Back in 2001, I bought a Ford Escape. Everything was great at first, then I had a financial setback and Ford was really good about deferring a payment for me. Everything was good again for about 3 1/2 years and then I have been put through HELL by Ford. I left my husband, who I found out hadn't made a payment on my car for 3 months. I called them, explained the situation, again, they were very nice making arrangements with me, so I could get back on my feet. That lasted about a month. I caught up the payments, and then started receiving phone calls that I hadn't made the payments. Luckily, I wrote down all my confirmation numbers because the person I spoke with clearly did not believe me. I provided the numbers and told him that I checked my bank account online and the payments had cleared, and the person didn't even apologize for the accusatory tone he continued until I hung up on him. So with that behind me, I continued making my payments. I admit some were a little late, as in a couple of days late. Then one month, I made my payment EARLY and started getting automated phone calls from Ford..as early as 8AM!!!! When you work nights and get off at 7AM, you can imagine what a nice wake up call that is, especially when you have been in asleep for 15 mins..... These calls continued approximately every hour to hour and a half. So abandoning my sleep, I call them back..Guess what? They say they haven't received my payment again, even though it posted to my bank account 3 days before it was due even allowing for transaction time!!! So again, I give them the confirmation number and the calls continued for the rest of the day because "well, you payment must not have posted to OUR system yet." I ended up turning off the ringer on my phone, which is not a good thing when you work in an emergency dispatch center.... So as my contract is winding down, I am thinking, "Great I am going to be rid of these MFers very soon." I open my last payment, and it's $1300. Now, I know that I don't have the kind of money, so I call to make arrangements to split it into 3 payments. I speak to a woman named April who sends me the paperwork to split the payments out, I sign it and send it back 4 days after I received it. It is now July, the paperwork says my first payment on the balance is due August 20. I don't hear from Ford, and I know how fond they are of calling me, until August 19. I spoke to a very nice man named John, to whom I explained about how I filled out the paperwork and send it in and my payment is not due yet. He explained to me that they never received the paperwork and now my account has been charged off. I gave him the dates I mailed the paperwork in, and he said he would talk to his supervisor about removing the charge off from my credit and to go ahead and make the payment. My boyfriend decided that he is going to pay my car off for my birthday tells me to get the payoff information, so I call to get it, and this woman who answers tells me that they can't remove anything from my credit report. I speak to a supervisor who tells me that he will remove it from my credit if I wire the money in. I explained to him that it's not my error, it's their error, and I will mail a check in for the PAYOFF. He tells me they will hold the check for 30 DAYS then process the title, and the title process can take another 30 DAYS, and oh, he won't remove the charge off from my credit. So I ask "Basically, you are telling me, you are holding the title to my vehicle, which you say will show as paid for as soon as your receive the check, hostage for at least 2 months?" He says,"Yes, you have had the car for 5 years and have bounced a check with us before." I asked what year and explained I was banking with Wells Fargo in 2002 and had a problem with my direct deposit which was remedied within a day, so the check and all fees were paid and I haven't bounced a check since. I admit I had an attitude because I thought because it was their error they were being completely unreasonable. He, however, got nasty, saying things like "when is the last time you made a payment?!" and "Don't expect me to do something for you, and you not do something for me."(Doesn't that sound like something a sexual harasser would say????) and got hung up on in the process. I WILL NEVER OWN ANOTHER FORD, AND WANT TO TELL EVERYONE FORD WILL LIE TO YOU, WILL NOT HONOR THEIR ERRORS AND TRY TO SCREW UP YOUR CREDIT!!! I WOULDN'T WALK ACROSS THE STREET FOR A FREE FORD!!!

Get a Better Attorney

I seem to respond to these things way too much.  First your non legal issues. If your account showed late then yes they do call you. Why would any company pay for people to call you if you were current. You freely admit there were alot of late payment issues on your account. In the world we live in it is legal and acceptable for business calls to be made from 8 am to 9 pm. Nothing improper there. The calls kept up for every hour or hour and a half THEN you answered? why not answer your phone when it rings then you won't keep getting the calls. You had to then giove your confirmation number? OMG so you paid the night before and they didn't have that information??? join the real world it takes time for any business to get a payment reflected on your account if it can be done in 24 to 48 hous then they are a good business. If them calling you when your late is such a problem then advise them your account is to be mail contact only. They have to honor that. BUT if you are late you may get up and find your vehicle gone. If you owe someone money and they cant find out what the problem is an when they will get paid it would be up to you to call them. If you don't they will just pick up their vehicle.  How is it Fords fault that they didn't get your paperwork. Every consumer know if you have important paperwork make a copy of everything if it has to be mailed follow up that evverything was received where & when it should have been and fax it again if needed. you don't just assume and forget about it. Finally as far as holding your title every company has a period of time that they wait to release a title or deed of trust if it was paid off by non certified funds. Could they have been nicer yes with out a doubt. Did they rip you off. No. Grow up and join the real world.

