This is an excerpt from a front page article n the December 13th, 2010 edition of the Philadelphia Daily News:

"A job sought at Walmart

About the same time, **** had an interview for an overnight-manager position at a suburban Walmart. After being out of steady work for more than a year, he had planned to work both jobs.

He gave the company permission to do a complete background check and disclosed in writing his misdemeanor convictions, he said.

A week later, Walmart sent him a denial letter and a copy of his background check conducted by General Information Services, a background-screening company based in South Carolina.

That background check said **** had been convicted in 1996 of felony cocaine possession in Gloucester County, Va., and sentenced to 10 years in prison.

"I have never even been to Gloucester County, Va.," **** said. "Back then, I was still in high school."

After receiving the report, **** said, he called GIS to dispute the information.

More than two weeks later, the company cleared his criminal-background check of the false felony-cocaine charge, according to GIS records he received.

On his own, **** had his fingerprints taken at the Pennsylvania State Police's Belmont Barracks and sent them to the Virginia State Police to demonstrate that he was not the man on their records, he said.

"GIS said they dealt with it, but I didn't want to leave any stone unturned," he said.

It was too late for employment at Walmart, where **** had been red-flagged not only for the false cocaine charge but also for his legitimate misdemeanors, he said.

And GameStop, where **** said the bosses knew about his misdemeanors when they hired him, refused to hire him back after the felony-cocaine charge was cleared.

"They told me I had to reapply to see if I could get another position with the company," he said. "Why should I have to reapply when you let me go off of false pretenses? You didn't even give me a chance to explain."

The Daily News was unable to confirm that GIS was the company that also conducted ****'s criminal-background check for GameStop. A GIS spokesman said he could not disclose clients' names, and a GameStop corporate spokesman said in an e-mail that the company "does not provide public comment on employment matters."

****, however, said a GIS representative told him by phone that the company also had conducted his GameStop background check. **** added that GameStop's human-resources department confirmed that they had used GIS.

Unemployment in jeopardy

Meanwhile, GameStop also is trying to appeal**** 's unemployment benefits.

In a Dec. 3 letter to Pennsylvania unemployment-compensation authorities, a cost-management agency contracted by GameStop wrote that **** had been "discharged for falsification of his application. He did not list on his application a felony for drug possession and distributing."

Now, ****, who has not had steady work since April 2009, wonders how many other jobs for which he applied turned him down because of the inaccurate background check.

"I've applied for many different positions," he said. "God only knows how many positions I applied to and they saw this mistake and it got read over and over and over."

Unfortunately, to Lillie Coney, associate director of the Electronic Privacy Information Center in Washington, D.C., ****'s is a familiar story.

"Background checks are pretty routine now, even for positions that don't require trust that they manage money or things of value," she

"For every one person you hear this happens to, there may be thousands of people who don't know this happens," she said.

"This the worst-case scenario because you're not going to be brought to trial to argue your innocence because you've already been found guilty and you don't even know it."

Lemens, who said he was prohibited from speaking about specific cases, said GIS' background checks are not guaranteed accurate.

"Of course not," he said. "You know when you see in the movies there's some kind of instantaneous universal background check performed? There is nothing like that. This is a process performed by humans. . . . Whenever there is a human element, there could be inaccuracies."

Lemens said the company has run into situations in which court records are inaccurate or "even made up."

"We, of course, can't make sure the public records are accurate," he said.

That's part of the problem with data brokers, Coney said. "They know the documents they are getting have errors, but it does not stop them from using [them]," she said.

"The core foundation of their business is telling their customers how many bad people they know about. They are not into telling someone what a wonderful person this is, because they don't want to be held accountable if something goes wrong."

Coney said the only way to manage the unregulated data-broker industry is to make it transparent and allow people to view their backgrounds regularly, as they can with their credit scores.

"Individuals are the only ones who are going to know if the information is accurate," she said.

No one is held accountable when a bad background report is produced and sent to an employer, Coney said.

"The problem is they are not getting penalized for doing this, so they keep using bad data practices," she said. "They are vilifying the names of the people who have no idea their names are even out there."

For Kevin ****, the problems persist.

"I don't want to be out of work," he said yesterday. "I wanted to work, I wanted to collect a paycheck, I wanted to work two jobs at one time. . . .

"Overall, it really has put my back against a wall, and the worst thing about it is it wasn't of my doing. I actually wish that some people in higher places could hear my story and see that some people actually do want to work."

I worked for Wal-Mart for years and know their processes.  Based on the info given I can say it is unlikely that he would have been hired by Wal-Mart for an overnight manager.

First I am trying to figure out what he means by overnight manager.  While it is a position it is merely one of the many positions that a normal assistant manager rotates into.  Normally two assistants will work over nights 4 days a week each.  Some stores only have one and have a support manager who handles the other nights.  Also some bigger stores may have one or more support managers who help the assistant managers.  I am assuming he was applying for a support manager position.

Second I am not sure if he has the background to qualify for this position.  The support position has changed a bit from what I understand and there is a new position but anything at the support level and above requires experience to be hired outside the company.  In fact I am surprised this position was offered outside the company period.  I knew a former Sam's Club manager who took this overnight support manager position.  So as you can imagine they want top quality people for it.  It sounds like this guys experience was as some sort of manager at Gamestop.  But it's unclear if he was the store manager there.  A store manager there with a lot of experience might be qualified to be a support manager but Wal-Mart experience is worth more.  In fact my Wal-Mart experience as an employee got me my first management job at Hollywood Video(similar pay and level of retail to Gamestop).  A store manager at this level is basically similar to a Department Manager at Wal-Mart but has more P&L/Hiring responsibilities and gets paid in some cases more. 

