorney's office about these people. They are scumbags.
