Survival Life N/A Sells BRAND NEW Items "As Is" Internet

I recently purchased a Stinger pen (a pen that looks like a regular pen but has a reinforced and sharp ball on the end of the pen designed to be used for personal protection) from Survival Life. They are a company that sells survival and personal protection devices. I purchased this pen as a brand new pen and I figured that, like other items that are purchased brand new, that if the item was or became defective in a few weeks that Survival Life would either repair or replace the item.

I informed Survival Life that the cap would not stay on the pen due to a defective oring in the cap and asked them to either fix it or replace it. They sent me back a reply that stated that I purchased a brand new pen that was purchased "As Is". I was totally unaware of this. I know that used items are normally sold "As Is" but never in my life have I ever heard of a brand new item that was sold "AS IS".

I feel like they can use this scam to deny  adjusting or repairing any item they sell and they sell several items that cost hundreds of dollars. Can You imagine purchasing an item for several hundred dollars and it arrives broken and when you contact the seller the seller says "too bad" the item was sold "As Is"? This is exactly what this company does. This pen only cost me $20 and I am greatful that I did not make a larger purchase because if it arrived broken I would just be out my money.

BUYERS BEWARE! This company will sell you brand new items and when they fail right after purchase they will just say "too bad it is As Is". A BRAND NEW item is sold "As IS". I never heard of this in my life.
