august 11 2006 my nightmare about 3 years ago i received a letter from gmac mortgage co saying i am behind 2 months and they needed 3 months to stop forclosure i had proff from my bank that they did cash the checks and they said ok it was there error, now on july 2006 i recevied 2 checks sent back for june and july and now they are saying i owe feb, march ,april ,may and they are forclosing my house and for me to call there lawyer they tap on almost 4000,00 in fees i again called them and got no where i called a place from hemap they are fighting for me but i called my bank they told me that gmac did cash my checks but they did it electronic and didnt send the paper check to the bank but i have my bank statements to prove that gmac received my payments and gmac says they didnt i need a lawyer to sue them bacause now i am selling my house so i dont lose anymore money i lived here 13 teen years and this gmac ever since they bought my other mortgage out they have been messing up my credit saying i missed payments or i am late and they want 5000.00 to re-enstate my account i just cant take it no more this company if stealing my money that i work hard for to keep a good home over my head and my family can someone help me

Hi Rosemarie,
You are being victimized by Gmac. They are intentionally trying to defraud you of your home. Before you do anything rash consider all your options. Can you afford an attorney, if, so; hire the best real estate attorney in your community. Do not pay Gmac the $4,000.00 they are trying to extort from you. Continue to send Gmac your mortgage payments via U.S. Mail, return receipt requested. When your checks are returned put them away for safe keeping.
You stated that Gmac has started foreclosure proceedings. You must answer the complaint that it sent you by filing a response with the Clerk of the Court in your county. In your response you will state why Gmac should not be allowed to foreclose on your property. The Court will set a date for Gmac's case to be heard. I strongly urge you to retain a lawyer. If you can't afford an attorney contact the Bar Association in your community and request they refer you to a ?pro bono? lawyer.
If I were you I would sue the hell out of Gmac. You really do have a slam-dunk case against it. From your report I can see at least five federal and state laws that it is breaking. If you'd like more specific information about Gmac and the fraud it is perpetrating against you respond to this rebuttal or contact the editor of Rip Off Report and ask that you be allowed to contact me directly.