Third while it is illegal to hold crimes against a person unless related to the position without knowing what said crimes are I can't even begin to tell rather or not they have a valid argument for using them.   Though I do not think they need it.

Fourth and finally the fact that you were working another job and trying to get hired as a manager at Wal-Mart would get your rejected automatically.  Wal-Mart will not work around another work schedule and at times will not hire part time people with another job.  A full time position that is important you have no chance if you tell them you plan to keep both jobs.

If you haven't done so already please take a look at ROR 713383. Sounds like someone else had a similar experience with GIS reporting bad info on him.

Looks like GIS may just be running reports on peoples names since the person in ROR 713383 had to do a check with the courts himself. The people listed in the report from GIS did not even have the same social security numbers as he did.

Hope you can use the info.

Your problem is with GIS not Walmart

Not saying that Walmart is a model employer or anything but it seems to me your problem is with GIS and not Walmart.

Although I think it is great that you were willing to work two jobs I heard somewhere that Walmart tends not to hire people that are working other jobs in this case I would say that if you were applying for a management position then even though you have the basis to go back to Walmart with proof that the felony charges were false that you would not get the position because you planned on working two jobs (did you disclose that to Walmart).  I wish I could remember which news story I heard it on (or maybe a documentary) but they would not even hire people that were considered oncall because of any scheduling problems with the other employer.

What other protected class are you in that would rate this as a case of discrimination? You seem kind of tight lipped about the misdemeanor so no one other than you or Walmart can determine whether or not it could possibly interfere with your position as a night manager.

in the United States of America is mostly corrupt, and they will be on the side of the BIG corporations, who keep most of the Law Firms in this 'corrupt' country in business, in my opinion.

Companies like Wal-Mart, Bank of America, JP Morgan Chase, Citigroup, Toyota, and many others, are all out to make profits any way possible. Most of them financially injure innocent consumers every day! These corporations will retain law firms that are also corrupt, and on the side of the corrupt people who run these corrupt corporations, to represent them.

You can try suing them, but you probably won't get very far, in my opinion.

Just expose them all over the web and make a big picket sign and stand outside of the Wal-Mart (off of their property) and direct everyone to this website and to your Ripoff Report. It's 100% legal, and it'll get the attention of hundreds, and possibly thousands of people who might boycott Wal-Mart.

Kevin,

You have obviously been hurt by the incompetence and negligence of others, and you should be paid. I would sue everyone involved.

Everyone involved here is engaged in the old "pass the buck" game, and you need to reel them in and get paid.

Stay off the phone, get as much documentation on every statement made and file lawsuits.

GIS actually has a legal obligation of "due diligence" in the verification process of any information they pass on to anyone else, such as an employer.

Be sure to appeal the unemployment thing as well, as that is bogus.

Big companies get away with this as they always assume that you don't have the time or money to follow through to hold them accountable, and will just go away.

DO NOT just "go away" on this one, as you can get PAID!

Be sure to pull credit reports from all three major credit bureaus as well to be sure there is no connection there such as an identity theft situation where you are meged with this other person.

File lawsuits under FTC rules in FEDERAL COURT right away. There are several good websites and services where you can get all of the information you need to prepare the complaints and file them in court, all without a lawyer. I have done this myself. It is very hard work and time consuming, but it WILL pay off, as YOU ARE RIGHT!

Never back down when you are right.

Just because you "disclose"convictions doesn't mean they have to hire you. Or even if they hire you that when the "official" background check comes back that they have to continue to employee you. Regardless of if there was wrong information that was corrected, according to the newpaper article you were still "flagged" because ofthe MISDOMEANERS..which were legitimate. I am not saying that GIS was without blame and if you can prove that they caused you problems that you may not be entitled to something.

As for the other companies, there is really no way for you to 100% know if you were never called back ONLY because of the Felony that was listed. Because you are at a time when the job market is competitive. Alot of the companies you never heard back from may never have even run a background check..because you didn't get to that point where it mattered for them. Or even just you disclosing the misdomeaner was enough to disqualify you.

As for the rest of the "article". If your unemployement is being challenged and it was because of the false information then that should be an easy win for you. Yes it is going to probably take some appeals but in the end you should be fine.

If you were such a model citizen before and have been a model citizen since then why haven't you looked at getting your records expunged?

1) The misdeameanors are legit. I plead guilty to them in 2002. They were informed in advance during the interview and I placed them on my background check paperwork. In Pennsylvania, it is illegal to no hire an individual for having a criminal background unless it coincides with the job. My misdeameanors do not.

2) The misdemeanors were done 9 YEARS AGO! First and only time I was in trouble with the law. Since then I have obtained a secondary education and have worked for comcast and yellowbook USA. Neither job was lost because of something illegal. Was laid off from one and resigned from the other.

3) Even after the Felony was erased, they still red flagged me. You were informed of the misdeameanors before hand. This is discrimination. Plain and simple. There are laws protecting every citizen, even those with criminal backgrounds. Please read these laws before making a just rebuttal.
