Ripoff Report VIP Arbitration Program
In re:
National Positions.,
Complainant,
v.
Elliot Lavi,
Author.
Rip-Off Report No.:
846839
ARBITRATOR DECISION
Bruce Meyerson,
Arbitrator
Complainant, National Positions has challenged the truthfulness of certain statements (each, a Statement) posted by Author Elliot Lavi (Lavi) on the Ripoff Report website at www.ripoffreport.com on February 29, 2012, as Ripoff Report No. 846839 (the Report). In the Report Lavi stated that National Positions did not provide the services that were promised with respect to links building, blog posts and search engine optimizations. National Positions has denied the Statements in the Report asserting that Lavi did not give National Positions sufficient time to achieve the desired results. Lavi has stated that the Report can be redacted. Both National Positions and Lavi have agreed to submit the dispute to the Ripoff Report VIP Arbitration.
Each Statement challenged by National Positions has been considered, together with any Witness Statements and Documents provided by National Positions, for determination of the truth or falsity of the Statement. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
I have been asked to decide whether the preponderance of the evidence submitted establishes that each Statement is true or that it is false. If the statement identified by Reliant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.
Each challenged Statement submitted by Lavi is set forth below together with my comments and ruling:
1. Statement: National Positions SEO SCAMS, Ripped Off by National Positions.
Discussion: National Positions has provided an Affidavit in which it is stated that it has received a number of awards for its services and that it provides its services to major Fortune 1000 companies. It provides its services on a month-to-month basis and its clients can terminate its services at any time. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find this Statement false.
2. Statement: DO NOT TRUST THIS COMPANY! Agoura Hills, California.
Discussion: National Positions has provided an Affidavit in which it is stated that it has received an award from the Better Business Bureau for customer satisfaction. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find this Statement false.
3. Statement: I then talked to a Mr. William who was full of false promises.
Discussion: National Positions has provided evidence of the contract which its customers sign, and has submitted an Affidavit stating that its communications with its customers correspond to that contract. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find this Statement false.
4. Statement: After initial signings, then came the unanswered emails, phone calls as well as delays in everything they had promised.
Discussion: National Positions has provided a summary of all of the communications with Lavi. This summary indicates that there were many communications between the parties. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find the Statement False.
5. Statement: The links were 90% from link farms.
Discussion: National Positions has provided an Affidavit stating that all of the links provided to Lavi were generated individually by hand. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find the Statement False.
6. Statement: which I found later which had no value to a sites popularity.
Discussion: National Positions has provided an Affidavit stating that some of the keyword rankings for Lavi did improve in a very short time. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find the Statement False.
7. Statement: (actually my site was penalized by google and took a violation for that).
Discussion: National Positions acknowledges that it has no information upon which to deny the Statement. Statements made in a Report are presumed to be true.
Ruling: I find the Statement true.
8. Statement: The blogs they promised was also done on the 3rd month and was done by someone who has no idea of how SEO must look.
Discussion: National Positions has provided an Affidavit explaining that the contract between the parties did not include a blog. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find this Statement false.
9. Statement: They charge us in America for top quality work, deliver work done by workers paid in India or other third world countries which is low Quality SEO.
Discussion: National Positions has provided an Affidavit stating that all of the work done on the account of Lavi was done by its employees in the United States. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find the Statement False.
10. Statement: Very unethical.
Discussion: National Positions has provided an Affidavit stating that it is currently rated A+ with the Better Business Bureau. Lavi did not submit a Response to the Complaint and agreed that the Report may be redacted.
Ruling: I find the Statement False.
DATED this _____ day of April, 2012.

I wonder how much Sir Ripped Off was paid to write a comment stating that he is satisfied with the services. Maybe I should file complaints all over this site.

It's kind of silly for an SEO firm to expect anyone to be able to "take down" a report made here. They know full well that RR never removes reports. If they're so good at what they do, they ought to be able to remove links to these reports from Google, etc.

