Entered into an agreement with General Steel’s design services group on January 6,2017. The contract was for them to provide local code review, floor plans, renderings, and cost estimate of the project. The contract also states that I could have 2 design changes. When I questioned what this meant, they said if I went from a gym to a church or a church to an office, those would be design changes. They completely skipped number 1, the local code review and went straight to floor plans. It’s 11 months later and I’ve never been presented with local code itmes. Secondly, I presented them a floor plan that I had drawn out. The simply plugged it into smartdraw. They didn’t give any suggestions or even check ADA requirements. For 9 months I worked with Ronald Lamping and Michael Gold to come up with a suitable design. What I got was a boring building that looked like a church. After just a month, I asked for a different floor plan and look of the building. They kept trying to “fix” this one by changing doors, colors, etc. They told me as soon as we got this one right we could go to a different design. One time I told them that they were as close as they were going to get so let’s get to the other design. They provided me the cost estimate and wanted me to move forward. I explained over a phone call that that building wasn’t perfect and I wanted to see a different design. Michael gold insisted they get that one right. So over the next 5 months they kept making some changes. I then again asked for a different design. This time I was told it would cost another $1,200. I responded with terms of the contract showing 2 design changes. After 3 weeks, I have heard nothing. The terms of the contract provide that arbitration is the sole resolution option and that the customer (me) must pay in advance for the arbitration and costs of their attorneys. Many courts have found general steel’s arbitration clause unenforceable but it would cost me for than $5900 to get a court to rule that. I’m sure Design Service Group understands this.
