My wife and I drove from Atlanta to Nashville on Wednesday morning to attend to the KIS Bankruptcy Hearing. All though the hearing only lasted 30 minutes, I received some very good information on how to pursue this thing. What really bothered me is that one..... only 7 people out of 1000s bothered to show up for the hearing. I was excepting to see a court room packed with people. The other thing that got me is that on the creditors list there were only 14 creditors that had filed a claimed against KIS GOLF! My wife and I made 15. Seems to me that if people are concerned about being ripped off there would have been more people there. I do understand that there are alot of people that really don't know what's going on. I didn't find out until Thanksgiving that all this was going on. For all of the members and ex-employees in Nashville I would have expected more people there. If you haven't filed a proof of claim against KIS PLEASE do so ASAP! I think I saw one ex-employee on the list that has filed. If you are not on the list of creditors AND filed a proof of claim would will not get ANYTHING!

So everyone knows.....The Chapter 11 is now a Chapter 7. This is because KIS failed to appear before the board around the first week of December. This info came from the US Bankruptcy court trustee himself.

I have created my own blog about this. We need to post and talk about all this on ONE blog and not have it all over the place. For people trying to get help it makes it hard. I haven't posted the info from the hearing yet to my blog but I will have it all up tonight.

LET'S ALL BAND TOGETHER AND PUT THESE KIS FOLKS IN JAIL AND TRY TO GET OUR MONEY BACK!!!!

I can speak for my family. We were partners. We've lost 10s of thousands of dollars. We lost our jobs with the SUDDEN closing of the stores. We are loosing our homes, our cars. and trying to put food in children's stomachs. Personally, we did not have the gas to drive and face the SOBs.

I will assure you that on a local level people believed in this company. We had our lives tangled up in this Ponzi Scheme. This company made huge returns all the way up and thru the 3rd quarter. The creators of this scheme were only in it for the greed. They were making MILLIONS. Yes, MILLIONS.

They have screwed up our paper work. Quite a few employees still cannot find work and cannot draw unemployment. They are also not sending out W2s. Several employees/partners have moved to different states and are now stranded away from their families. Many of the ex-employees had to do without Christmas presents this year.

I don't expect pity. Just a little understanding. We are scattered all over the South. We had our entire lives wound up in the mess. We are so sorry for our part in having you buy. I promise you that we believed. Almost all employees first bought a package/set of clubs. We loved it and had the best time working together and with the families. This company should have continued to prosper. Greed is an evil thing!

Just a little side note: rumor has it that they are reopening under another name. They have done this more than 50 times. They are good at what they do.

It's obvious that you may know a little more about this and how it works than the rest of us. If you have any updated information, please post it. I agree with you, this is not a debatable issue and we are all not here to see who know more than the next. I will leave it at that.

Please communicate with members, employees, investors, and partners regarding the upcoming information sessions regarding Bankruptcy case, Kis Golf, Inc., 441 Donelson Pike, Suite 325, Nashville, TN 37214.

If you are owed monies as a member, employee, investor, and/or partner, you will want to attend one of the sessions as outlined below.

The rooms have been booked for two hours. In addition, you will have an opportunity to ask questions at the end of the session. The information session will cover three topics related to the recent bankruptcy filing of Kis Golf, Inc.

The first topic will ensure that you are provided contact information for contacting the appropriate government agencies in the upcoming days.

The second topic will be a discussion regarding the representation by a civil litigation attorney as well as the bankruptcy attorney. The attorneys have been contacted, and they are interested in the number of people and to what extent individuals have been affected by Kis Golf, Inc.

The third topic will cover financial resources. In order to cover the financial resources for legal counsel a discussion will be held regarding the opportunity to band together to share the financial cost. There will not be money collected during this meeting, nor are you committed to participate in any type of legal action.

These are information sessions only.

It will take approximately three weeks to finalize meetings at the cities wherein Kis Golf, Inc., was located.

At the end of the session, if you are interested in becoming part of civil litigation from a class action perspective and if you are also interested in representation from the Bankruptcy Attorney at the upcoming creditor's hearing, we will be requesting your contact information. There is a bankruptcy attorney in Nashville, Tennessee, who has agreed to represent any and all parties in this matter. The initial cost for his representation at this meeting is very minimal.