NationalPositions Lawyer Threatens to Sue Us If We Don't Take Down Review! When telling the truth, There is Nothing to worry about!
AUTHOR: rippedoff3982 - (United States of America)
SUBMITTED: Monday, March 05, 2012
We did not appear "after 6 months" of silence. We emailed you guys and talked to you guys and allowing you to make the right thing and act according to the original agreement. The reviews we have made about your dishonest business is true and accurate. We just wanted every honest business out there know about our experience and realize what's going on here. Your company provided non-indexed , 0 PageRank links and/or broken links and passed them on as Good/popular links and that my friend is DISHONEST and in one word: THEFT! That's like selling a car with no engine. Surely it looks great but the truth is that it's not going to get you from point A to point B.
Other people have had similar experiences with your company. a quick look would confirm that others have experienced similar outcome by working with your company and they allege that your company is also committing spam and trapping honest businesses with Search Engine work with no result so surely there must be something wrong or people would leave positive feedbacks. a copy of that report can be found on
http://www.ripoffreport.com/directory/National-Positions.aspx
The so called "on site programming" FAILED and i am sure your company is fully aware of that. why lie? All you guys stated was that " your site is well made and it doesn't require any programming" and therefore no programming was done. Maybe you should shed light on what exactly you are referring to and stop being so vague. Your staff was not even able to fix a simple site map or a footer and told me that "people in India are the ones who take care of those kinda stuff" and it's still having an issue so you know. All the emails are there to proof our claim.
Your company DID NOT and i repeat DID NOT achieve any positive ranking and google Analytic is there to show that. If anything, your company caused our listings to suffer. If you notice that we have listings that are ranked higher today, it's because we started working with companies that have good ethics and morals and actually provides us with QUALITY LINKS and not DEAD LINKS or links from LINK FARMS.
Also, when national position noticed that we have posted this truthful review of them, they have asked their lawyer to bully us and tell us that what we are doing is illegal and we can not leave feedback for this company. That's the kind of business they are.
We are stating facts and the truth and only the truth. This review is 100% honest and you may let your lawyer Mr. Craig S. Berman know that and ask him to STOP BULLYING US or a report would be sent to State Bar of California about him intimidating us and bulling us.
After all, maybe you DID NOT KNOW about all of these. Maybe your company has gotten so large that you guys do not see small companies such as ours and that's understandable. But a company can come back and try to make things right instead of sending their lawyers to intimidate us and asks us to take back our reviews or there will be a law suit.
It's not too late. If your company decides to do the right thing, i will honestly state that here. Or we can go on and let a small court claim decide that.
The ball is in your court.
Thank you!

Legitimate SEO from a Legitimate Company

It seems ludicrous that after 6 months of not hearing from Mr. Lavi, he out of the blue defames us publicly. He of course does not mention that, he maintains all of the work we performed for him, including the content and onsite programming that we performed on his website (still on his website at the time of this posting). If we were a scam and we did not know what we are doing, surely he would jettison everything and anything to do with us.
It should also be noted that we DID achieve some positive ranking improvements on Google during our tenure (cheap suits from #13 to #4; Tuxedo suits from #6 to #4; tan suits from #11 to #8; Designer suits from nowhere to #14). His keyword list is very competitive and as a self professed expert in SEO (based on his early post), he should surely understand that he would need more time (more than 4 months) and budget (more than $600 a month) to achieve the desired results on these keywords.
It should also mentioned that our linking techniques and methodology have past the scrutiny of many of the largest companies in the world. Our techniques are ethical, white hat and proven to work.
We wish Mr. Lavi all the success with his business.

SEO DONE WRONG by NATIONAL POSITIONS

Maybe most people do not know how SEO works or how ranking and keywords affect a website's popularity. Maybe most people do not know what PageRank is and how it's calculated and how important it is for a site to have its in-bound links coming from a high page rank site. But i do. When your company told me they are going to have a link building campaign, (which was the main reason we started doing business), you told me on the phone that the links will be from sites from Page Rank1 and above.
When the reports came, almost 90% of the links were from sites not even ranked or indexed by google. They were simply link farms or sites made for soul purpose of selling links to your customers. the other 10% were from sites which they DID NOT EXIST! I call that an unethical business practice. it doesnt matter how much our budget was. what matters is that you agreed to do a work and the work done was far from what was agreed initially.
I am not lying when i state that i was scammed by your company. it's the truth and the facts are there. I am really sad to see how your company is taking advantage of hard working men and women and then accuse them of having "high expectations."
your company DID scam me and DID take my money with no result and my ranking actually went DOWN.
These are My experience with your company and i do NOT recommend National Positions to anyone.

Our company, a reputable internet marketing company, takes every complaint extremely seriously.
We have been servicing websites since 2004 and have won several awards from numerous organizations including the Inc500 magazine and the Los Angeles Business Journal.
At the time of this posting, National Positions has in excess of three thousand Google organic positions 1,2 and 3 for its clients. National Positions also provides its services to major Fortune 1000 as well as many prominent industry websites.
Mr. Lavi contracted our services in May 2011. The keywords to be optimized included: suits, mens suits, business suits, wool suits, designer suits etc. There were 24 keywords included in this list. His s****.>
All contracted deliverables were met, plus additional free services. We had limited success on some of the keywords rankings in four months at which stage Mr. Lavi cancelled the services in August 2011.At the time of cancellation, Mr. Lavi did not request his money back. Subsequently, Mr. Lavi took his issues to his credit card company twice and his credit card company ruled in our favor both times.
Unfortunately Mr. Lavi has taken an alternative approach now by writing scathing reviews of us and demanding his money back. He is also bent on destroying our reputation. What a shame!
We believe the core of this issue lies in Mr. Lavi expectations re better results within the 4 months. Unfortunately, with SEO, it is rarely possible to predict the time it will take for rankings to improve. We believe with more time (and probably a bigger s****.>
