RAB company has reported to me that I have an account that is in collections. I have spoken to three representatives on three different occasions regarding this account and this issue. The first representative hung up on me with no resolution and I immediately called back. The second representative indicated to me that a letter/statement had been generated and mailed to me two weeks prior to the phone conversation explaining this debt and money owed. I denied having received any such letter and the representative called me a liar. I received a statement from RAB company as a follow up to this telephone call post dated two days after I spoke to the representative not two weeks prior as indicated by the representative. I sent a letter to RAB company indicating that the debt is not valid and I refuse to pay. Last night, 11/29/06 a representative called. He indicated having no information on anyone having received the letter I sent. I asked the representative about the statue of limitations in NY statee (which is 6 years and this alleged debt is 10 years old) I questioned him as to how the company can legally collect on this alleged debt. At this point, he hung up on me without any resolution. The debt that RAB is indicating I owe has never been proven as I have requested proof of the debt and they have not sent me anything. They indicated the proof is because they say so.

You did the right thing. These junk debt collectors think that people will just roll over and pay whatever they want you to pay. Mostly it is from people who have stellar credit. The collector then says either pay-up or we will trash your credit. Of course, this is extortion. But people don't want their credit hammered so they pay even though the debt isn't theirs. I had such issues with a junk debt collector. I did as you and told them to prove it or go away. Of course they can't prove it but they try anyway. Turn the tables on them and file a small claims action agasint them. Drag them into court and in front of a judge explain their actions. Should shut them up pretty quick. Cheers!!
