I entered into a contract with ADT Security Services for alarm monitoring on a commercial building I own in 2008. The initial contract was for 3 years and then after that it went month to month.

I had the monthly payment automatically taken out of the bank every month. I never thought anything about it until February 12, 2014 when I received a "Final Statement of Your Account" in the mail for $467.68. It said the service was cancelled effective 01/20/2014 and if I did not pay immediately it would be forwarded to a collection agency.

This was the first and only notice I received from ADT. No phone calls and no letters. I contacted them immediately and was told that debit card had expired in September 2013 so no monthly payments had been taken out. So I owed a balance of $227.74 and a remaining balance of Contract due of $224.24 plus sales tax.

I explained that I never received any phone call or notice from ADT until 02/12/14. The ADT man told me I owed the balance for the months that they were not able to withdraw money from my bank account. He then explained that the other balance due for "Remainder of Contract Due" was for January 2014-July 2014. I explained that my contract specifically says that after the initial 3 year contract it then reverts to a month to month billing. He said that was not the case because I have a commercial account and that automatically renews each year for one year.

I explained that I was looking at my contract I signed and it specifically says:

"TERM OF CONTRACT: The initial term of this Contract is for three (3) years. Our alarm monitoring and notification services will begin when the equipment is installed and is operational, and when the necessary communications connection is completed. This Contract will automatically renew for successive thirty (30) day terms unless terminated by either party's written notice at least thirty (30) days before the end of the then-current term. If terminated, this contract ends on the last day of the then-current term."

 

I even read it to them and his only response was that I either paid it or it was going to collections. I have excellent credit and did not want it to go to collections, so I was strong-armed into paying $467.68.

 

I will never use ADT, nor will I recommend to anyone that they use ADT. It is one big scam!
