We have a rental use that we have coverage on. The unit needed was not cooling properly so we filed a claim. The first tech they sent out was extremely rude and short tempered. He didn't have the 5 minutes to wait time for my tenant to get a hold of me to see if I would be willing to pay for extra services. He said nothing was wrong with the unit - it just needed cleaned. He didn't perform any service, packed up and left before I even had to time call my tenant back. I filed a complaint with Choice about the tech and they assigned someone new.

The next tech they assigned didn't show up at the time they told us they would be there. He said he had a more important job and wasn't worried about us. That he would come when he had time to get around to it. I filed a complaint again. The next tech they assigned also never showed up and when I called them they said they totally forgot about the service ticket. I again filed a complaint again. The fourth tech went out, determined that the seals on the compressor have gone bad and it needs replace. He said the coils are in good shape, they are clean and the fins show no sign of damage. He called Choice, but Choice informed him that the compressor failure was due to lack of routine maintenance and would not be covered. This is based off the fact that the first tech filed paperwork that nothing was wrong and it just needed cleaned.

A manager informed me that they have since stopped using the first company due to multiple complaints about service. However, due to his report to them that the unit was dirty, they are claiming the compressor failure is not covered. So, now they are requiring me to provide documentation that I have had it cleaned yearly by a certified HVAC tech to prove that the failure isn't lack of maintenance. I have a home warranty so I don't have to pay for this time of repair. I went through 3 different AC companies and then they stand one a statement from an AC contractor who is less than reputable. They aren't going by what the 4th tech that they sent out said. They look for any excuse they can to avoid paying and file it under not being maintained regularly.

Sorry I didnt add this part in the first statment. It has been cleaned every year by my handy man. But sense my handy man isnt a certified AC tech by there standard then they wont accept his work. It doesnt say anything in the paperwork about having it maintained by a certified AC tech. it just says it needs to be maintained.

So, I am doing my part. they are just looking for a way out of paying.

 If the FIRST tech that came out found that YOUR AC unit was "dirty" then the warrenty company is going to go by what THAT tech found. The reason being is that YOU could quietly pay for a cleaning and then get another tech out there to give YOU the OK to have the work done. Believe it or not, THAT is a form of INSURANCE FRAUD!!!! People go to jail over a lot less with insurance fraud. So the first tech found that YOUR unit has NOT been regularly maintained. THEY know this because unless YOU live in the sahara desert it takes awhile to build up THAT MUCH dirt. Which would mean that it has been awhile since your last servicing of the unit. YOUR issue is probably the same issue that MOST consumers have. And that is that you DID NOT READ!!!! Yes its a lot of fine print. Yes it IS a pain in the rump. BUT!! It IS your responsibility to maintain your equipment and THAT is outlined in your warrenty contract. YOU would know this yourself had you taken some time and read. YOU have made assumptions as to WHAT is covered by your warrenty. YOU do not know what is covered specifically because you did not read the paperwork. Yes it IS their job to deny claims, especially those claims where the customer HAS NOT done THEIR part. THAT is why they want maintenance records from you. To PROVE that YOU did indeed maintain the equipment and had a yearly routine check up done on the AC unit. If you have not had this done, then it makes PERFECT sense. WHY would they throw good money at YOUR problem when YOU didn't even have a yearly check up done. As far as THEY are concerned even if they DID do this job and pay out all that money, YOU would probably fall into your old habits of not having a yearly check up done. YOU and I both KNOW that YOU have not even paid enough into the warrenty to even afford a new unit being placed on your property. So in the future I would suggest that YOU read ALL available paperwork presented to you and YOU do some research online BEFORE you file a claim. This way YOU can avoid all that hassel and frustration. Just because YOU have a warrenty doesn't turn that warrenty company into YOUR personal bank to pay for all YOU need completed. There is ALWAYS addendums and codices in ANY contract. YOU need to KNOW what YOU need to do in order to file a successful claim. In this instance it was regular maintenance. NOT A RIPOFF!!!! Its just that YOU did not do YOUR part and THEY wont honor a warrenty where YOU did not do your part. Its simple common sense.
