So that is where we were at. I now need to come up with $11,036.64 plus attorney's fees (but the attorney will not give me those amounts.) the $11,036.64 will be added to the $10,882.52 that Wells Fargo Home Mortgage has been holding in a suspense account for me, for nearly a year, not gaining one cent of interest by the way, while they continue adding interest and late fees to my account. If I pay the money "owed" I can stop the sale, but I have a hunch this vicious cycle will never end, I don't think there is a real way out. It simply doesn't exist. Wells Fargo (and Freddie Mac) will stop at nothing to steal my home! By the way the sale date is one day after my oldest daughter's 10th birthday, 5 days beofre my youngest daughters 2nd birthday, 7 days before thanksgiving and One month and Seven days before Christmas. "Wells Fargo and Freddie Mac, the "gift" that keeps on taking!"
Letter to News Media in my Community:
Hello,
My name is Michelle S, I am a homeowner, but not for long, Wells Fargo Home Mortgage is stealing my house. please read this e-mail in it's entirety, please visit the links that I have shared. I am not alone, the "mortgage crisis" is being misrepresented.
Here is a copy of the letter that I have written to Congresswoman Lummis. I will be e-mailing and mailing it to her today along with links, as well as at least one story that mirrors mine (the links go to HUNDREDS more stories just like mine.) And a "tell all" from a former Wells Fargo Home Mortgage employee, that explains why I am getting nowhere fast. There is a sale date set for Nov. 18th, 1 day after my oldest daughter turns 10, 5 days before my youngest daughter turns 2, 7 days before thanks giving and 1 month and 7 days before Christmas. Please, read my letter, please visit all the link I am providing. Please let the public know this mortgage mess is not all about people who got sucked in to a mortgage they couldn't afford. Most of the people like me fell into a hard time, lost a job, got sick, something happened, they fell behind, and not even by a lot, and now it has been made impossible for us to redeem ourselves and keep our homes. Please, look into this. My home may not be able to be saved, but maybe you can help someone else, maybe the media can put a stop to all of this once and for all.

Letter written to my Congresswoman:
I am a wife, a mother of four biological children and two (now adult) step sons, I am a former business owner and until November 18th, 2010, I am a homeowner.
I am writing to you today because my husband and I are feeling victimized and taken advantage of by Wells Fargo Home Mortgage, N.A. In the fall of 2008, the construction company my husband and I owned began to struggle pretty badly, and fell behind in a couple of mortgage payments. We began to do our best to continue paying our mortgage and get caught up again, when we fell on even tougher times and missed about two payments. To make a long story short, on June 22, 2009, we stopped an impending sale on our home by paying $8,423.261 to the foreclosure attorney(CMS Legal Services) which was the amount they (CMS Legal Services) had told me that very morning that we had to pay in order to stop the sale. On July 2, 2009 CMS Legal Services sent me a refund check in the amount of $221.60, because we had paid too much to have our loan reinstated. this amount never made sense to us, and they would not break it down for us, according to this number we failed to make 6 months worth of payments plus attorneys fees, we did not miss six months of payments
When my husband went to make our mortgage payment at our local Wells Fargo, they would not accept his payment, he was told to come back in a few weeks, because the reinstatement of our loan could take some time. He came back in a couple of weeks, and we were told we still werent in the system and to come back. This cycle repeated one more time, so we called Wells Fargo Home Mortgage to find out what was going on. We were told that our payments would not be accepted until we got into some sort of program. I told them I was not interested in a program, I only wanted to pay my mortgage. We were told that is not how it worked and in order to have our loan reinstated their policy was that we get into to some sort of (loan modification) program. We were then told to fill out mountains of paper work, and instructed that Wells Fargo Home Mortgage would not accept any of our payments until we were in a program.
n October of 2009, we were finally approved for the HAMP program, but were told our payments would start Jan. 1, 2010, we were not to make a payment prior to that date. We were also told that we were not to pay one penny more than the modified amount, $1,074.67. We made our first modified payment to Wells Fargo Home Mortgage, via Western Union on December 29, 2009, for the January 1st payment. We made our mortgage payment every month via Western Union, and began getting letters in the mail in the spring of 2010 saying that we were no longer enrolled in the HAMP program, because a specific years taxes had not yet been filed. When we called to find out what was going on, we were told that we needed to re-apply for a different modification, we asked if we could just pay our mortgage, we were not interested in a program, and were told that it is their policy that in order to be reinstated we had to be enrolled in some sort of modification program. Month, after month we filled out the same paper work, because in expired after 30 days, month after month no programWe continued paying $1,074.67until we received a letter dated May 21 of 2010 saying that our loan was being rescheduled so we could have a fresh start in that same letter we were told we would need to make a payment of $2,024.50 prior to May 31, 2010 (Junes payment) to enroll in this program. But after making the payment, if we were not approved, they would send back the initial payment. Because we made a payment near two times the mortgage payment we were already making, we didnt make another payment until the end of June (for July), on June 7th, we received a letter saying we were not approved because we did not provide Wells Fargo Home Mortgage with enough information. We always provided what they asked for. It was around this time we learned we were still in active foreclosure! Since paying to stop the sale of our house, we had been in foreclosure and nobody told us until this summer! We found out not only had every payment we made to WFHM since the beginning of 2010 had not been applied to our mortgage, but instead a suspense account, but we also learned that we were now in default by not paying our full mortgage payment all these months, because we were no longer in a Modification Programnot one person had ever told us that our monthly payment was to return to normal after we were kicked out of the HAMP program.
I will digress to the fall of 2010, we now have a sale date of November 18, 2010. WFHM has refused our September and October mortgage payments, and now wants $11,036.64 plus attorneys fees accruing interest, late charges, and other costs, on top of all the $10,882.52 that they are holding (interest free by the way) in a suspense account. We were baffled as to how these numbers are even possibleuntil we realized WFHM will sell my home unless I pay them the mortgage for the months THEY told us not to pay our mortgage as well as the difference between the modified loan amount through the HAMP program and our actual mortgage payment.
Madam, this is injustice! How many families are going through this same thing. Wells Fargo will stop at nothing to take my home away, we followed their rules, we paid more than we owed to get our house back once already, and now they are doing this again.
Our options are limited and drastic at that, I implore you to help us and families like us who are victims to our mortgage companies. These companies have to be stopped; my husband and I are not lowlifes who dont make our house payment and live here rent free until they kick us out. We have done everything they ask and have only moved backwards.
