I went shopping at Walmart, my mistake I know. I had a grocery cart full of bagged goods, clothes and such. I was with my Husband and 2 year old daughter They were Eating outside waiting for me. Of course it is really busy there. I went to exit the store and the alarms sounded. The man who was sitting at the stool with Walmart vest on Jumped up and tackled me. I have a bruise on my face and scratches on my arms and legs. All it was, was the cashier had forgotten to take of the security tag from a pair of pants I bought. Isn't being tackled to the ground illegal???? I don't know where to start. Please help me!

Regarding the orange vest guy

AUTHOR: Steve - (U.S.A.)

POSTED: Monday, July 21, 2008

It appears to me that the person involved here was NOT a greeter or a rent-a-cop due to the orange vest statement.

The ONLY employees at Wal-Mart who wear orange vests are the lot guys who gather carts, and the lawn/garden guys working outside with lifts, etc.

It sounds like there is much more to this story.

"The man who was sitting at the stool with Walmart vest on Jumped up and tackled me."

Psst...
Walmart associates no longer wear vests, that ended last year, Also,

"All it was, was the cashier had forgotten to take of the security tag from a pair of pants I bought."

We haven't used the removable security tags on pants since I started working here years ago...

Why didn't your husband put the two-year old on a motorized pony in the cart area - then proceed to stomp the s**t out of this rent-a-cop? Are men so neutered in 2008 America that they do not feel the need to defend their wives when someone assaults them?

If the story is true, you were indeed assaulted by the store employee - who has absolutely NO legal right to so much as touch you. Their ONLY recourse would be to contact law enforcement to report you if they believe that you stole something. They have ZERO authority to stop, detain or tackle ANYONE.

Another person assaulting my wife in any way clears the path legally for me to defend her via snapping his neck in two. I would then sue Wal-Mart for every penny possible since it is THEIR employee who perpetrated the initial assault. Since you have bypassed the first part of that equation, I would suggest you proceed to Part II and contact a lawyer. Given your injuries, they will throw out a settlement offer faster than you can say 'bad rent-a-cop!'

I despise WalMart, and I would love to believe you.

But I can't believe you.

If this were true, you would have filed a police report immediately because this is assault.

A very serious crime, a felony.

I think you're making it up, that's a crime as well.

Unfortunately, as bad as WalMart is, many people make up posts about them. Walmart is a craphole, but they didn't get to be as big as they are by being stupid and opening themselves up to lawsuits by allowing greeters to kick the crap out of customers.

If by some chance you are telling the truth, I would encourage you to file a police report and post the number for all of us to see.

Sounds odd to me

AUTHOR: Jim - (U.S.A.)

POSTED: Friday, July 18, 2008

I know that Walmart has some employees that are less than inteligent, but I find it hard to believe that someone tackled a customer (especially a woman) simply because the buzzer went off. Their buzzer goes off all of the time in situations where the customer did nothing wrong. I realize I was not there, but I am sure Walmart has a code of conduct for its employees, and I am willing to bet that includes not physically abusing the customers. With that said, if this is true, you had to have filed a police report. In that case, you have a very good base for a law suit.

Did you call the police?

AUTHOR: J G Shrugged - (U.S.A.)

POSTED: Friday, July 18, 2008

And seek a consultation with a local attorney. Most will give the consultation for free. While there was probable cause that you may have stolen something (and buy the way, were you hurrying out of the store at the time?), I don't think tackling you was warranted in this case. Not all tackling is illegal. But I don't think so in this case.

Walmart

AUTHOR: Atlanta Guy - (U.S.A.)

POSTED: Friday, July 18, 2008

Find you an attorney IMMEDIATELY !!! Most will take your case on a contigency basis ( you pay AFTER Walmart pays you ). Take pictures of your injuries. If at all possible, get witness statements. SUE for a HUGE amount of money. You have been assaulted and have the injuries to prove it. Make them pay dearly for what they did to you.
