Would like to enter a class action suit against Triad Financial Corporation for unlawful business practices and violations of federal and state laws.

In 2001 I purchased a 2000 Ford Focus through at a local auto dealership that was financed by Triad for a total of $14,873.91. After 3 years of payments Traid said we still owed over $11,000.

I wrote asked for a history statement of my account and I found numerous errors i.e. several double late charges, over 10 payments that was applied to interest only & not one penny to the principal, reversed payments where the money was withdrawn from my checking account according to my bank statement and numerous illegal late charges. I wrote (2) letters requesting these corrections to our account that Triad completely ignored.

I was harrassed by numerous computerized phone calls from Triad on a daily basis for payments I did not owe. Instead of making the corrections, Triad retilated by repossessing my auto at 1 a.m. in the morning. My attorney sent them a letter demanding Traid make the corrections & return the vehicle. It's been over a month now and I still have not received anything from Triad.

Triad Saga Continues...

Triad would not respond to our letters of dispute dated April 4 and May 1, 2005 regarding numerous errors on our history statement. Triad would not respond to our attorney's letter of demand dated July 5, 2005. Triad's Legal Management Supervisor Sergio Padilla did respond in writing on July 22, 2005 to the complaint we filed with the Washington State Attorney General, however, it was all a lie.
He wrote "At this juncture the complainant is welcomed to redeem the vehicle and we will waive the late fees out of good faith." He failed to say Traid already auctioned off our vehicle. He also stated a "Notice of Intent was sent". This was also a lie. We did not receive any notice from Traid since they took our vehicle at 1 a.m. in the morning on June 14, 2005. Washington State law states "you must be notified in writing by the creditor if the vehicle is to be kept or sold and you have the right to redeem the repossessed vehicle up until it is sold or within 21 days of receiving notice". This was a blatant violation of our rights according to State laws and Federal laws. Traid thinks they are above the law and can violate laws on a regular basis with no consequences what so ever. Where's an attorney that will go after these lying law breaking thieves?

It's been 6 weeks and still no contact from Triad in writing or by phone. I filed a claim against Triad with Washington State Attorney General's office. I suggest that you all file a complaint with your Attorney General's office. Please contact me to join a class action suit A.S.A.P.
