Mr. Sandless Refused to return deposit when work not done Aston Pennsylvania

I arranged to have Mr. Sandless refinish my bathroom floor on February 6th. I paid $153.00 deposit on my credit card.

Two men arrived on February 21st. I was told that sanding would not remove the water stains from the wood.  Bruno took photos of the floor, which I assumed were to show why they hadn't done the job.

The next day (2/22) I called the office about my deposit and left a message. The next day I talked to Matt who told me since I hadn't cancelled the job within the three day period allowed in the contract, I was not entitled to the deposit. 

I hadn't received the contract (I thought) and knew nothing about the 3 day arrangement but since the job hadn't been "cancelled" by me but rather because it could not be done properly, I felt his argument was specious. He sent another copy of the contract as we were talking which I didn't receive (I thought) and told him so.

I did finally locate the 2 copies of the contract which my ancient computer had filed on its own. However, I did not frivolously cancel the job - the job couldn't be done as ordered. 

I have been trying to get my deposit back ever since. Matt has told me he had to run it by his boss (I think he is the boss) and the Accountant and the last time I talked to him, he finally said he would send it to me. That was almost two weeks ago and nothing yet.