FORD CREDIT HAS DONE THE SAME TO ME!

Ford Motor Credit loves to harass by phone! I have 3 accounts with Ford Credit. I have paid my accounts upto 3 months ahead because I work overseas for 2 months at a time.

They call 50 times a day & load up the voicemail to where no other collegues can contact me.

The most effective way that I found to deter them from calling is to purchase a freon horn. When they call let 'em have it!

They will be too deaf to call again!

As fas as bankruptcy, I filed twice. Both times I have had Ford Credit involved. Ford Credit doe's not send invoices. On top of that they will not entertain any questions pertaining to your account!

Instead, you are transferred to their Bankruptcy Department in Arizona. There you will find rude service & sarcasam with the reps.

I like Ford Super Duty Trucks, I own 3 of them for my Business. I do agree on their cars though, they are ot up to par with the foreign cars.

I have never stiffed Ford with a repo, but when I lost 2 trucks in Hurricane Wilma, they would not Finance me because I had filed Bankruptcy 1 year before. Even though I paid off 2 vehicles with them just the month before!

There is no loyalty with Banks & their customers that is for sure!

I just though I woud add my 2 cents.

I know what your saying and I just want you to know that I sent a fax of your letter to Ford.

In fact, last month I sent the following to Ford, please read it because there is a good chance you will need to have your brakes checked!

My letter is as follows:

7/24/06

To Whom It May Concern:

Today, I just read that the Ford Motor Company reported a $123 million dollar quarterly loss and I am not surprised!

The fact remains; you do not make quality products! It is also a fact that the Ford Motor Company does not respect the consumer!

To prove these two points, please consider the following facts:

Our Honda first brake job occurred when the vehicle had over 120,000 miles. Our Ford vehicle couldn't get 42,000 miles before there was a complete failure of the brakes We are very lucky that nobody was hurt or killed by your company's defective products! (This is your notification that there is a problem with your poorly designed/defective vehicle(s).)

The next point: The nation's consumers are not your customers The Ford Dealerships are your customers! This is why when people write to your company about problems with dealerships nothing happens! It is because of this simple fact that your company is in deep financial trouble all because you do not respect the consumer!

You don't even want to hear from the consumer, which is why you refuse to give out the main fax number and this is also why you send letters like this one over to that useless Customer Service Group!

Think about this for a moment: My wife and I routinely get over 100,000 plus miles out of our vehicles brakes, yet we couldn't get 42k out of a Ford. What a rip-off! What a poorly designed vehicle! What a dangerous piece of junk!

Again, we are very lucky that nobody was hurt or killed by this poorly designed/built and very defective Ford product!

Would you like to know what is ironic about this?

I will get a lot of satisfaction posting a detailed explanation about the defective Ford product on the Internet, along with the warning, If someone in your family was hurt or killed you better have the Investigators check the brakes!

The bad part about this is that your company knows that this is a poor design!

A way out. . .

If a creditor places a negative item on your credit report which is untrue, they are in violation of the Fair Credit Reporting Act and as such, they can be sued for a lot of money.

If you have/will pay off the vehicle and you get the title, and the chargeoff is still there - see a good consumer lawyer and sue them silly.

Don't go to your run of the mill family lawyer because he'll be lost in consumer law. You need to see a lawyer who is very conversant in consumer law.

We got behind 3 months with our payment to Ford Motor Credit. We had filed bankruptcy, and they had stopped billing us, and 3 months over the course of 9 months I let slip away. They filed paperwork to repossess the car. I contacted their attorney who provided me all sorts of information, which months were missing, the payoff, address to send etc..

My husband and I paid off the car and within 2 weeks, we received a refund check (they had overstated the payoff balance) and our title, and a letter thanking us for doing business with them. We most likely will not buy another Ford anytime soon, but they were pretty accommodating when it was WE who screwed up.
