I found out about Palisade Colletion when I received a copy of my credit report in Nov 2006. There in my otherwiase perfect report was an old AT&T cell phone bill that I thought had been taken care of in 2003! In June 2003 my purse was stolen. Someone opened two different cell phone accounts. I was contacted by both of them at home and settled one of them quickly, even receiving a letter from them agreeing it was identity theft. I thought my AT&T issue was settled as well with NRS Associates as I sent them the police report and letter from the other cell phone company. But suddenly Palisades Collections appeared for the same $1,492 as in 2003. I called Palisades and was told to contact their lawyers Wollpoff & Abramson, LLP. When I called them I found that there had been a judgement agaist me in court. I then had to go to Boston Municipal Court to get the judgement vacated using vacation time from work. A Wolpoff & Abramson attorney, Rhonda Levey, spoke with me and took copies of my proof of identity, verification of address at the time the debt was incurred and police report. She agreed to vacate the judgement and another court date swas et for March 20, 2007. She said I would probably get a letter from Palisades and not have to go as it was pretty clear the debt was not mine but she had to report back to Palisades. Serveral weeks later I received a ID Theft Affidavit from Palisades that they wanted filled out with the same information I gave to the lawyer, notorized and returned. I sent it Federal Express so I would have a signed confirmation of delivery. Today I called them to find out what the status was and they said all that my file was the court date for March 20. I have lived in the same place for over 12 years and never lived at the address the AT&T bills went to. Why did Palisades never try to contact me? My phone number is in the phone book. The other agencies from my ID theft had no problem finding me. This is driving me crazy. When will this end??

#3 Consumer Suggestion

Donna, just file a lawsuit on them!

Donna,

Just file a lawsuit on them for your losses in dealing with this frivolous collections activity. That is the only thing these freaks understand.

The first thing you should be aware of, is that you NEVER have to prove you do not owe a debt. The burden of proof is always on them. Whether the debt is yours or not, that is irrelevant.

Always STAY OFF THE PHONE, and always demand debt validation upon first contact by any collection agency, in writing by certified mail, return reciept requested. Put the certified# on the letter itself and keep a copy for your records.

In this letter clearly dispute the debt, and demand to see the signed contract that created the debt, as well as a full account history and itemization of charges.

Talking to them, or giving them documentation will ALWAYS make things worse for you, not better.

NEVER speak to any debt collector on the phone, and NEVER give a debt collector ANY information at all.
