 From what I heard and saw was a woman (whom I later found out her name was Jenn, sorry don't know her last name) asking for oil. She told a manager (I later found out the managers name was Dawn because the woman asked for it) that I guess she called the store for oil and they said they carried it.  Jenn to the manager that she drove all the way out there and it was hard due to her disability.  I witnessed the manager roll her eyes at her. Then Jenn said when she called they said they had it. The manager said it was probably a season employee and they don't know.  Jenn said they shoul train them. Jenn wasn't rude just told her that and the manager sighed and said there was nothing they could. Jenn asked for the corporate office number and the manager said they don't have it. The manager told her to go to Kohl's website and it would be there.  Jen asked if she could go online and get it for her because it was hard for her and the manager got annoyed and sighed and said they don't have internet access. Jenn asked if she could write downand the manager told her to take out her phone and put it down. jenn said she preferred it written for her due to her disability it was hard to really do this.  the manager told her to go with her to customer service with her.  She made this woman who is disabled walk to customer service.  Clearly this manager discriminated against this woman. I am a paralegal and have witness discrimination and have help try legal cases.  Dawn treated her poorly, enough to make this woman upset.  Dawn should have accommodated this woman and treated her better with her disability.  I went up to Jenn later, gave her my card and told her it wasn't her fault. jenn wasn't rude or nasty and clearly this manager was having a bad day or maybe this is how she is.  She really treated Jenn badly. In my eyes, there was no reason for Dawn to roll her eyes and be nasty.  On top of that, making Jenn walk all the way to customer service.  I know your managers must have corporate numbers and I know they must have internet access.  If you were there and saw what I saw you would have been embarrassed by what the manager did and be disgusted as I was.It was sad to watch a disabled woman being treated so poorly.  I am not going to lie, as a paralegal I told her to call a lawyer because it was clearly discrimination. I hope for the sake of your stores you address this with the manager so she is aware that what she did was wrong.  I was told when I went up to Jenn to comfort her and let her know it wasn't her fault.  Jenn was clearly upset by what this manager did.  In my eyes, as a paralegal I would try to settle out of court because what I saw clearly deserves compensation for what she went through.  I hope I never have to witness this again. The company explained they were sorry and at fault but as soon as she said she wants to be compensated they quickly said they weren't at fault. They gave her the run around, didn't return her calls throughout much of the process and have swept it under the "rug" Horrible and a lawyer should get involved.

I would expect a paralegal to have a better command of written English.

Don't they require any English Composition classes to become a paralegal?

i don't even know a richard??? i just happened to respond to another store blog and saw this and it caught my eye.. whoever you are, you have issues. you are definetely a kohls rep or something to be so invested in this blog.... since you probably are and are so interested maybe gear your energy to training people. if you are a rep for this store you should invest your time replying to this.. hmm maybe i will copy and paste all this on twitter, facebook and different sites and see how many you respond too lol get a life or maybe get off these blogs and do your job idiot to make the company better. the more you blog the stupidier you sound and people will see this as how much free time a kohl's rep has on their hands instead of doing your job lol

wow.... after reading through the comments...i have to agree with the original writer. this is definetely wrong of kohl's..shame on you for treating someone and not owning up to it. i also agree..it is their 1st amendment right to say what happened. also people critizing the writer seems to either be an employee of kohl's, maybe the manager herself or a higher up. so that being said... there is probably a lot more evidence that hasn't been presented in order to protect this woman's case. heck i wouldn't tell all here either

it is sad that she was treated like this and if they saw she was disabled why make her walk kohl's??? seems your manager just was trying to make it difficult for this woman.  i won't be shopping there and have many new items from that store and have receipt for over $1000 of b-day presents. i am returning all for cash lol maybe i will see this so-called manager...haha. i have seen questionable things at that store but this is just mean.

so kohl's..it will be interesting to see how this plays out in court. hopefully it gets updated here. also of course they have internet access and have higher ups phone numbers. come on...do you take all customers as being dumb???? apparently if this woman is filing a lawsuit, the higher ups didn't help this woman. i hope she gets a ton..it will kick it to kohl's for being a horrible place that in this day and age treats people like this!!!

You originally stated..

In your update you stated...

So in the matter of a few hours she goes from needing an attorney to having one and not only that but getting a lawsuit involved.

But this statement is a bit more troubling...

To me as a consumer, find that interesting that they would now change their story. 

- And to me I find it interesting how you try to come off as a regular "consumer" yet you appear to know quite a bit about the entire situation.  It makes one wonder what your true role in this is, as it seems very unlikely that you were just some random consumer walking through the store.

You talk about not being able to provide all of the facts due to a lawsuit.  Well in what law course did you ever take that said it was a good idea to post ANYTHING about an ongoing suit?  As a "Paralegal" you should know that even the bits you have posted could cause issues in court.

Yes she does have an attorney.  It is only slander if the facts are false. I wrote this after speaking the the woman and Kohl's admitted they have corporate #'s and access to the internet. Also it is not about "eye rolling" It is the fact that she made a person who has difficulty with mobilty walk somewhere where they could have easily gave her what was needed while on the floor instead of having her ambulate to customer service.  They did this because they were "annoyed" that she wanted corporate number.  Also they woman spoke to other employees on the way out and they even said the manager has the information requested.  This has to due with treating disabled people with the same respect as you and I.  We may be able to walk to the customer service desk easily, but not everyone is lucky enough to have that ability.  Just recently I have been aware that they admitted the manager should not have done that and that it was wrong and that she did have access to what was requested.  It wasn't until after she wanted compensation did they dispute they were wrong.  To me as a consumer, find that interesting that they would now change their story.  This shows in my eyes as well as people in general that they are guilty just don't want to pay to resolve this.  There is more to the story than I can disclose here. I am unable to provide all facts due to a lawsuit.

A Paralegal?

So I guess since this was such as obvious case of discrimination, that when this person called the store they knew she was disabled and intentionally and only because she was disabled they gave her wrong information....that is what you are saying right?

The last time I checked rolling your eyes at someone wasn't a factor in discrimination.  But perhaps as a Paralegal you have some expert knowledge.  So can you please tell us what exact provision of the ADA did they break when they rolled their eyes at the customer?

Just how many years of experience in the infrastruture of Kohl's do you have to know that they have Internet Access?  Do they give this Internet access to non-disabled people?

As a Paralegal you must work for an attorney, so why didn't you tell her to call YOUR attorney?  For that matter since you apparently know who she is why don't you go to your attorney and have them call this woman?

So let me ask you this one final question.  As a paralegal, what have you learned about Libel and Slander?