Once again, as a follow up to the first topic of discussion, you will also be receiving handouts regarding the procedure for getting the government agencies involved in the investigation to determine whether or not there was misappropriation of corporate assets by senior management. In order for government agencies to get involved, they will need to be contacted by each and every individual. We want to be sure to handle this in the most effective way possible.

Your attendance at one of the information sessions will ensure that you have accurate information regarding the proper protocol for moving forward in an ethical and practical manner.


Memphis meeting is this Saturday, Jan 3.

Columbia, SC meeting is Saturday, Jan 17.

Kennesaw, GA meeting is Saturday, Jan 31.

My comment: I thought you attended the hearing on December 17. There was no hearing on January 17, as this date has not arrived.

Which bankruptcy trustee did you speak with? The Chapter 11 Trustee ? Lloyd M. or the new trustee for the Chapter 7? Mr. David G. Rogers??

The trustee changed when the case was converted to Chapter 7.

As far as hot of the press, I am sure you are aware with cases like this that "hot of the press", could be for a total of 30 minutes or less before something else changes.

Your additional comments were, "We should all be putting fourth an effort to get as much information as we can to one another." I could not agree with you more in this; however, my questions started with you because the information was not accurate. I agree the information should be shared, but just be sure it is accurate.

You final comment to review, "If you know anything about how Chapter 7 Bankruptcies work I wouldn't wait. It's first come first serve when all of the remaining assets have been liquidated." This is a no asset case for now....yes, the trustee has hired someone to look for assets...yes...you are right this is chapter 7; however, I would suggest a review of the 2008 Bankruptcy Code, Rules and Forms including the federal rules of civil procedures and the federal rules of evidence as to your last comment regarding first come first serve. The is a specific order for paying out the creditors as outlined in the Code, Rules and Forms.

I am not debating. I agree with you. Please post accurate information. We all have the same goals in mind.

I don't know about you; but I would want to know if you are a Bankruptcy Attorney, and if you are staying current on the information you are providing through this forum as well as your blog.

I wish you the best in working to a resolution on your 10k.

Shelby D,

I would have to disagree with you about the importance of the Jan. 17th hearing. We walked away with a lot of helpful information and as well talked with the Bankruptcy Court clert and US Bankruptcy Trustee that is handling case. Had my wife and I not attended, we would still be in the dark. Also the new court hearing date was not put out until 12pm on the 17th. So we got the information hot off the press.

My blogs or comments are to educate and share information with others in the same situation. However, it is not mines or any other single person's job the do all the leg work on this. We should all be putting fourth an effort to get as much information as we can to one another. Maybe I am the only one that thinks being ripped off of 10K is a big deal. So I advice anyone that wants more information to come to the hearing Jan. 21, 2009.


As for those several hundred claims that you know of personally that will file before the deadline, I hope they are smart enough to file NOW! If you know anything about how Chapter 7 Bankruptcies work I wouldn't wait. It's first come first serve when all of the remaining assets have been liquidated.

First of all, the hearing was rescheduled for January 21, 2009. I personally know of several hundred claims which will be filed before the April 25, 2009, deadline.

I appreciate that you are starting a blog regarding this issue, but do you think there is any strategy in waiting to attend the January 21, 2009, creditor's hearing.

You are right that Kis Golf did not file the appropriate schedules nor did they show for the November 24, 2008, hearing. The motion to convert to chapter 7 was accepted, and the hearing on the Motion to Convert for December 30 was not necessary.

Since you obviously have a couple of followers, please be sure you are providing the most up-to-date information regarding hearings. The hearing on the 17th of December was not necessary since the creditor's hearing is currently scheduled for January 21, 2009.

I hope this helps those who are reading your blog and who have decided to follow your comments.

Thank you so much for your information you have posted to file a claim. Alot of us are in the dark about this situation, the only way I find out anything about what's going on is by logging on the the ripoffreport.com. Even some of the email addresses that have been given for attorneys gathering information, I have not received response back on. I have been looking for this claim form for a while but could never quite find it. I will be sending my claim in immediately. I would love to keep in touch and work on this with you. They filed 1 week after we joined. I did not even make the first payment. I am so disguisted and angry and I agree with you that we can not let them get away with this.

I signed up to the blog but it will not let me post comments. I will keep up with your blog.
