My experience with Magic Jack is this , great I made 7-19 calls a week most of them being received. I then had an unusual day when I made 44 outgoing calls and figured this is great since I have "UNLIMITED CALLING IN THE US" I then find it is their standards and practices according to section 6C and you can look this up to remove the top 20% of their customers. Well the problem with this is they are constantly cutting calls lower and lower I mean my average daily call volume on a per month basis is roughly 1.7 calls a day I did the math. If you are consistently kicking off the top 20% of your customers and keeping their money, you are ever decreasing the alloted call volume and is false advertisement since my subscription lasted 4 months rather than a year , you are buying a very small call volume for 20 dollars and customer support is deceptive and trained to lure you to links that close the chat windows. I copied the script below.



 Ramona: Hello, how may I help you?



sam: Hi Ramona my magic jack service stopped




sam: I was wondering if you can help me




Ramona: Let me check what's going on with your account.




Ramona: One moment please...




sam: I was also wondering if you could tell me how many calls I




sam: made today




Ramona: Please be informed that Call records cannot be accessed on-line at this time. You may check the call logs from the softphone.




sam: ok]




sam: I made 45 calls today




sam: would that be defined as excessive?




Ramona: Missed Call Indicator : Red X Mark ; Received Call Indicator : Dark Blue Triangle pointing to the Right ; Outgoing Call (Dialed numbers) Indicator : Lite Blue Triangle pointing to the Left.




sam: under your current policy, being that your software locks you out of your call log




Ramona: It shows here, This Phone Number:  XXX XXX XXXX has violated our Terms of Service. Please refer to Section 6, Proper Use at www.magicJack.com/TOS




Ramona: ..




Ramona: I fully understand how you feel. Unfortunately, there's nothing we can do for it as this kind of process is system generated. Once our Terms of Service is violated your magicJack service will automatically be suspended. There is nothing you can do to reverse the action either.




sam: how would I file a complaint




sam: as I understand if I click that link it will kick me out of this call log so I can't copy and paste it to my BBB and ripoffreport.com links I am going to make




Ramona: Under 6. Proper Use it says "If magicJack sees excessive use, including but not limited to, a customer whose usage is twenty (20) times more than the average magicJack's customer's usage, or a customer who calls more than 50 different telephone numbers per day, or systematic or intentional misuse, it reserves the right, in our sole discretion, to terminate your use of the magicJack device and/or Software immediately, and you will not be entitled to get a refund of any licensing fee or any other fee you may have paid to us. We reserve the right to reclaim any telephone number that does not make a call for a consecutive 90 days. In the event we reclaim a phone number and your software license is still active, you may choose another phone number."




sam: I understand that




sam: How would I file a complaint




sam: can you please provide me with that information




sam: as well as the correct corporate person to contact




sam: my calls were fewer than 50 today




Ramona: It is not only for this day that system evaluate the activities on your magicJack account.




sam: That is wonderful as I usually only make roughly 5 calls a week




sam: so the averages will be in my favor in this complaint issue




sam: How do I file a complaint at the corporate level?




sam: VocalTec Communications Ltd




Ramona: As I have mentioned and explained above, it is the system that will evaluates your activity on your magicJack account. If you violates "Terms of Service", it will deactivates it.




sam: under the consumer protection act I am entitled to the information I have requested are you able to provide that to me?




Ramona: When you plug the magicJack into your computer for the first time you were taken to the registration page to get a new number. On the third screen/dialog box of the wizard you were asked to read the TOS article entitled "magicJack Device and Software, Terms of Service and Software License Agreement". It is impossible to proceed with the process and hit next unless you checked on the box at the bottom that says "I have read and agree to the Terms of Service." Activating a magicJack service requires agreeing to the TOS, which you did.




sam: I will ask you again are you able to provide that information I have requested to me, under my rights of a consumer under the consumer protection act?




Ramona: Please do understand that we do not have the information for that matter, it is the system who evaluates the activities on your magicJack account.




sam: you are a representative of VocalTec Communications Ltd. (CALL)'




sam: yes?




sam: and you do not have the information to file a corporate complaint yes?




sam: as is required by the consumer protection act




Ramona: We are customer support (chat) for magicJack device.




sam: If I feel that my complaint was not sufficiently handled what is your policy?




Ramona: I have already explained the status of your magicJack account here at our end, it is deactivated since you have violated the "Terms of Service". There is nothing you can do to reverse the action.




sam: are you instructed to put up a web link box that knowingly kicks us out of this chat?
