On January 21st I was at a stop light and my vehicle was hit from the rear. Their was no damage to my vehicle.
I only received a claim form from the insurance company dated January 23rd.
I was taken to the hospital by ambulance for neck and back injury. An x-ray was taken of my neck. I had severe neck and back spasms.
I was given a prescription and told to follow-up with my doctor. I saw my doctor on January 24th and received a shot for the spasms. An x-ray was taken of my back. I received a different prescription at that time because I was not getting any relief from the first medication
On February 14th and MRI of my Thoracic Spine and Lumbar. The results and all medical reports and medications that I were taking were sent to the insurance company.
I started calling Unique Insurance in April to find out what was going on with my case. I spoke with one claims adjuster who was very rude. She gave me the name of the adjuster that was supposedly handling my case.
I've called him several times and my calls were not returned.

I would just like to say that it is not impossible to sustain injuries when there was no damage to my vehicle.
These are not imaginary injuries. I can only tell you that I saw the vehicle approaching and before I could even think to react I was hit. Maybe I tightened my muscles for the impact. Like I said before I have doctor bills and x-rays as my proof.
I was informed by my insurance company State Farm that Unique Insurance Company would be responsible for my pain and suffering. Also that I should not do anything to jeopardize them from being reimbursed.
Maybe small claims court is the way to go.

Why is Unique Insurance Company still in business

I don't understand how this Insurance Company can remain in business. There has to be a way to get them to pay or close them down.
I have been told by my insurance company that more that likely I will not be paid for my pain and suffering. I do know that my insurance company State Farm will be going after them to pay my medical bills that they have already paid which are in the thousands.
I believe that they are getting away with this because people get frustrated and just give up. I have no intention of giving up whether I'm compensated or not.

Gwendolyn, what insurance company do you have?
Funny, and suspicious on your motives, that your car had no damage at all but your body is suffering?
IF you had insurance it would be better for you to let them fight for the claim. The more you contact and say to the opposing insurance the less your insurance can do to help you.

Look in your yellow pages...you will see TONS of ads for attorneys who specialize in cases like yours...Most do not charge up-front...they work on a commission of any settlement.

As I said earlier, just sue the guy and let HIM deal with his silly insurance company. You're not obligated to deal with them directly.

I failed to mention that the person driving the vehicle that rear-ended me worked for the insured party and was insured through him.
The person driving the vehicle received two tickets. The driver stated to the police that his brakes did not catch.
There is no question that the driver was at fault. I'm asking that the insurance company pay for my medical bills and pain and suffering.
I am still having muscle spasms. I was told from my doctor that it will just take time.

You didn't mention if this insurance company is yours or the other party's. It sounds like the accident was the other person's fault. You aren't obligated to put up with the bureaucracy of somebody else's company. Just sue the driver in small-claims court and let him or her wrestle with the insurance companies to get reimbursed.
If you are filing a claim against your own policy because it was a hit-and-run accident or some other reason, you might need a little reality check: There was no damage to your car so let's be honest--just how bad can your injuries be when your bumper isn't even smooshed? You are going to run up your rates or possibly get your policy canceled with this nonsense.
