Formal Complaint Wells Fargos intractable tactics and callous dealings regarding our home loan. Disregarding our homeowners rights and changing facts to flatly refuse our numerous requests for any consideration to prevent foreclosure. I have made complaints regarding their fraudulent practices and procedures and found all federal programs provide no penalties against their illegal actions. The HUD counseling offers merely a toothless tiger that has no influence or effect on the lender. I am pursuing legal actions against them for numerous failures in abiding the rules of the HAMP program and our rights under RESPA and TILA.

As we await the next correspondence from Wells Fargo, we try to understand why the loss mitigation department has rejected us again for the HAMP program, They cited "excessive forbearance" - All the while  they have misapportioned our payments and misrepresented their intentions and procedures. We have been told untruths regarding our payments made from February 2010 through November 2010. Although we have demonstrated a sincere effort to meet our financial obligation and have clearly shown our desire to keep our home, we have found an uncooperative lender unwilling to find any solution.  Even as we have demonstrated good faith and made every payment, we continue to accrue arrearages, fees, fines and penalties without consideration or explanation. Our payments have not been applied to our loan but have been held in some frozen account without any explanation of what is being done with them.

Our situation is deadly serious, but sadly not unique. Due to lengthy unemployment, we fell behind on our property tax payments in 2009. With little warning, Wells Fargo paid the taxes in January 2010 and established a TAX ESCROW account that increased our payment from 1453.81 to 2745.99. When we called to inquire, they offered a LOAN MODIFICATION TRIAL. This started a spiral that now leaves us struggling to keep our home. This trial offer accepted the lowered payments but continued to acrew arrearages even while we followed their instructions to the letter. Now the consequences of their actions have put us in a much worse financial situation with over 13,000.00 in arrearages. The stress of our current financial crisis caused my husband to have a stroke in May 2010, require brain surgery and since become disabled.

Now, with a disabled husband and a school age child, I am left to fend for myself with WFHM.  Regardless of monthly payments, overwhelming hardship and sincere efforts to work something out, Wells Fargo Home Mortgage has again decided that we don't QUALIFY for any consideration. They have cashed every check but not applied the funds to our loan. They have also reported us to the credit agencies as having not made a payment since June 2010 further damaging our ability to get any other loan. Over these last 11 months, they have caused us tremendous pain and suffering trying to protect our home from their predatory practices. They are forcing us to take legal actions to protect our rights and homestead. We are hoping to be included in the Harwood Feffer LLP class action suit against Wells Fargo Home Mortgage for their unfair and illegal mortgage practices. They are harming families without any regard for the outcome of their actions.
