The credit card bill NFCU is harrasing me about is my husband, because of them soon to be ex. They start calling at 8 am and end at 8:45 every day, about 3 to 9 times a day. They spoke to my disable minor kid telling to take the message was "he needs to pay is bill he is a theft". They have spoke to my kid several times. In addition they will call and will not responded and then they hang up. I have complainted to them in person. I have been told that they have the right to do so and to continue, I was informed that they do not have to follow the Privacy Act or The Fair Debt Collection Practices Act. Know they have call my place of work almost costing me my job. After I told them to stop the person called 2 more consecutive times, "This is NOT my bill and I was NOT on his accounts".

Thanks for you comments but I know that FDCPA, does not apply to original creditors. Laws have been created and amendments done for several reasons, but also to stop abuses. The Fair Credit Act, from what I can read (15 USC 1692. 802 section a, Congressional Finding and Statements of purpose. Abuse debt collection practices contribute to the number of personal bankruptcy, to marital instability, to the loss of jobs and to invasions of individuals privacy. Because of the current economical situation of the Country, this abuse is happening with original creditors. Fair Credit Act should be amended and include Credit Unions and Original creditors. The Fair Credit Act does not say that people should not pay their bills, but they are referring to abuse, speaking to your child is abuse, calling up to 9 times daily is abuse, calling someone a thief is abuse, callings on Sundays is abuse, calling at someone else work of place whom is not the debtors is more than abuse, it is morally, ethically abusive, and wrong, it is totally disregard for someone else well being. Regardless if a institution is an original creditor abuse and harassment should not be allowed.
I would like to find out to how many people Navy Federal Credit Union have treated in this manner, and maybe if it is a lot and we are many, then something has to change. Once again this is NOT MY DEBIT.
PS What happened to the privacy act does it also not apply to original creditors?

They can not violate the Fair Debt Collection Practices Act(FDCPA) because the FDCPA does not apply to Original Creditors(which NFCU is). Unless there is some specific VA law for "Privacy" they are not in violation for disclosing information about your ex's account.
The good news(if you can call it that) is that once they Charge-Off the account they will sell the account to a Collection Agency. At that time the FDCPA will apply and you can legally keep them from calling or contacting you.
