My husband took me to Walmart to surprise me and bought me an IPad Mini.. or what we thought was an IPad. Got it home and opened the box only to find two cut up magazines and no IPad.
I immediately called Walmart and asked for a manager. She got on the phone and told me to bring it in and she'd get me an IPad.
We brought it back and asked for the lady that we spoke with on the phone. Ten minutes later she came out and I opened the box and showed her what was in it. She asked me to put the lid back on and close the box, she wouldn't even touch it. She than asked if it was sealed, I told her yes and I broke the plastic and showed her.
She than told me that it was an Apple problem not hers and that I would have to call them. I had my receipt in hand and paid $350 cash. She didn't scan it or anything and said she couldn't do anything for me.
I asked for her manager. He proceded to take my info and said they'd call me back later. So there I walked out empty handed and crying. Having spent $350 cash I got nothing from Walmart. Not even a sympathetic I'm sorry.

The problem is that they DO NOT KNOW if you are telling the truth. Ipad minis are a HOT item and as such they have to ensure that YOU are not trying to pull a fast one. And before you get all defensive, no one is accusing you, yet. Your story has a couple of tells in it. You said you had to open the shrink wrap. Was the magazine Domestic or International? See at the walmarts I have been in, the employees normally do not have access to a heat shrink gun. If they DO have access, then it means they are on camera when they do it.
The managment staff MUST do a loss prevention investigation. If they search their footage and dont see wrong doing, then they will just assume that your the one pulling something. Its unfortunate, but thats the way it goes. You sitting there and waiting is a good sign that you might be truthful, but then again, they cant arrest you for this so even if they find nothing on their end you would be safe.
Its the way of the world and you ONLY have your fellow consumers to blame. IF it was returned SEALED then the return people at walmart did their job correctly. IF this was something that happend at their distribution facility, the STORE wouldnt know. Bottom line is, your fellow consumers have so beaten and stolen from corporate america that they trust NO ONE!! And YOU are caught in it.
You will have to let them finish their investigation. If it was a domestic magazine then odds are that this happend state side and they should be able to track this down.

I called the police

I called our local police and they said to call an attorney. I've also called a news station and corporate. . I'm waiting for calls back.
But in the meantime I'm sitting in their customer service. The manager claimed that they are investigating it and hopefully it will be resolved today.. not good enough! How long d does it take to see that it's obviously been returned before.
Its their mistake and I'm sitting here until they fix it. The manager acted surprised when I told him that its been happening a lot and to look it up online.. really?! I was smart enough to look it up, come on Walmart!

If you paid by credit card, call them immediately and cancel the transaction. Tell them you did not receive the product.

I am not sure if the police would be interested but I would have called them before I took the item back. Your return would hold a lot more weight if you walked in with an officier.
