After paying in good faith via PayPal for a "brand new" eBay item + shipping, I was sent the wrong item (and not new) by a Hong Kong seller. After notifying the seller of his goof up, he insisted that I pay the return shipping back to Hong Kong before he would issue a refund. Since the shipping the wrong item was not my fault or responsibility, I refused to pay return shipping for something I did not purchase. Why should I be financially liable and penalized for the seller's error? Besides, if I paid the return shipping I would actually be losing money from this failed eBay transaction - despite the refund!

So I decided to escalate the dispute to PayPal's "Resolution Center".

In my view I was the injured party. I had paid the full price, and received nothing in return - except the added hassle of repackaging the item, taking off work to go to the Post Office and paying to send it half way around the world. Ridiculous. So I proposed that the seller have the item retrieved by UPS, FeDex or DHL.

But PayPal's deliberation was swift: they sided with the fraudulent seller stipulating that I should pay for the return shipping.

Apparently PayPal is biased towards Vendors/Sellers. The moral of the story is: If you buy something on eBay and receive the wrong item or not as represented and insist on a refund, YOU WILL LOSE MONEY. This is a completely hostile and antagonistic ecommerce transaction strategy for innocent consumers acting in good faith - and PayPal Resolution Center Policy SUPPORTS IT!!!

Here is my experience similar to the complains against PayPal:  Part I I purchased an item via ebay; paid via PayPal... and the item received was not as advertised.. a bait and switch for a cheaper model.  I did a "buy it now" for a external hard drive that had features that were not in the model I received.  I filed a dispute and the seller declared I got what was offered=LIE! I refsued to acce[pt the seller's lie.. but Paypal closed the dispute anyway.

Part II: I then filed a complaint with the State Attorney General's Office of the listed business address of the seller.. the one that PayPal "verified" and after diligent research the Ohio Atty general's investigator called me (nice touch.. other states don't do that) advising that the address used on shipping label was bogus.. that no such company existed in Ohio according to tax or other records.  yet Paypal declares that all was correct in their records and the seller was left to continue with impunity.

After disputes close or the 45 day dispute window closes ebay absolve all responsibility for such devious sellers.

So to assert that complaints saying PayPal is a fraudulent operation is correct,  As they do not verify the seller as legitimate.  And once closed they will not re-open.  If you call they tell you to file with Attorney general's but in my case even that is a non sequitur.

Ebay says when asked via telephone (as their system blocks any on line dispute filing that is for an item over 45 days) they just say all we can recommend is you file with US federal Trade Commission which is also a waste of time as they only catalog, they do not process as complaints or investigate,  G-D Ebay!  G-D them all for running a crooked operation immune from any legal sanctions.  And now I understand Rev Wright... he got screwed by ebay!

You are a bit misguided in your remarks

I understand your point of view, but some things do happen.  As a seller (and buyer alike), I have stood on both sides of the fence.  You must understand that accidents can and will happen.  It is not intentional considering sellers don't like any more hassle than do buyers when it comes to a sale.

Buyers in eBay always have the upper hand since they can leave negative feedback, file disputes, and usually get their way pretty easily.  You have to give the seller credit as they were immediately ready to help you (sometime difficult to find these days). The selling process cost sellers a lot of time and money as well.  I personally find myself losing money due fuel, packaging materials, and other costs associated with being a seller.  Once in a while I will have a buyer who pleads that they "bought the wrong thing" and wants to return it.  Once again; I am stuck eating listing fees, shipping costs, and packaging materials.  Don't even get me started with scammers who file false claims and win their money back through Paypal (personally have lost $1600 this year alone).

Honestly, if you want to get the item you paid for or a complete refund, then just eat the nominal shipping charge and return it.  What I cannot understand is you have invested so much time and effort to save yourself $5 for shipping (referring to this Ripoff Report and the Paypal claim), when you could have simply just sent it back and got the process corrected.  Many times if you treat the seller with the same respect and dignity you expect, they often will throw in a 'little something extra' to make it worth your while.  It is the pompus jerks who make a bad situation worse, is when sellers will fight a buyer every step of the way.

As I mentioned before:  I have been buying and selling on eBay for nearly 12 years now and have seen just about every situation one could imagine so I see your side, but I think you are making a simple situation more complex than it should be.

Paypal Does not Help It's Users

I purchased a laptop from a seller,who had an auction going, but no bids. I asked him if he would take less for the item, and he said yes. I sent the $$ immediately via paypal. The fool did not stop the auction, and people started to bid on the laptop. I sent numerous emails to the seller telling him I had already paid for the laptop, so he better end the auction, and explain to the bidders.

When the auction ended, he had a new buyer for more money, and sold it to that buyer. Meanwhile, I have paid for a laptop, which I don't have. I contacted the seller, and he was very mad at me, said that ebay and paypal took out so much fees, that he did not have the $600. to refund to me. I told him when he got paid for the computer from the new seller, to send the money. He said he would, but did not. I reported him to Ebay, and paypal. Ebay said they restricted him, but they can not tell me how. They suggested that I make a police report both in my town, and in the seller's town. I also called the FBI and they told me to make a report at www.ic3.gov, which I did.

The seller then indicated to paypal that he would give me a refund, but paypal made me wait over 2 weeks to see if the seller had the money in his bank account, which he did not. They then ruled the dispute in my favor, however, I have no money refunded. Paypal said they will try to get the money from him.

Lucky for me, I am in law enforcement, and contacted an officer in his local police dept., gave him the info, and after about 5 emails, got a police case number. I found the seller's address, parents name and phone on the internet, and gave them to the officer. The officer called the seller's home, and his father (seller is 27) said that his son told him that he had given me a refund. I explained to the officer that the refund did not go through, because there was no money in the account. Now the officer is following up.......I told the officer to explain, that my next step is to file suit, and it will be for the $600., plus an airline ticket from L.A. round trip, plus 2 days hotel, food, rental car, and distress, which will come to alot more than $600.

The seller's father wanted to know if I wanted the computer (don't know if ebay stopped him from selling it to the high bidder of the auction), but I said no, I am afraid that he may have screwed it up inside or something. I don't trust him at all.

I have to wait and see what the police in S.C. can do for me, or then sue this person. Paypal drug it's feet, and has not helped at all.

Paypal makes you feel safe, but you are not at all. SO PAY ATTENTION: AFTER USING PAYPAL FOR 5 YEARS, THEY DID NOT HELP ME WITH THIS FRAUD. I HAVE HAD TO DO ALL THE LEG WORK AND REPORT MAKING MYSELF. THEY GIVE YOU THE SAME PAT ANSWERS WHEN YOU CALL THEM ON THE PHONE. IT IS A REAL JOKE. NOW EBAY REQUIRES YOU TO ACCEPT PAYPAL, BUT ON MY LISTINGS, I WRITE, NO PAYPAL. I WILL NEVER DEAL WITH THEM AGAIN.

I am out $600 and they don't care at all. The seller got away with fraud, and paypal let them. Unbelievable.
