I was a victim of Identity theft and for 6 months I have been fighting with them to close the account and remove it from my credit report. They keep saying they've "mailed" me information that I need to fill out and return. But not only have they not mailed me anything, each time I call they tell me a different time that they actually "mailed" it to me. Not once repeating the same day (or even the same week). I've even disputed it with all 3 credit bureau's and they even "lied" to them saying the account is mine, so it keeps getting updated on my credit report. NOW! their latest scam is they say that they can't access my account anymore because there was a hold put on it because they were informed I was DECEASED! So, now they want me to mail my pay-stub and/or W-2 so the block can be unlocked! I honestly can not believe there is a company like this in business in the USA!!!

They finally did the right(ish) thing after hours and hours of phone calls, and me submitting everything from military orders, to local country bills, etc etc... HOWEVER! of course, they did nothing for me (it even took numerous additional phone calls to the "office of the president" at their company) to get the HARD inquirey removed. I will definatly file a report where you mentioned though. Thank you!

Credit One Takes Advantage of our Military Folks

Wow, there is a simple solution.  You should file your ID theft claim with the FTC and the CFPB.gov.  They are required by law to handle your account in a very specific manner, which I realize they don't.

You can file a CFPB.gov report in minutes and with enough complaints, the CFPB.gov will begin a formal investigation of Credit One Bank and its practices and has the POWER to fine the bank as much as it wants;  some banks have been fined hundreds of millions of dollars.

The second tactic is to arbitrate.  This is a simple process whereby you essentially take Credit One Bank to arbitration (sort of like a Judge Judy Court), where Credit One Bank has to pay all of the costs, which can easily amount to $50,000 or more, plus attorneys fees.  They have to fly to you with their witnesses and foot the entire bill.  Credit One chose to include arbitration in its contract and is therefore bound by the contract to arbitrate AND pay the entire bill.   You should read the contract by googling "credit one bank arbitration."  There is also an entire string about arbitrating against Credit One Bank on the website debtorboards.com   Go to the tab marked Arbitration.  Good luck.

Dear Mr Sarcasm

"At the outset, you write you are a victim of identity theft.  It also seems like you're saying the thief opened this account in your name and you contacted this subprime credit card company wanting them to close this account, as it wasn't yours"

Of course I said close the account that wasn't mine... it wasn't "mine" because I didn't OPEN IT! BUT it was however in MY NAME, MY SSN and showing up on MY Credit Report!

"You then state you disputed this account with the three major credit bureaus, as you should have if this story is true.  As per federal law, the bureaus then contact the entity who reported the information.  If the creditor does verify you indeed you are the owner of the account, then the information stays.  If not, it has to be removed.  You claim this subprime credit card company violated federal law and lied to the cb's.  A little later it looks like you SLIPPED and stated exactly:  "they can't access MY ACCOUNT..."

Yes, I disputed it with the 3 cb's... when I noticed it (along with more by this point)... and obviously they lied to them, because they still used the false information from the original opening of the account. EVEN after I contacted them AGAIN saying this account was not opened by me!... and I am so sorry, I worded it and said "MY ACCOUNT" wording error... since it is my name... HOW ABOUT I SAY... THEIR ACCOUNT IN MY NAME.

Credit One is a SUBPRIME credit card company which offers credit cards to those who have developed their own reputation of NOT paying their bills on time.  There are many who come here and wail and whine because they themselves have turned on the collections machine because they continue in their deadbeat ways.  Others, who have turned on that collections machine come here to spread some type of negative information for the express purpose of some childish "getting even" because of their collections efforts.  I suspect there's more to this story...like the TRUTH.

I'm not whining about a lie.. only 100% facts... would you like all of the recorded phone calls? I have very clear proof.. I wasn't even in the same country when I account was opened or charges were made! I am in the Military and was stationed overseas during this entire time... so you can take your smart a** comments and shove them! This is a criminal company and I will continue to expose them for what they ARE!
