On January 31, 2006, someone from Triad was sent out to repo my car after I had made a payment and set up arrangements for the remaining payments I was behind. I didn't give them the car, but proceeded to call Triad to find out what happened to which they replied they never received my payment. After some further discussions another payment was made that day and I was told that they could put a "hold" on the repo order for now. They further stated that as long as I kept my arrangements, they wouldn't take the car. I spoke with a party by the name of Anthony at that time. By the end of January,I had made two payments (1/16 & 1/31)towards catching the payments up. In the month of February, I made a payment on 2/11 & 2/26), but the week of the 27th someone showed up again to repo the car.
I then called Triad and spoke with a representative by the name of Ms. Calloway who told me that the last representative that I had dealt with (Eddie)had requested repo order removed, but when account rolled to another department, supervisor (no name provided) didn't honor request to remove repo order. She told me that my payment on 2/24 would show account only 15 days delinquent and that I should at that point try to get extension for remaining past due month of February. Ms. Calloway further stated that in looking at my account, it showed that I had previously paid the fee for requesting an extension (previous attempt hadn't been completed by company who never faxed and/or emailed forms).
On 3/8/06, I receive a call from them stating that account is 28 days past due. I asked why were they calling me when I have arrangements set up for 3/10/06. Was told by rude representative (didn't identify himself) that they will keep calling until I do payment. I call them back on 3/9/06 to see why they are harassing me and to speak to Ms. Calloway since she was the only one who seemed to not be rude in speaking to me. After some discussions about account with rep
by name of Canisha (sp?)I asked about getting one month extension and after further inquiry as to the whereabouts of previous extension fee that weren't even used (and Ms. Calloway stated were available), she wanted a second phone number besides my home. I informed her that I didn't have one and that I wouldn't allow them to call me at work. She then went on to state that this is why they denied my extension because I wouldn't provide an additional phone.
This companies collection tactics, rude behavior, unprofessional demeanor is draining to say the least. While I have been behind on this account, I have made some strong attempts (at which I feel I've succeeded) in getting it caught up and current. At no point, have they been helpful, but only difficult. They aren't required to provide me the extension or work with me - I am aware that they as a business have that option. But it is the manner in which they conduct their business; it is the many violations of codes in which they don't seem to regard to collect. They are constantly (and knowingly) violating FDCPA, FTC Codes with their collection practices.
