I bought a car from JD Byrider in 2008. I was young, without credit, and had no other choice, or so I thought at that time. Anyways, They took my tax check of 800 dollars as my down payment. Then a couple weeks later 350 dollars then they said I had 101 payments of 173 dollars. I have paid these payments every other week for the last 3 years. I was told I would have my car paid off in June, now they are telling me it will be December. For three years I have thought June, then they changed it. Also I was told that.
Anyways, before my warranty was up I took my car in because it wouldn't back up on a hill. They sent it back saying nothing was wrong with it. Obviously they didn't try to back it up on a hill.
I've been late on my payment a couple of times, but always made up my payments. They always like to harass me when I am late.
On Christmas Eve, last year, they called me saying I was late on my payment, and I knew I made my payment. They kept stating that if I didn't pay them now, then they would repossess my car, and well, I hung up the phone on them saying Good luck finding a tow truck on Christmas! That next Monday when the bank opened up again I went to see what happened to the money I put in there for my car. It turned out that CNAC posted a payment of 140.00. I thought it was weird because they always post 173.00.
The bank looked up there records and found out that they took out somebody else's payment from my account then tried to take out my payment the very next day. All that harassment on Christmas eve was all about there own mistake. This charged me late fees on my other bills, plus my bank fees of 30.00 each time! I thought it was bullcrap really! They sent me a check of 60.00 to pay my bank fees though. It didn't really fix all the crap I had to go through that week.
Because of that, my next payment of 173.00 I figured I would pay late so I could pay my other bills first that they screwed me over on in the first place. Well, they called me today saying they needed the money now. I told them I can't pay til Monday, and they are threatening to take my car. I just don't get it. They can screw me!? Why can't I be a weak late?
All I really want to do is give the car back. If it was in mint condition it would only be worth 4000 dollars. Its not, and I still owe 4000 dollars. All together, I will have paid over 18000 dollars. It's not fare. I could be using that money on my babies, who need diapers and milk. I work my butt off just so they can have their money. Why are they allowed to charge me so much. The interest on my loan to by a car from JD Byrider that CNAC financed is like 25%.
Why don't they explain this in high school before you start real life? Can anybody help? Can I tell them to take the car and still be able to buy a house in a year or two?? Can I win if they take me to court? If I give the car back, can they really garnish my wages? Why are they able to do this to me and my family, I'm nothing but a waitress at a restaurant. I only make 1200 dollars a month and they get a third of that. It's just not fare. Please, just help me. Anybody, what should I do?

Why are they allowed to charge me so much. The interest on my loan to by a car from JD Byrider that CNAC financed is like 25%.
- The short answer is because you agreed to it. You are a high-risk borrower, Higher Risk = Higher Rates. They didn't force you to get that car, you could have gotten a cheaper car, you could have saved up your money for a few weeks/months and paid cash for it. Sure it would not have been as nice but even if you financed itat those high rates it probably would be paid off now.
Why don't they explain this in high school before you start real life?
-I don't know your situation, butwhy is the school system supposed to do this? Why not your parents or guardians?You are going to find out there is a lot of things inlife that high school didn't teach you. The best lesson you can take from this before you agree to any sort of contract or account agreement..get it in writing. Then read and fullyunderstand what it says. If you don't understand take someone with you who does, if you still don't understand DON'T sign anything.

It is time for your reality check. If you turn the car in, or they come and get it, it is still a Reposession. As such they will sell the car at auction and you will still be "on the hook" for the remaining balance. Based on what you wrote the chances of you getting approved for a house in 1-2 years is about zero even with a perfect payment historyand you keep the car. If you have a reposession on your report in no way, shape or form would you be approved for a Mortgage from any legitimate lender. Not to mention that if you thought the terms of this car loan were bad, just wait until you try and get another one with a reposession on your report.
If you fail to pay back this balance they can take you to court. Unless you get lucky enough to find some technicallity they will get a judgement against you. Once they get a judgement against you, depending on your State they may be able to garnish your wages or attach your bank account.
