My mother is very ill and I have power of attorney for her affairs. I forwarded a copy of the power of attorney to most of her known creditors. Instead of dealing with me the creditors turned the account over to a collection agency. On 7/21/03, there was a nasty threatening message on the voice mail from a Jerry Williams, his phone number and the threat, you'd better call if you know what is good for you.

I ignored the message and I decided to let him call me again and he did and left the same type of message the next day. Again, I decided to let Jerry Williams call and this time I was home and I answered the phone. Jerry Williams started yelling at me and calling me by my mother's name. I told him to stop yelling at me and that I am not my mother and who in the hell are you and who are you representing? Jerry asked who are you and I do not want to put your mother's business in the streets.

I told him that I have power of attorney and that you'd better deal with me and you'd better tone down your attitude. He started yelling and I told him that either he'd answer my questions or hang up the phone. Jerry went on to say that the apple does not fall far from the tree. I said, you have never talked to my mother and you'd better watch your mouth, because you are pushing the envelope to no return.

Jerry said that he will call anytime he wants and that he'll do anything he well please. I said we'll see. Again, I asked Jerry who was he representing, he refused and said Ford Motor Credit, which I know is a lie. I contacted Ford Motor Credit and I talked to Gail and she was not pleased that this so-called law firm would use the corporate trademark name in a illegal act. Gail said that she is reporting this to upper management and Ford Motor Company's legal department. I have already forwarded the information to Ford's Customer Service Department and the Legal Department in Dearborn, MI.

On July 24, 2003 at exactly 7:54 am, Jerry Williams started calling and hanging up. He called five times and at 7:57 am, I answered the phone on the sixth ring. I said, what is it now b***h! Jerry said, excuse me. I said that you have repeatedly violated the Federal Debt Collection Practices Act and it is not even 8:00 am.

Since then, I have received 21 phone calls from Jerry, he just calls and let it ring and hang up. sometimes, he speed dials.

we too have been harassed by Direct Merchants Bank

We got a loan and paid Direct Merchants off, or so we thought...we paid them 3888.88 and then we got a bill for another 140.00 the 3888.88 was the payoff they gave our mortgage company for the consolidation......We sent a copy of the check and the statement they had given our mortgage compnay and so we thought it was resolved.until this week, they are calling about a bill from 1998., a collection agency is doing this for them..I had to go thru all my paper work and pull out all the paperwork to prove to the colleciton agency again, that we paid them off...

We have had so much trouble with DM bank all the years we had to card...we too were charged late fees and then over the limit fees on this card....and I sent in the payment 2 weeks ahead of time..I think that anyone who applies for a card with Direct Merchants should beware..I feel that it is almost like a loan shark company...
So now again, we are getting calls from a collcetion agency after 6 years...
BEWARE OF CREDIT CARDS...

Thank you for your suggestion. I have reported this abuse to the FTC and so far according to P. Scott Lowery, they will watch their employees more closely. My mother recently passed away. The lawfirm sent a process server to my home at 5:30 am. I told him that my mother passed away and that he'd never, ever come to my home again or he will regret it. He came back later that afternoon, banging on the windows and door, calling my mother's name. I opened the door and I hit him between the eyes with a crowbar, breaking his nose and both cheekbones.

He went to the police and the police told him, sorry, the debtor's daughter told you that she was dead and you came back later on to harass the family, you knew better. Better luck next time.

Legal action against the law firm might be appropriate

The federal Fair Debt Collection Practices Act has sever remedies that might be available to your mother. In addition to actual damages, the court can award a penalty of up to $1000 per violation and attorney's fees. The actual damages can include emotional distress damages.

There may be another agency in your state that also has jurisdiction over illegal debt collection activities and you might consider contacting the Federal Trade Commission as well.

Here is the update on this so-called law firm that violated the FDCPA regarding my mother's account. After filing the complaint with the Lawyer Disciplinary Committee, here is what Scott Lowery's firm stated.

From now on, this firm will do a better job of supervising all employees and oversee the training of all employees in debt collection.

My response to this firm. Never, Never, Never, ever contact this household again for any reason. You are not getting one red cent and do not look for it.
