For Chrsitmas my wife wanted an Apple Ipod touch 32 gb media device. My research showed that there were first and second generatin devices. I seached only for second generaltion devices and was taken to the B & H web site.
I have herad horor stories about New York Photography stores but B & H seemed ok. The web paged decribed a second genreation device.
I ordered Apple APIPODT32 iPod touch 32GB Wi-Fi Media Player w/ January Software Update in November thinking that this would get me the latest and greatest software when it was released. Using paypal gave me confidance. I printed out the description.
After Christmas my wife informed me the the unit was a first generation device and that a software upgrade would cost $30. I emailed and called B & H. I was told that I received what I ordered and that they were done. I was also told that there could be no return. Paypal did not help either.
I checked the B & H web site. Now in January the description says 1st generation. Obviously people had complained. This smells bad.

I sound like an employee? How so? Because I have made substantial purchases from B&H and have received good service?
Did you notice that I live in Chico, California? B&H is located in New York, that's quite a commute, isn't it?

I dont belive a word you just said. You CLEARLY sound like a B&H employee trying to come across as a customer and failed. If you did any shopping at B&H you would realize that they have the worst customer service and are always overpriced.
To the customer who got scammed: I would always order an iPod directly from apple.com that way you know exactly what you are getting and not B&H's mistakes. They have errors everywhere on their website and they never fix them or fix the issues at hand.

We're sorry this customer is dissatisfied. The item he purchased is now discontinued but its description on our web site clearly stated, "Apple iPod touch 32GB Wi-Fi Media Player w/ Jan. Software Update 1st Gen." Apple's January Software Update, which takes full advantage of the touch's WiFi capabilities, was included. While we regret his dissatisfaction we do not believe we erred in any way and do not believe this unsatisfactory review is deserved.

B&H is a very legitimate business. I spent over $10,000 with them in 2008. In fact, when I needed to send something back they had shipped out the replacement item before they got the defective one.
I took a look at the search results for the 32GB iPod touch and they had clearly marked the products with first or second generation. In fact, the first generation iPod is even listed as having a software update (though that model is discontinued).
I'm not saying that you're wrong, just that everything appears to be in order now.
