On June 28, 1998, Daryl Kanuho and I had placed a sectional and five piece Willie Taupe table and chairs on layaway. We wanted the one in stock, but due to them being on layaway, Charlota, who is the manager, said that it was better for her to order us a new one since we did not need them until end of September.

On September 30, 1998, Daryl picked up the sectional and table and chairs. The table is made out of wood, but the one she had in her warehouse did not have the knots in the wood, like the one she wanted Daryl to pick up. Daryl told her that he did not want the table due to it having the knots in it. Due to our situation of moving into a new home that day, Charlotta advised him to take the table and she would or us a new one. Charlotta advised us that it would take 4-8 weeks to get a new one, we agreed to wait.

At the end of October, Daryl called to see what was happening with the new table. Charlotta said it would take longer. In November, I called again. Charlotta said she would have to call the vendor and get back with me. All that was said was it was on ordre for the next shipment.

We waited until February 7th, Daryl and I went to Wholesale Furniture. They could not find our paperwork. So we came back to our home and called with all the invoice numbers. Doris, salesperson advised me that she would have Charlotta find out what happened with the order. Of course, we received no call back.

On February 9th, I spoke to Doris. She claims that she was checking with the vendor and she would cal me back. On February 10th, I called Doris again. At this point, she told me that table had been discontinued, but the vendor may still have one in stock and she would call me back. I explained to her if she did not call me back, I would have to find help in getting this matter solved.

I did not hear for the Wholesale Furniture Company since then. On March 1st, I called the BBB and asked them for help. They had me feel out paperwork for the claim against the company. They had said they agreed with me that we should return the table and get our money back. Wholesale Furntiure never responded to them either. They sent me information on an attorney. He advised me due to the amount of money involved to try to settle it through small claims court first due to large amount we would have to place down for him to work on the case.

So I filed a small claims suit against Wholesale Furniture. On August 6, 1999, the judge ruled in our favor because no one from Wholesale Furniture showed up again.

To this day, they will not talk to me. Now I have to file more paperwork in order to place a lien against the company to reimbursement of the cost of the table and all money spent filing against them.
