On September 5 , 2008 I was t-boned in a intersection by a driver who didn't even attempt to stop . He was clearly cited at fault and had Progressive car insurance.. Since then I have been without a truck ( it was totaled ) . Progresive insurance company told me they would pay 4000.00 for my truck. A market search showed that my truck was going for 7 to 8 thousand to replace it. So mean while they referred me to Auto advantage to find me a truck. They found one for 7,500 . Well they won't pay that. So I'm still out a truck and missing out on work. They said they could only give me a rental vehicle for 3 days ???? I'm so frustrated dealing with them !!. They are very good at phone tag also !! So whats my next step ?

Progressive (along with many major insurance companies) does NOT use evaluations that are only benefitial to them. They use a very public, very well known, and very accurate NADA. That is it. No Blue Book (not an evaluation software anyways - only "starting point of negiations") and no autotrader or anything else. Where they get their pricing from is the "average selling price of the vehicles in your area at the time of the accident with the options/miles listed". Nothing more, nothing less. It is a very fair system. Sometimes it is a lot more then Blue Book, sometimes not. Either way, its the same for EVERYONE. If you truely and indeedly can't find any vehicle with in a 200 or so mile radius that is similar, then there is a clause where you can get independent evaluation done to the vehicle. But this has to be a truely independent evaluator that is certified and both you and Progressive can agree on. It also may cost you some money to get the evaluation. Progressive isn't just looking out for themselves and are attempting to treat everyone the same with the same total loss procedures. Also, 3 days does seem like a short time to have a rental after your car is totaled, but most states only recognize the need to give 1 day.

The insurance company is required by law to offer you a fair settlement. The problem is that their definition of fair, and yours may differ. They will use sources to determine valuation that are beneficial to their bottom line. If you have a disagreement on the price of the vehicle that cannot be reconciled ultimately your only recourse is legal action. Unfortunately the law states that they only owe for rental usually until 24-72 hours (depending on your state) after they make an offer.
Your best bet at this point is to hire an independent appraiser. Use the appraisal to dispute their offer. If this fails, your recourse is legal action. If a lawsuit is filed they will likely settle out of court. In any case, if you think that their offer is unfair you need to provide documentation to back it up.
Unfortunately the law does not recognize your duress. In other words, any expenses or inconvenience you incur as a result of the settlement process usually cannot be handed off to the insurance company. Therefore it might be a good idea after you receive an appraisal to go ahead and replace the car yourself and seek reimbursement for the full value, as it is unlikely that you will be able to collect on further rental expenses.
