nfcu is guilty of violating banking and fair debt collections act regulations.

Following a medical problem I fell behind on a loan I have with nfcu. My problem, I know. But what nfcu did was reprehensible and illegal. Without any legal authority or moral conciience they sought out my wife, and suspended her online bank privileges, denying het the ability to manage her account. She is not a party to the loan or account on which it is held, and is being blackmailed by nfcu to force me to give them money.

She cannot manage her account, nor pay on her credit card she has with them without spending additional money above and beyond the general population of credit union members. Service fees are now being assesed to her acount because we live 8o miles away from the nearest institution and have no way of telling what her balances are.

nfcu is directly violating her civil and legal rights.

US and international banking regulations also define violations which they are guilty of:

corrupt and fraudulent practices: whereas:

they are using "(i) coercive practice, which is, offering, giving, recieving, or soliciting, directly or indirectly, anything of value to improperly influence the actions of another party; (the collection agent is being paid to violate her rights and the regulations of the fair debt collections act).

(ii) fraudulent practice, which is any action, including misrepresentation, to obtain a financial or other benfit, or avoid an obligation by deception. (they are avoiding providing the services to which she contracted for when opening her account).

(iii) COERCIVE PRACTICE, which is impairing or harmoing, or threatening to impair or harm, directly or indirectly, any party or persons closely related to a party, to IMPROPERLY influence the actions of that party; (nfcu has threatened to finacially harm my wife in an effort to effect me paying on a separate account)

(iv) COLLUSIVE PRACTICE, which is the arrangement between two or more entities, without the knowlege , but designed to improperly influence the actions of another party; Whereby nfcu credit collections, and nfcu personal banking, both separate entities, conspired without my wife's or my personal knowledge, to influence loan payments on my part).


YEAH...nfcu , they are the real serious bad guys ...threatening, blackmailing, and non-communicated sanctions agains innocent individuals.

This is next thing to breaking knee caps. NFCU and it's agents are giving the impression that they are merely are a bunch of thugs content on violating whichever moral and legal precident they have to in the sole effort to make money.

Beware, they will use any means possible, legal or ILlegal to take your money, whether youowe it to them or not.

Regardless of what all you "proper and snooty" souls had to say, The OCC has upheld my complaint against NFCU and NFCU has acknowledged by saying what they did to my wife's account they did in error.

And to answer the last question posted. no my name is NOT on my wifes account, so she was an innocent victim.

For any of those who criticized our right to complain....you people are on the wrong team for pete's sake. We are banded to gether as a country to fight the practices I was complaining about. What the heck are you people or your spouses doing in our military anyways.

Stick your preaching about indebitness where the sun doesn't shine, and realize the matter was my wife being victimized by a large company. You should all be ashamed of yoursevles if you believe I intentionally hurt my wife or that she deserves to be penalized for my bad luck. I myself am ashamed to be grouped together with any of you as a military member. Defending the credit union was cowardly..plain and simple!

Here's hoping that all the snobs here also sustain a life and death situation that causes you to suffer hard finacial times. Thanks for reminding me that there is as much scum in the military as in any walk of life. Now you people with the negative criticism can go complain that those killed in combat owe people money too.....I wouldn't put it past you!

Question on this situation

I understand that you say the loan is in your name and that your wife's name is not on it. My question is this...is your name on the account that you are having trouble with? If so it, seems what is happening is called "right of offset". If you fall behind on a loan or cause an account to go into the negative, the bank has the right to offset that debt by taking the money owed from any account at that bank or credit union which has your name on it.
It seems extreme that the credit union would cancel the online banking. Sounds like the account has been closed or restricted due to this situation.
Yes I do work for a financial institution, but not this credit union. Just trying to help with understanding.

regarding personal property statement on rebuttal

As far as your rebutal asking if I live in a common property state...That is complete and utter B.S.!!! First off. the BANK is not in my state. Second off...I didn't do S--t to my wife and there was no judgement or justification to violate her civil rights or for them to engage in criminal corruption by violating the fair debt collection act. I find your statement that suggests I have wronged my wife and that the bank is the victim way out of linel. Should I be penalized for having my heart attack? Should I be penalized for my employer firing me because I had a Heart attack? Should I be further penalized be cause prospective employers wouyld rather hhire people who didn't have heart attacks, even though I am now stronger than most people my age? Keep in mind that my condition was misdiagnosed a month earlier by a lazy and incompetent emergency room department at a Veterans Hospital.

I am absolutely furious that with all that has happened to my family, and what this inevitably will do to my credit rating, that ANYONE would assume that the 'little people' were wrong. THANK GOD my wife has remained right beside me, and knew that I would remain her hero. If I had did so much damage to my wife as you put it, then why is she, the person with an unequaled view and perspective of the situation, not asking stupid questions like you are.

Community state or not there has to be a judgement for there to be a determination of whether our properties sharre commonality.

this was a clear case where the agent working for the collection department overstepped his boundaries and abused his or her power to effect the parameters of the online banking system.

Oh, by the way, the OCC felt the same way and my wife's rights were upheld, the bank had overstepped their power, authority, and she now has had her priviledges restored.


For anyone else who has seen this report, and thinks that their rights have been violated....act first, then see what happens. If everytime someone feels wrong, they are afraid to complain, what good is this forum anyways. What good is the OCC, Consumer rights advocacies, and even our courts for that matter.

Thanks for the (uh...yeah) advice, but I preferred not to lay down belly up and let a large bank stepp all over my wifes rights. Shame on you for assuming a bank automatically must be in the right. The bully lost. I was right. My wife was a victim. Thank god I was here to protect her and go to bat for her instead of you!

FIGHT, god-d**n-it, if you think you've been wronged! Don't be afraid of those Goliaths.

This is totally crazy! NFCU gives any deliquent mbrs plently of options to pay their bills. It is the responsibilty of the deliquent mbr to make payments or arrangments on their accounts. They offer extensions as well as free personal fin management programs to help assist you with your accnts. ...In response to the comment about they are out to make money...A credit union is nonprofit and is owned by it's mbrs...and being a mbr/owner, I am not to happy that NFCU has to waste their time and money with irresponsible mbrs that can't make their payment on time... Your are causing interset rates to go up for other mbrs..word of advice...pay your bills..The only THUGS are deliquent mbrs running from their responsbilities

If you do, the debt is her responsibility as well as yours. And, sorry Dixiedooh, if you didn't want your wife to be hurt, you wouldn't have done this to her. This wasn't the doings of the credit union that caused your wife's accounts to be penalized.

And no, I don't work for the credit union.
