Short summary of events, my husband had to close his small business due to economy , I am a RN that due to chronic and new health issues was unemployed for about 6 months, we got behind on mortgage. We had a bankruptcy in 2010 but have slowly tried digging our way back to surface.
During our current troubles with mortgage , I continued to try to communicate and tried to obtain a loan modification from my lender. Since Dec-Jan, I have called and have been shuffled and told no one can help me bc my loan is in the bankruptcy dept?? I finally get an email from a man that talked loan modification in Jan , he kept asking for the same documents over and over, I submitted them over and over but the process was dragged out until July and he never communicated with me, BUT I with him asking questions and wanting answers , I would send 2-3 emails and finally he would answer me,until finally he says I am denied due to non submitting of paper that was not asked for or was lost??...
I now have their attorney wanting to foreclose. This company would not accept payments when they said it was in bankruptcy ( this was discharged in 2010). I contacted my bankruptcy attorney and he said this was not an issue. I am going to lose my home even after I offer to pay, even after I tried my best at loan modification process, I don't know what to do. I just tried AGAIN to call and same story, in bankruptcy dept and they would not talk to me. They already released to my credit report they have foreclosed. PLEASE PLEASE HELP ME I BEG OF YOU... I have written to US Attorney General of Ky and Tx, to Consumers Affairs.,BBB. Even tried to get a response from their attorney and as usual I hear nothing.. I accidently emailed the wrong company and they were the ONLY ones to return any correspondence... Please help.

The response to my complaints of unfair, illegal, discrimatory, predatory lending and foreclosure practices that I was sent were attachments that were something I already knew..... I am poor. I used to be known as what people called the "middle class" now I am simply poor.I was sent attachments by Ms.Brinkley stating that Nationstar MAILED me 3 letters asking for paperwork and then denying my modification. The only communication I have from Nationstar is simple... it is of 3 ways...
Do I think they deliberately prey on the poor ? YES I do because we are easy targets, we have no money to fight. Do I think they prey on people with know disabilities who will be off work at times? YES I DO, I stated in my modification letter in January why I was unemployed and made the fatal mistake of telling them my disabilities , which does limit my work abilities at times. Which has made us late on our mortgage and did make us file bankruptcy in 2010.PLUS when I filed my complaint with the BBB in TX , there is a flag on their account where they admit no guilt but had to pay a pregnant lady money for not wanting to do a modification because of risk of not returning to work after having baby and during pregnancy.
Do I think they infringed on my rights alloted to me as a homeowner per the DODD-FRANK ACT? YES!!!
- Notification of Foreclosure Alternatives:Servicers must let borrowers know about their “loss mitigation options” to retain their home after borrowers have missed two consecutive payments. They must provide them a written notice that includes examples of options that might be available to them as alternatives to foreclosure and instructions for how to obtain more information.
- Direct and Ongoing Access to Servicing Personnel: Servicers must have policies and procedures in place to provide delinquent borrowers with direct, easy, ongoing access to employees responsible for helping them. These personnel are responsible for alerting borrowers to any missing information on their applications, telling borrowers about the status of any loss mitigation application, and making sure documents get to the right servicing personnel for processing.
- Fair Review Process: The servicer must consider all foreclosure alternatives available from the mortgage owners or investors – those with decision-making power over the loan – to help the borrower retain the home. These options can range from deferment of payments to loan modifications. And servicers can no longer steer borrowers to those options that are most financially favorable for the servicer.
- Clear Monthly Mortgage Statements:Servicers must provide regular statements which include: the amount and due date of the next payment; a breakdown of payments by principal, interest, fees, and escrow; and recent transaction activity.

No Runarounds
When mortgage servicers make mistakes, records get lost, payments are processed too slowly, or servicer personnel do not have the latest information about a consumer’s account, the consumer suffers the consequences. The CFPB’s rules will require common-sense policies and procedures for handling consumer accounts and preventing runarounds.

We are successfully dealing with these exact issues in our office just as you have stated above and we have been able to successfully assert the rights of our clients!
I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like SPS, SLS, Green Tree, Ocwen and Nationstar are simply just scumbags but they can be beat at their own game too just like the big banks can be defeated. You CAN win this fight!!!
It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Nationstar since you have a valid hardship and RIGHTS but I also commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights! With that said, you have overlooked a key aspect to your fight, which is putting it in writing in the form of a proper QWR to regulatory agencies outside of Nationstar that assist in fighting for your rights like the CFPB; your attorney should have also provided with you a letter in which to proceed with modification. I would be more than happy to educate you as to how to fight for your rights.
