My husband is a Veteran and I'm Disabled.  Recently we had 3 expensive Appliances all die on the same exact day (what are the chances) and we HAD to replace them immediately so we fell behind on our Mortgage because we do not have "extra" Savings sitting in the bank.  We fell behind 2 months on our Mortgage.


We know that Ocwen starts Foreclosure on the 89th day if you do not make a payment and we were at 60 days already going on a Third we made a rush Ckg ACH payment and it was not able to go thru because I only have ACH on my Savings Acct....I called Ocwen the very next morning when they opened and told them I mistakenly gave them our Checking account number and theres no ACH set up on that account only on our Savings...and Ocwen said they would not take a Savings Account Cust Svc told us to go to CVS Money Gram and pay with cash and we immediately did that...

10 days went by and we thought the Cash Payment went thru fine.....then one morning I woke to find a statement from Ocwen that did NOT show our payment...I immediately called them and their recording did not state the payment either...I spoke to Cust Svc again and Poota told me that the Cash Payment was REFUSED and SENT BACK.... I asked why and she researched and said it was an OCWEN ERROR....and we should go to CVS Moneygram and collect our money back (she gave me a "returned code") and we should resubmit the payment again and it would be accepted.

I asked will it be accepted from the original day that we actually paid it on May 17th or will it be posted as of today May 25 ??  She said it will be accepted as of today (which makes it the 85th day now...very close now to Foreclosure).....and 10 more DAYS OF INTEREST....she said she can not do anything about refunding interest and she connected me with the Relationship Manager after much discussion...

Fazon the Relationship manager said the 10 days differerence will not matter because the loan is not a simple interest loan there is no daily interest rate on my mortgage....I find that hard to believe but I just don't know enough about the different types of loans to argue the point I was just glad to find that I wasn't going to Forclosure..but they were not making it easy on us to catch it up...we are only 4 days from Forclosure....which upsets me terribly and being Disabled ...this is not a good thing for makes me sick.....we are trying so hard my husband is working everyday... 12 hours a day to make enough money for us to catch up and we are not children anymore this is a difficult time for us.....

So my husband ran down to CVS to collect and repay the money and we have to pay ANOTHER FEE to Send AGAIN.....a FEE for the BOUNCED original payment and we lost the first FEE we paid to send it the first time......Ocwen refused to refund ANY of those fees or fix the Date of Payment and any Interest that might have accrued due to OCWENS ERROR....

I requested a Letter from Fazon stating the ERROR was theirs and that it has been Corrected.....he said he'd see what "The RESEARCH DEPT" could soon as I hear those words my hair stands up.....I said I DO NOT want to have to write letters to the Research Dept to collect what YOU OWE ME for YOUR ERROR.......I am basically PAYING YOU to MAKE MISTAKES ON MY ACCOUNT at A CRITICAL TIME when we are desperately trying to catch up....and he said we may have to contact them to get a letter......he will do what he can...and he said he would call me as soon as the "corrected payment" is Posted.....(lets just say I won't hold my breath hearing back from them)......I said the PAYMENT was NOT in ERROR....OCWEN IS....

My home is a very nice home in a very nice neighborhood and they every time we've been late due to my illness they have tried to make it impossible for us to catch up by non communication...making me write to research depts....making me pay huge amounts of money to catch up my loan because they refuse to take one month payment they want ALL the Past Due Money or NOTHING.....they WANT MY HOME .......and we are fighting to keep what we've put our entire life savings into.....I'm SICK of having to FIGHT and having to PAY THEM TO TAKE MY PAYMENTS....I was sick once and had to pay them 10,000 to save my home... I understand if you are behind you have to catch up but they DO NOT make it easy for you to do the Right Thing.....they put as many hoops as possible in place for you to jump thru just to make a payment.

Because of THEIR ERROR I'm out MORE MONEY and I dont' have money in the first place.... thats why I'm behind in the Mortgage Payment in the first place and they tell me there is NO INTEREST for the last 10 days....which, their error caused me to pay now at almost a Foreclosure Stopping Point thank GOD I called and checked today or I never would have known it was Refused......I STILL DON'T BELIEVE THEM about the Interest.... if it was me owing THEM they would charge me for every SECOND....I have over $2000 in FEES just because they've mailed me paperwork over the past year......thats $2000 dollars charged to ME for Mailouts that I did NOT ASK was Certified Mailings that DUPLICATED regular Mailings and They charge me for Every One of them.  But paying my 10 days of Interest for THEIR ERROR back to me or Paying for the FEES thru MoneyGram that they are costing me.......OH NO...there is no interest accruing according to them and they don't refund fees.......and thats the end of it...what can a person do..NOTHING and THEY KNOW IT.

Well my husband just called the payments been resent...lets see what happens next....

Understand this and understand this correctly...your husband being a veteran HAS NOTHING TO DO WITH THIS!!!!  You being disabled has NOTHING to do with this!  You are just pulling out all of the sympathy cards as a smokescreen when the FACT is it was YOU GUYS who caused this by being TWO MONTHS late making payments!  You not having any savings or emergency fund is not caused by them but by YOU.  All of this could have been avoided by you guys not getting TWO MONTHS late in your payments. 


NO RIPOFF HERE -- Complainer caused this by failing to make payments for two months, thus turning on the collections/foreclosure machine.
