Ugly Duckling DriveTime dealer pushed sale and provided false info to lender to insure end of month sale. Ventura CA

Dealer made me feel like they were my only resort in financing a vehicle with my credit history. It was the end of month and they made it seem like it was my last day to ever buy a car. Now I know that it was the end of month commision. I made my downpayment 3 minutes before midnite on 1/31/07 and contract dated 1/31/2007 and not fully explained nor signed till 02/01/2007. References called numerous times looking for my home number when they should have it on file. My employment contacted and given by DriveTime my private info, my social secuirty number locate my account.

When I contacted DriveTime Corp. office in AZ they accused me of providing false info regarding my references and my employment status when dealer was fully aware of everything. There was a lapse in my second payment that was only 7 days late. My new paydates with new job would only lapse one payment only. Dealer was to provide info to lender and never did. After only 5-7 days DriveTime put my loan in default and asked that I surrendered vehicle even when I offered payment. They refused I reported them to DMV consumer fraud unit and they still have not sent any letters or any judgements and never picked up vehicle still in my posession.

Everything on my application that I signed at the dealer store had accurate information. The information that was submitted to the lender did not match what I had signed on my application at the dealer store. Information was entirely mixed up and seemed to have missing documents that I had signed at the dealer store. Instead of matching documents and sorting the situation out I was accused of providing false information, and now I lose money and a vehicle. I tried to make payment triple if I had to even borrow it till my next paydate. It was no more than 6 days late and they refused any payment what so ever.

Just to summarize what happened

1. You went to a car dealer who specializes in financing poor credit risks such as yourself

2. They got you approved by lyingon the application and falsifying data, which YOU signed as being factual

3. They tried to contact you regarding your loan application but didn't have YOUR HOME PHONE NUMBER so they tried to reach you using references YOU supplied (why you are upset at them reaching your references is beyond me since that's kind of what references are for)

4. The loan company contacted your employer, and obviously realized that the information on the applicaton was falsified. It doesn't matter if the dealer knew it was false, YOU SIGNED IT AS TRUE

5. YOU MISSED YOUR SECOND PAYMENT. SECOND...didn't even make 2 in a row

6. The loan company declared your loan null and void as the application was approved using false information and they rightfully want their car back

If the above is true, than they have every right to ask for it back. Just because the dealer pressured you and put false information down to get you approved doesn't resolve you of liability. You still signed the contract stating that the information provided is accurate. Sorry, but you're completely in the wrong here, and you should thank god that they aren't pursuing you in other legal ways for falsifying a legal document and entring into a contract under false pretense and fraud which could include jail time.
