 the petsmart at south hurstborne parkway breaks the law by not allowing me a break or a  lunch when i have been there for more than 5 hours. i have been writing down the hours i work and writing down when i am denied a break or a lunch because they have either forgotten or they tell me that there is no one to cover my break

it is not my job to make sure there is enough people in the store to fill in while i take a lunch, and i found it odd that while there is no one to cover my break or my lunch, i get called to the salon and the petcare department to cover other peoples breaks. i should also add that i have no safty training to work in the salon and am not allowed to wash the dogs or clip nails so i end up cleaning and answering the phone but i cant help customers with their dogs. im not allowed to and many of them dont want to wait and leave.

three times this month i have been denied a lunch and i rarely ever get a break. the only time i get a break is when another coworker i work with is there because she forces them to let me. this happens when there are four people in the store. not including the pet trainer who usually has a class and cant cover the break.

usually it is only three people. me, someone in petcare, and a manager. im tired of petsmart thinking they dont have to follow the law. also another thing petsmart does is when we get certain tests by e-mail that all associates must take, the managers will fill out the answers for us or write down the right answers and have us sit there while they hit submit. i dont even know what was on these tests. i just know they put in the answers for us. federal says they have to but they dont care. they only tell me well there is not enough people and no one to cover your lunch. im afraid to contact HR because i need this job and cant afford to be fired.

 Federal law has nothing to do with Breaks and Lunch periods, that is regulated by the State, in your case Kentucky.

You are required to be given 1 10 Minute break period per 4 hours worked, this is a paid period.  Lunches are a bit different though.  Apparently they need to give you a "reasonable" period not sooner than 3 hours and not later than 5 hours into your shift.   This is "off the clock" and it seems as if it could be seen as not required if you have made other arrangements with the employer.

However, they don't define what "reasonable" is, and you may need to show proof that you did not have some sort of agreement to skip your lunch.

I will say that if you are worried about getting fired.  In just about every case, if you report them to the State and they fire you for it, they could be in some very..very serious trouble.  I do not believe that same protection would apply if you report it to their HR department.
