In late 2009 I requested a new (local to me) number from Virgin Mobile, since I had moved from the original location where I resided and first got Virgin Mobile service.  Within the first week or 10 days, I began receiving phone calls from a payday loan store looking for somone named Gloria H. and I kept telling them that she no longer had this number - it is now mine and I have no idea who she is.

After 2 or 3 months of me telling them to stop calling, they did.  Then a few months later, I began receiving phone calls from a debt collection company called CCA, looking for this Gloria H.  When they called my cell number, all it was was a recorded message... "if you are Gloria H--- please return this call".  All automated. 

After the third or fourth call in as many days, I called the number back and told the person who answered that I was NOT this person and I told them how long I had this number.  They said they'd remove the number from their call list (obviously, Ms. H. had not repaid her payday loan and defaulted). 

After a week or two, the calls started again.  Again, I called them back - and this time the man at CCA was very rude, insisting that I WAS Gloria H. and if I wasn't, then I knew where she was.  I told this jerk in no uncertain terms that I was NOT her.

So I then contacted a law firm that I knew about who went after debt collectors who violated the Fair Credit Act.  They said that they could get me at least $1,000 for the harrassment by CCA.  The court case got rescheduled a couple of times.  Then I went online to Virgin Mobile to get my phone records, only to find to my dismay that they only go back 60 days!  I then emailed them to get my phone records for June & July of 2010 - only to receive 2 days later an email that I would have to call their toll-free number and request a form, which then had to be filled out and sent in by a police department.  WHAT THE F**??? I emailed back and told them that this is NOT  criminal case -it is a civil case, and why can't I have my records?  then they emailed back 2 days later and said I could look up the past 60 days on line, or call the number and request the form.  I wrote back and told them how lousy they are and I will lose the court case because I cannot provide the phone records.  See, CCA is claiming that they only called my cell number ONCE - which is bullsh**t.  But I don't have all the calls on my phone's call log anymore - just the last one in late June.  Then today I got a call on my cell from Virgin Mobile - almost didn't answer it because it only said "unavailable".  The heavily-accented woman kept saying the same thing, except NOW they say I can get my records -but it'll be at least 2 weeks.  GRRRRRRRRRRRRRRRR.  The case is lost - court was today.

Virgin Mobile cost me at least $1,000 in a lost case.  I am now looking into another cell phone provider.

The attorney's office is in LA... the hearing was to be in Denver - and I live in VA!  The attorney kept telling me that the judge required my presence in Denver since CCA was saying they only called once and my suit was filed because I claimed that they called several times (which is against the rules!).  To keep me from having to go to Denver I had to provide the attorney's office with enough details (dates and times of phone calls) however I didn't know this til the case had been continued TWICE.  The suit was originally filed last July!! 

So here it is, February, and when I asked Virgin for my records after not being able to pull up anything older than 60 days, I get the runaround from them.

Yes, the attorney's office sucks - and I do NOT recommend Krohn & Moss.

  What kind of lawyer did you hire?   It's hard to imagine even the most inexperienced lawyer not having the evidence in hand before getting a court date.
