The first time I asked for help from GMAC I was three months behind. They gave me a loan through Dyck Oneal - $6000.00 (I pay 60.00 a month to this company and half goes to interest) The loan does not qualify for interest being applied to taxes. I am wondering why they didn't offer me a loan modification then. This was in Dec 08. I had to go back and ask for more help because I was getting pay cuts in increments of 10%. Total as of today 45% pay cut which includes having to pay part of my health insurance. I received a call from GMAC in August 09 and was told that I qualifed for Obama's loan modification program. Which I was very grateful. Of course this was the pretrial period and I had to make my payments on time for the next following three months. I made my first Payment September 09 the new amount I was given to pay. I made my 2nd payment for October online because I did not want to be late and there was not an option for me to pay the lower amount. So I paid the old mortgage payment amount thinking that I could apply it to the following months payment. The overage amount was 203.33. I made my November 09 payment over the phone and their representative took out 203.33 more than the new modification payment. Caused my checking account to bounce with other issues because I am really strapped financially and I could not pay another bill besides the late charges, overdraft fees, etc. After several phone calls I was assured that I would get a check for the difference, which never showed up so I took the overage of those two months and took it off my December 09 payment. I received the loan modification paper work filled it out and overnited it back to GMAC. It took them a few months to adjust my bill to the correct amount due and I stayed in constant contact with them. The only problem was that they were showing me two months behind on my mortgage payment. I have not been 30 days late since I started the pretrial. I contacted them and got this reply: We apologize for taking out to much money from your checking and we can't give it back to you because we applied it to delinquent interest. But as a courtesy we will credit you 99.00 +/- for late fees. (But I was not late and there are not suppose to be late charges, etc. during a loan modification process) I have been going back and forth with them every since. I have been harrassed by phone calls saying I'm past due. They have reported me late on my credit report and will not return the money that I over paid. I pulled my transaction report on line and saw where they did not give me credit for payment for four months and only show as receipt. So they misapplied my house payments. When I pointed this out they sent me a letter of a copy of the transaction report. They are charging me extra late charges and inspection fees every month and I'm not sure what that is about. I have written the Attorney General with all the documents of proof. I have also written president Obama and Governor Charlie Crist concerning this. I asked the president to check out ripoffreport.com and complaintboard.com and sent copies of those web sites to Charlie Crist. I copied customer service for gmac on those e-mails. I'm sure this is not the only mortgage company who has taken tax payer money and throwed their customers under the bus. But if you have not done so and if you know of anyone else who has be unethically treated by any Mortgage Company. Please e-mail the president along with your governor and representatives. File a complaint with your attorney general. After reading all that I have on this website concerning this I am seeing that most people who are like me, really can't afford and attorney and just want their elected officials to do their jobs and protect the American people.
