In May 2014 we received a letter from Ocwen/Freedom Mortgage that said they had not received our mortgage payments for Jan, Feb and April. The payments were submitted online by my husband directly from his bank.  Up until that time my husband made our mortgage payents by check.

When my husband called Ocwen regarding the whereabouts of those payments he was told an online account was never set up w/Ocwen therefore claiming they never received those payments. Three-months of our mortgage payments have somehow mysteriously disappeared and are unaccounted for and for nearly 1 1/2 years we've been trying to locate that money.  

Months passed before we were notified by way of a delinquency letter that our loan was in default.  A legal assistant from D.G. Weber and Associates named Brian Hope contacted us by phone and told us he had been appointed to help us with this very serious matter. In exchange for his legal assistance we needed to agree to pay a retainer fee totaling close to $4k. 

Because my husband and I were making futile attempts to deal one-on-deal with Ocwen   ourselves for several months to resolve this matter, and getting no where, we thought this might be our next best option--to have someone from a law firm step in an represent us.

Brian instructed us to complete some documents online which included a request for mortgage assistance and a hardship affidavit which he, in turn, would submit to Ocwen.  Ocwen declined the online documents saying they required a hard copy of these documents. We received these documents in the mail, completed them again, and mailed them back to Ocwen.

When we contacted Ocwen to get an update on what was being done re the RMA/Hardship Affidavit we were told those documents had been "misplaced" and we would need to complete them again. Our frustrations only increased as my husband and I we not being given any updates regarding our situation w/Ocwen. 

I made numerous calls and submitted countless emails to D.G. Weber asking for updates.  Many of my questions continued to be unanswered.  I had to continuously plead with Brian for updates.  I would receive occasional one or two sentence updates but nothing very specific or concrete---none of my concerns were being addressed. 

In my dealings with D.G. Weber, over the long haul, I wound up speaking to more than one person as our file/documents were being handed from one person to another. Everyone seems to be passing the buck and we are no further along in resolving this nightmare than when we first started. 

For the past few months my husband and I have been in communication with a legal representative from D.G. Weber named Sandra Pechonka.  She's been our single point of contact...our liaison...with Ocwen. She has spoken with several people at Ocwen claiming to be a relationship manager; the latest being someone named Victoria. 

Back in November/December 2014 Sandy told us Ocwen would be sending us some documents for a trial loan modification.  We received and completed these documents and had them notarized and sent them back to Ocwen immediately. 

We were thrilled to find out we were approved for the trial loan modification so long as we met the terms that stipulated we would need to pay a specified amount for 3 months. We were also told we were approved for a "fixed" interest rate for the life our our loan. 

Imagine our shock and dismay when Sandy told us Ocwen "made a mistake" in the original trial loan modification agreement and it would need to be revised.  Due to their mistakes and negligence, they have had my husband and I jumping through hoops for over a year. 

Since this whole fiasco started my husband and I have not missed paying a single payment on our mortgage.  In truth, we never missed any of our payments that Ocwen and Freedom Mortgage say we have.  That money my husband sent for those "supposed missing months" is in an Ocwen suspense account somewhere.  

The problem is Ocwen has too many branch offices in different states.  We strongly feel one of those branches has those [missing] mortgage payments.  In our most sincere efforts to play catch up we have submitted in addition to our regular monthly mortgage payments, double payments and even a one-check of $4k to cover what they say we owe and they still say we're behind.

Currently, we are being told by Ocwen, through Sandy Pechonka, that our file has been flagged and is under review.  Supposedly, we are now being informed that we were NOT approved for a loan modification afterall, it was a MISTAKE, as we are NOT 90 days delinquent in our payments! 

Both Ocwen and Freedom Mortgage have continually sent us delinquency letters telling us we're 3-months behind in our mortgage, yet at the same time we are not 90 days delinquent which does not qualify us for a loan modification.  That doesn't make any sense.  My husband and I thought the idea behind a loan modification was to make our monthly mortgage payments more affordable.

Prior to being told we'd need to make 3 consecutive "trial loan modification" payments of $1,703.28 for 3 months before the the modification beame permanent, we were making monthly payments of $1,591.90.  What Ocwen is asking is that we continue to pay the higher "trial" amount--even though they say that trial modification was reversed and we weren't approved (due to their mistake in the original agreement--until our file is reviewed

They are dragging this out and at this juncture we're never going to resolve this.  Ocwen has us jumping through hoops and essentially we're the ones having to pay for their mistakes and negligence.  There is something seriously wrong and shady about this company.  

They claim "helping homeowners is what we do," but the only thing they've managed to do is put my husband and I in a serious financial bind.  I'm at the end of my rope and the stress of having to deal with this situation where there doesn't seem to be an end in sight has had an irreversible impact on my emotional health. 

My husband and I are in our early 60s. He's a 22-year Veteran of the Air Force.  We can't even consider refinancing for a VA loan or a reverse mortgage because we can't get out of this mess with Ocwen and Freedom Mortgage.  Neither of these two companies are on the  same page as we gotten nothing but conflicting and contradictory information from both.

Someone needs to look into the questionable practices of these two mortgage lenders.  MY HUSBAND AND I NEED ANSWERS AND DESPERATELY WANT TO PUT AN END TO THIS NIGHTMARE ONCE AND FOR ALL!!!!!!!
